MEMBER DIARY

So, Who Watches The Watchers? Holder In A Political Witch Hunt Of Sherrif Joe Arpaio!

Let me introduce you to one Maximilien François Marie Isidore de Robespierre.

Many no doubt are familiar with the story of this despicable personage…but for those of you who do not know who Robespierre was, the long and the short of it is, he is the man who sent tens of thousands of his countrymen for a final appointment with Madame la Guillotine in what has come to be called the “reign of terror” in the aftermath of the French Revolution.

After the fall of the monarchy, France faced more food riots, large popular insurrections and accusations of treasonous acts by those previously considered patriots. A stable government was needed to quell the chaos. On 11 March, a Revolutionary Tribunal was established in Paris. On 6 April, the nine-member Committee of Public Safety replaced the larger Committee of General Defense. On 27 July 1793, the Convention elected Robespierre to the Committee, although he had not sought the position. The Committee of General Security began to manage the country’s internal police.

Though nominally all members of the committee were equal, Robespierre has often been regarded as the dominant force and, as such, the de facto dictator of the country. He is also seen as the driving force behind the Reign of Terror

A simple declaration that a person was an enemy of the revolution from Monsieur Robespierre was oft all that was required to have one’s head removed from his shoulders by way of “The National Razor”

Robespierre is the very definition of what unchecked and unaccountable raw POWER can produce. Answerable to no one, political enemies were slaughtered by the wagon load until finally, this rogue of rouges had his own head removed as an enemy of the republic when his countrymen finally had enough of his arrogance and hubris.

Just deserts?

Perhaps, but the irony of ending up with his neck sliced through by the very same instrument of his absolute power is inescapable.

Fast forward some 216 years across the pond and we find ourselves confronted by a modern day Robespierre in our nation’s capital. The instrument of terror and power have changed but the reign of terror being wrought upon this nation is no less terrifying even if it is thus far less bloody. How ever you slice it…the tactics remain the same.

So, what are you talking about Ace?

U.S. may sue Arizona’s Sheriff Arpaio for not cooperating in investigation

A federal investigation of a controversial Arizona sheriff known for tough immigration enforcement has intensified in recent days, escalating the conflict between the Obama administration and officials in the border state.

Justice Department officials in Washington have issued a rare threat to sue Maricopa County Sheriff Joe Arpaio if he does not cooperate with their investigation of whether he discriminates against Hispanics. The civil rights inquiry is one of two that target the man who calls himself “America’s toughest sheriff.” A federal grand jury in Phoenix is examining whether Arpaio has used his power to investigate and intimidate political opponents and whether his office misappropriated government money, sources said.

The standoff comes just weeks after the Justice Department sued Arizona and Gov. Jan Brewer (R) because of the state’s new immigration law, heightening tensions over the issue ahead of November’s midterm elections. The renewed debate has focused attention on Arpaio, a former D.C. police officer who runs a 3,800-employee department, and a state at the epicenter of the controversy over the nation’s estimated 12 million illegal immigrants.

Keep in mind, this is the Washington Post which is the propaganda arm of today’s version of Revolutionary France’s Committee of Public Safety but it’s worth the read even if the story is simply a steno-graphed version of DOJ talking points.

Bottom line is this…move the whole story forward 216 years. Instead of the accusation of being an “enemy of the revolution” now it is the only necessary to accuse a local law enforcement official of “civil rights violations” to bring today’s version of the “Committee of Public Safety” sniffing around in search of anything that can be found to justify the destruction and political death of Sheriff Arpaio. No use declaring your innocence…you are guilty until the committee decides whether you are guilty or not just before it sentences you to it’s pre determined penance

So, Secretary Holder….Today’s version of Monsieur Robespierre has his committee, in the form of DOJ Lawyers who will go down to Maricopa County and comb over every single arrest report of every single Latino that has been arrested, questioned, or convicted of any offense since the good Sheriff has been in office in order to trump up as many cases of civil “alleged” rights violations as possible.

The civil rights division’s investigation began in March 2009 and focuses on whether Arpaio’s department engaged in “discriminatory police practices and unconstitutional searches and seizures,” along with allegations that his jail discriminated against Hispanic inmates, according to letters the division sent to Arpaio. A complaint to the Justice Department said that even bilingual jail guards are required to speak to inmates only in English and that the rule could endanger prisoners’ medical care. The jail was also accused of forcing Hispanic visitors to fill out a “citizenship check” form, the letters said.

Add to this simultaneous DOJ investigations as to whether Arpaio ordered investigations of political opponents, (pot calling the kettle black?) and yet more federal investigations as to whether The Sheriff has misappropriated federal funds and it seems pretty clear to a casual observer that there is an all out push by the most powerful law enforcement official in the land who serves at the discretion of the President of the United States to destroy a man elected to his office over an over again and has become a symbol of law and order for millions across this country.

So…with all that said…I’ll make a prediction…it’s not really a prediction because the handwriting is on the wall. It’s simple common sense really…

The DOJ will have it’s investigations….it will obtain it’s court order to obtain records and the fishing expedition will commence. There is about to be a virtual army that will descend on Maricopa County…and they will dig and dig until they have destroyed Sheriff Joe. Our laws have become so far reaching that I don’t care how honest you are…no matter how diligent you try to be in complying with every jot and tittle of the law today…if a prosecutor is determined to take you down….down you will go because no one can keep up.

The long arm of the DOJ will get their man. Even if they don’t, they’ll tar and smear him while simultaneously costing the county so much money complying with their witch hunt that the voters will throw the Sheriff under the bus just to get Holder off their backs…

Meanwhile…who is watching the watchers? Who is holding the Obama Justice Department accountable. Who is out there to make sure Mr Holder is not abusing HIS power? \

There is no unbiased reporting here on the subject because the Arizona Republic (or as JD Hayworth calls it, the Repugnant) is a staunch opponent of Sheriff Joe Arpaio and everything he stands for, it seems.

This may well end up with charges being brought that claim Sheriff Joe has committed racist acts because he’s looked for lawbreakers where most of the lawbreakers live.

Interesting, isn’t it? Who has been unjustly accused and tried by the DOJ in recent years. Ted Stevens, Tom Delay, two border patrol agents, Scooter Libby, and now it may be Sheriff Joe. All of them either Republicans or in what the press would call “conservative jobs.”

    • AceInTX

and even if they don’t find any obscure law that has been broken, they’ll end up getting convictions for making false statements in an investigation such as what happened with Scooter Libby where no underlying crime was shown to have been committed but that a lie was told to the Feds during the investigation

      • Scope

Fitzy is still busy Scootering Blago. Then again, they may decide to let sleeping dogs lie with one of their own, and go after the real enemy, the Republican Sheriff Arpaio. They want to get the Sheriff for “racial profiling” yet the BP who said “if you want freedom you will have to kill some crackers.” He walks free today and unpunished.

Thanks for writing about this Ace. One of the tipping points for Obama and his entire admin., was in going after the state of Arizona’s 1070 law. A majority of the population is with Arizona, and, many states are poised to pass similar immigration legislation. Now they have chosen their target (Arpaio), personalized it, and will try to ridicule him. They will undoubtedly drag the Sheriff, through the mud, but, I believe this time it will be a fatal blow to Obama, Holder, and everyone at the DOJ. As you said yourself, the Sheriff is a national hero for his tough stance on illegals. No one wants their hereos abused.

the bringing of charges where underlying charges can’t be proven and so all they get is lying about some tangential issue.

          • Scope

I am sure Blago is guilty of being involved with selling the O’s hot seat. Can’t find any other meaning to “It’s bleeping golden.”

The problem I have with the trial is that tapes were allowed to be played in court of Blagos conversations, but, the O, Emanuel, and a host of others, also recorded, were not allowed. Fitzy was obviously allowed to subpeona anyone he wanted, but, the Blago defense was barred from subpeoning those DC thugs that I believe were very much so involved. If Blago is going to sit his butt in jail, then so should the rest of the cast of the characters involved. That’s not justice served according to the law of the land, but, it would have been an injustice to pick and chose your criminal of the day.

I read that the WSJ is asking for Fitzy to resign, or to be fired.

when it comes to anything Chicago, you always can expect there to be many side streets that you didn’t go looking in.

If the story about the jurist can be proven, then I would think the entire trial would be considered a mistrial. Wouldn’t there be some type of punishment for the jurist?

I understand that Fitzgerald was considering filing paperwork for another trial next week, apparently on some of the same charges. If that story is true, he will be running to the courthouse as fast as he can.

Some are calling for Fitzgerald to quit or be fired. I’m sure there are many more just like him in the gutter he crawled out of.

The best part of this is that it will stay in the news all the way up to the mid-terms, and I think most are pretty tired of Chicago corruption and thuggery. Wasn’t Alexi G also brought up in this trial in some way?

          • gekster

Is why this juror had a pre-concieved notion of innocence before the trial was even half over.
The forman should have reported her, and got things straightened out.

hated entrapment, and I think this result as with Scooter Libby, are a tangential version of same.

more later…on this subject, maybe…as I am VERY busy trying to get paid and with other writing commitments.

“Scooter”: verb transitive–To pursue a defendant or ancillary figure in a politico-criminal investigation beyond the point at which the original charges have been determined to be prosecutable or not, in order to generate a charge of “lying to the investigator,” whether the lie is germane or not.

Examples: “Patrick Fitzgerald Scootered Karl Rove while he was in the process of Scootering Scooter Libby.”

“Patrick Fitzgerald says he will Scooter Blago if he can’t convict him on anything else.”

require a column soon denouncing certain fbi witch hunt/congressional political investigations and prosecutions, sting operations in general. I have always held this view. It also applies to the vague definitions of insider trading.

  • renny

astronomical fees and costs defending himself.

If we are to have rule of law, we have to defend those legally policing us. Holder and crew are just political hacks playing Chicago thug tactics.

Vote. Rep. in Nov. and maybe a GOP Congress can investigate the investigators. Supposedly, Issa is already lining up his committee and focusing on this administration’s flagrant illegalities and corruption.

  • mbecker908

Arpaio has been investigated by the Justice Department dating back 10+ years, by both Republican and Democrat administrations. He’s been taken to court numerous times and the county has paid out hundreds of millions of dollars in fines and judgments because of the way he runs his little shop of horrors.

Arpaio may win kudos for being a “tough sheriff”, but in fact he’s arguably the worst law enforcement officer in the state of Arizona. It’s not just the Republic that doesn’t like him, you can add every county sheriff in the state. You can add the police chiefs of every city in Maricopa County.

He’s also been investigated by the Maricopa County Council for budgetary problems and a host of other stuff and he was being investigated by the state just before Janet Napolitano was elected. Joe came out and endorsed her and after she won – beating Matt Salmon, a fantastic conservative – by less than a point and with less than 50% of the vote, the state dropped their investigation.

You want to go off on Holder and the DoJ, fine. Just find something else. On this one, Holder’s probably right. And for God’s sake, don’t send money to Joe. Send it to the Republican candidate of your choice to retake the House and Senate.

    • aesthete

There’s a lot to loathe about the way Obama, Holder, and co. do business, both in the legal realm and otherwise. Arpaio isn’t one of those reasons: he costs the state and his county much more money than what he saves with the Tent Cities and other such measures, lets his officers have unchecked reign, and runs roughshod over the rights both of those he arrests and those who have done nothing wrong. Here’s a good list of a whole bunch of them. I’m not a bleeding heart on the issue of prisoners’ rights, but Arpaio consistently crosses the line in a big way. This shouldn’t be a Republican or Democrat issue, but an American issue.

He gets away with it because he’s a great publicist, and because he manages to make himself look like the perpetual victim in all of this.

      • AceInTX

without regard to whether there is any evidence there has even been any wrong doing?

        Justice be damned!
Tyrannical over reach and raw power poltics be damned!

We don’t like the guy so we’re just going to turn a blind eye to the unjust, unconstitutional and despicable tactics a fascistic Democrat administration is using to destroy him?

        Brilliant!

        • aesthete

We should oppose the guy because, in addition to his being a jerk whose station consistently and intentionally violates the rights of citizens, his selling point and supposedly redeeming feature (namely the supposed cost-effectiveness of his measures) is a complete lie.

If you can point out to me where the charges against him are false, I’d defend him: I’ve defended the rights of Nazis and Muslim extremists on this board, so I guess defending Arpaio would just be my latest hated person to be defended by me. Near as I can tell (and I haven’t looked closely at Holder’s case), the case they’ve assembled against him is legitimate. If it’s not, there’s plenty of other stuff that he should be nailed on concerning civil rights violations. If Arpaio is indicted (yet again) on a legitimate issue, I will have no problem with it, and he is far from a martyr.

          • AceInTX

without being tagged with anything significant is a good place to start.

and don’r obfuscate the issue here…this isn’t about defending Arpaio per se it’s about an out of control justice department over reaching and abusing it’s authority.

And now you are making it about going along with the Obama Justice Department in it’s attacks on a local law enforcement official with no evidence to speak of simply because you don’t like the guy.

Pretty shallow thinking on your part methinks

          • gekster

and your hispanic, and I catch you breaking the law, and I arrest you,
            I’m violating your civil rights.
            huh?
Can you tell me whose civil rights he has broken, and how.

          • AceInTX

nothing I point to here is a problem for Aesthe because he just knows Arpaio is a bad man and any means to Obama Justice department employs to bring down the bad man is fine.

            Understand now?

          • gekster

More or less he broke the law by enforcing the law .

lest you prove yourself a fool…

They have no case beyond the usual suspects complaining about civil rights violations.

That’s the reason for the fishing expedition. The DOJ waltzes in without a grand jury so far as I know…or any judicial oversight and starts demanding documents.

Arpaio tells him to take a long walk off a short pier…thus the lawsuit to compel the sheriff’s department to comply.

If there are real violations here…and the DOJ can prove wrong doing…then let them get the required search warrants…let the formal charges be brought and let the investigation be conducted in a constitutional and legal manner…but they won’t do that.

    • AceInTX

over ten years, Arpaio has been investigated by two administrations, the state and county the Maricopa council yet he’s still standing isn’t he…and he keeps getting reelected so he must be doing something right.

The witch hunt is real and the issues I am bringing up are valid. Holder doesn’t have squat to charge him with and can’t site any grounds to justify his witch hunt which is why they are demanding documents without sighting any law or constitutional authority to do so.

They won’t know if there are any charges until they get their hands on the documents and dig to find the rope to hang Arpaio with.

I don’t care if you like Arpaio or not…but this issue is the unchecked power that is being brought to bear here with NO legal or constitutional authority what so ever by the USDOJ against a locally elected representative of the people with no concrete evidence that any crime has been committed.

      • Scope

I don’t live in Arizona, and, I am sure not on the up and up with Arpaio. I do remember over the years reading about the many cases brought against him, yet, it seemed that nothing stuck. Arpaio has been re-elected many times. That must mean something.

My biggest problem with those that have consistent arguments against Arpaio, is in giving the Holder DOJ a pass, and, saying that they are probably right in this case. It absolutely says that it’s OK to go after someone I don’t like. It says that 2 wrongs really do make a right.

As far as the Holder DOJ, they have never, to my knowledge, come out in favor of anything lawful, or Constitutional, or even American. To use the DOJ in this case to back up an argument is more than hypocritical.

the Dems have been perpetrating this last 10 years. Stevens just exonerated from his nightmare of injustice. DeLay is approaching 10 years, DOJ just jettisoned its investigation and two of the state charges have been thrown out. Then there was the Duke LaCrosse team and Scooter Libby. I hate to say it but there is only one way to stop this. Full scale legal counterattack. When the Dems’ cases finally fall apart, we don’t shake hands and praise the justice system. We go after Ronnie Earle, the DOJ attorneys, Mike Nifong. Malicious prosecution, wrongful injunction actions, disbarment, contempt of court. Nifong’s case has shown the way, he got full disbarment, real sentenced jail time for abuse of prosecutorial powers and lying to the court. Asking Dems to play nice won’t do anymore they are fighting dirty and in it too deep. These legal actions are the only thing they (Dem prosecutors) will fear and understand. When they get the shaking fear of God in them for abusing their fearful powers, they will refuse to carry out their (DNC, trial lawyer and union interest groups) masters’ wishes

we will be nice to them in hopes they will be nice to us. We will let them have their President’s SCOTUS appointments in hopes they will let us have our President’s, when his/her time comes. We will not pursue malicious prosecution because gentlemen don’t do that and we would have to scour in the streets to line up the witnesses and evidence that’s there a plenty, heaven forbid.

Nobody back in the district cares if they’re mean to some East Coast castati or prune-faced bad tempered lefty woman. But, the Georgetown set they all get sucked into cares. If senators were still appointed by legislatures, we could just order them to come home very weekend, yes, even mine and I’d be willing for my state to pay for a G-5 or such so they could do it. Heh, that’s a good idea; I might get a ride on it one day.

because I was always uncomfortable with what was done to Trent Lott but I cheered when Bush turned his back on him in favor of Senator Frist because I saw Lott as totally inept as a leader. so I can see where he is comong from…

but what was done to Lott was wrong…and what is being done here is infinitely worse in that we are using the proprietorial powers of an Executive branch cabinet level agency to target, harass, and destroy local official because that official’s behavior offends the establishment’s delicate sensibilities!

This is a naked and raw abuse of power and prosecutorial misconduct of the highest order and anyone who lays down and tries to pass it off as nothing because they don’t like said local official should be ashamed of themselves!

our government has gotten so large…and our laws have gotten so arbitrary and voluminous that anyone in this country can be frog marched off to jail if a power hungry cad with investigative powers wants to put them there.
