Breaking: Court Rejects Bid To Restore Drilling Moratorium

Alternate headline: Jobs Were Saved

A federal appeals court on Thursday rejected the federal government’s effort to restore an offshore deepwater drilling moratorium, opening the door to resumed drilling in the Gulf while the legal fight continues.

A three-judge panel of the 5th U.S. Circuit Court of Appeals ruled soon after an afternoon hearing in a lawsuit filed by companies that oppose the drilling ban. The moratorium was struck down June 22 by U.S. District Judge Martin Feldman.

The Interior Department argued the moratorium was necessary while it studied deepwater drilling risks in the wake of the BP oil spill. Government lawyers asked the appeals court to let the temporary drilling ban stand until the 5th Circuit ruled on their appeal of the lower-court ruling.

Even Democrat Senator Mary Landrieu knew the damage the moratorium posed:

A Gulf of Mexico moratorium on deep-water drilling put in place after BP Plc’s oil spill may cause “almost unfathomable” damage to state and local government finances, U.S. Senator Mary Landrieu said in a court filing.

I would not have made that arguement, but her heart is in the right place.

Not much has changed.

As long as Salazar can threaten another moratorium (this one with some veneer of justification), no operators will put a rig back to work & take that risk of getting shut down again.

The blogger formerly known as ‘Vladimir’.

Next up, SCOTUS...... When that fails, then........

…….. he’ll simply cut an exec. order and (try to) shut it all down, not just the drilling rigs on this moratorium – all of ‘em – everywhere in the water.

Betcha he’ll go for it.

Any takers ?

Heh. That could be fun to watch...

I’m not sure what would happen, but .. exposing the agents (erm, agencies) of the Executive branch to lawsuits could get interesting, especially since Obama has guaranteed himself a hostile SCOTUS…

I could not bet against that, but

what does Obama do when his massive drilling shutdown drops Gulf refineries throughput, in short order, from high 90′s down to 90%, then 85% – then the price of a bbl of oil recaptures a $20 fear premium on top of a following- up 15% increase in world mkt price of oil -in very short order no less – in high summer drive time in the US – in simple language this means $4/gal+ at the pump PDQ. And no not just in Louisiana; in NYC, Chicago, Los Angeles and lots of other Blue places. Is there no one in this man’s circle in the WH to tell him of his madness to his face, for the sake of the country? The very last thing this economy needs right now, is an energy price spike shocking its way through the system. We’re talking macro-economics here, this all plays out to the worse unaffected by whether they cap Deepwater Horizon well or not. It’s like we don’t have a President, we have a mad Roman Emperor raging and foaming at the mouth.

$4? It's bobbing a little under $3 here already.. I expect to see $6 this year. nt

dear friend RSers with the truth – but the truth is, your estimate is much closer to – the truth.

The cost of electricity will necessarily skyrocket.

Kenny Solomon (Diary) Thursday, July 8th at 10:30PM EDT (link)

Yeah.

So will the cost of shipping ammo to retailers.

Did I just say that ?

You just did the amazing, you snarked into plain truth

As they say, “Oil is in everything.” Computers, medicine, cost plane tickets, clothing, as well as gasoline. I’m sure it’s in the ammo or the gun cleaning fluids too, let alone fueling the trailers bringing it to your local friendly gun shop.

This is great!

Another slap in the face for Obama…they are laughing him out of court.
Has he exhausted his best arguements?

It is great but this is not instilling confidence in the oil drillers

izoneguy (Diary) Thursday, July 8th at 10:45PM EDT (link)

The oil producers are still leaving…..

SO in one respect Obama is getting what he wants.

I am afraid with all of the funky business that Obama
is doing behind the curtain it will be hard to re-gain
the confidence of oil producers in the future.

Until the Dept. of Energy, OSHA, and the EPA get
some kind of rational people in place – it may be lights out
for millions of Americans. And this is what it may take to
push those folks away from the progressives and the socialists.

Those who had once simpered: “I don’t want to destroy the rich, I only want to seize a little of their surplus to help the poor, just a little, they’ll never miss it!” – then, later, had snapped: “The tycoons can stand being squeezed; they’ve amassed enough to last them for three generations” – then, later, had yelled: “Why should the people suffer while businessmen have reserves to last a year?” – now were screaming: “Why should we starve while some people have reserves to last a week?” – Atlas Shrugged

I do understand and agree.

snowshooze (Diary) Thursday, July 8th at 10:52PM EDT (link)

When so much investment is at stake, a conservative view is demanded. No one in their right mind would come to the table and bet millions on confidence.
But…we are headed generally in the right direction…

Obama has to know

izoneguy (Diary) Friday, July 9th at 12:19AM EDT (link)

that business is holding back because of his policies.
The corporations have 1.8 Trillion sitting on the sidelines.
They are like Turtles right now and Obama keeps
trying to come out with false promises and campaign rheotic.
It won’t work this time…..
