BREAKING: Supreme Court Reverses Sotomayor in Firefighter Case

The Supreme Court, in a 5-4 decision authored by Justice Kennedy, has reversed Judge Sotomayor’s opinion in the Ricci case.

The Court found that there had been discrimination and there was a violation of Title VII.

Those white men and black man on the Supreme Court just didn’t have the same experiences as Judge Sotomayor and consequently saw discrimination where Sotomayor saw justice.

We can postion over it, hold people accountable for it, but the Democrats, and, yes, some Republicans will confirm her. Our objectives should be to hold the caucus as firmly as possible so as to avoid giving cover to any vulnerable Democrats and to put a large target on the backs of any Democrats from traditionally Republican states are mortally wounded by the vote.

I’m not eyore, I’m a very practical fighter and I pick my fights; there’s no reason to fight just to lose. Sometimes you do take on a losing fight, but you only do so if it contributes to some larger objective or future goal.

If this decision is bad for Sotomoyor, which I think it is, in that this nonsense has been going on for 40 years with no end in sight. This decision is the first light at the end of the tunnel, I also think this decision is a chink in the armor of Gov. Palin.
The State of Alaska along with several other states filed amicus briefs in support of the City of New Haven and against Ricci. The state of Alaska did not have to file a brief, but they chose to do so. What was Gov. Palin thinking about when the decision was made to throw in with the City of New Haven?

It is not an elective position. Mr. Svobodny was appointed acting Attorney General by Gov. Palin during the period in which Gov. Palin was attempting to have Wayne Ross appointed Attorney General. Mr. Svobodny did not actually write the brief, but the State of Alaska paid for attorneys to represent the position stated in the amicus brief.
As to his politics, I don’t know but he appears to be a career prosecutor.

I feel strongly about this case in that I took a promotional test for the Chicago Police Department in 1979, scored 4th out of over 6,000. You can guess the rest, 3 years later I got promoted after finding myself in the low 200’s in the final list as a result of a mixture of politics and affirmative action. That was the first time I voted for a republican, Pres. Regan, in the hope that affirmative action would be put to rest.

The governor appoints the AG who is part of the Executive Branch of govt..
This brief, which supported the respondents position, is the position of the State of Alaska, and specifially the Executive Branch of the State of Alaska. I don’t know Gov. Palin’s feelings about this breif, other than what her appointed Attorney General has put his signiture to. I don’t beleive the legislature can order the executive branch of govt. to file briefs in support of any position. The State of Alaska could have stayed out of this matter. It did not, their AG joined an amicus brief in support of the City of New Haven.
What I trying to say in answer to your first question, did Gov. Palin support this brief, She is the boss, and I would have to say she did. If she says she did not support the breif she is going to look silly, or asleep at the wheel.

They are saying that promotion is a mere expectation, something very consistent with Alaska law, don’t know the others, and that the petitioners had suffered no immediate harm in that there wasn’t a present case or controvesy until such time as someone was actually discriminated against in conferring a promotion. Basically, they’re saying the US should stay out of the issue at this stage of the game, a position with which I agree. Go read the brief.

if I understand you correctly the amicus was in support of the gov’t being allowed to hire/fire/promote as they see fit, like “right to work”. But the majority opinion didn’t really deal with the promotion from what I read, it dealt with the idea of the test being certified or not.

So the amicus and the majority opinion are not within conflict and further the amicus and Sotomayor’s summary order are not the same position.

Is that correct?

New Haven was stupid to say that they would not promote those who passed the test because all the blacks failed to pass the test. They could have just said that at this time the money is not there for anyone to get a promotion. This answer goes more to the concern of the amicus brief allowing a local government some flexibility on decisions concerning promotions. There are usually words to the effect that passing a test is a requirement for promotion, but I have never seen words to the effect that passing a test is a guarantee to a promotion.

By saying it was because the Blacks didn’t do well, they made it an illegal race-based reason. I think they could have even gone so far as to say that because of the result they were re-evaluating their selection criteria and testing scheme and been OK.

That said, on the question as the USSC framed it, I agree with the decision, but I’m not going to try to pretend there wasn’t a certain amount of judicial activism of the more conservative kind to get to a place where they could opine on it.

Theirs is a very narrowly tailored position in which they assert that the essence of the petioners’ theory is that since they passed, the respondent is obligated to promote them. Amici say they are under no obligation to promote anyone at any time, no matter what; a position with which I agree. I’ve been through lots of recruitments where because of a union contract, EEO, politics, whatever, we did not want to hire or promote whoever we would have been required or directed to hire or promote, so our answer was to not hire or promote anyone, just leave the job vacant or keep someone in acting.

I doubt anyone in the Governors Office knew or even cared about this case. This is the sort of thing that Administrations HR/LR people and Law’s Labor and State Affairs attornies would have known about and the acting AG would have had the discretion to do as he pleased.

This must be used as an educational tool to those that thought it was okay to vote Obama because McCain really wasn’t Conservative enough anyway (though we have to admit some other Republican picks have not been stellar). The Democrats are always going to be pushing Ultra-Leftist Judges now and WE MUST now do the same with Conservative Judges - no more “compromise picks” from our side. Won't Change Composition of Court

As noted above she is one of the 4.

But, besides the actual decision, it shows her complete lack of thought on constitutional issues. She saw white guys and dismissed them out of hand. It never entered her mind that there were important constitutional arguments — on either side — that could be made. She had no desire to craft a thoughtful decision to support her viewpoint. That is my major problem with her.

Dislike Ginsburg and Stevens, but they at least try to justify their positions. Scalia and Kennedy do it for their positions (I prefer Kennedy’s well-laid out opinions to Scalia). ANY Supreme Court justice should be able to write a decent opinion with just a little thought and effort.

The fact that Sotomayor cannot even attempt to write an opinion on such an important issue as discrimination exposes her shallow intellect. “White = bad” what more does she need to say?

The questioning must go to this point, repeatedly. Just as Thomas’ questioning all centered around an incident THAT NEVER BLOODY HAPPENED, so should her questioning center around the opinion she could have but didn’t write.

Ginsburg’s mind clearly lives in a liberal utopia. If Justice Ginsburg had been providing the Opinion of the Court instead of the dissent, any method of comparison between employees would have essentially been rendered discriminatory on the basis of the possibility that some theoretical “less adverse” process could exist. She hangs her dissent mostly on the fact that one expert, who Justice Alito reveals in his concurrence to have offered the city his own expertise and services, said that there may be other methods that wouldn’t produce the disparate racial results that the current test-based method did. Never mind the fact that the current method is the required one based upon New Haven’s current labor contract with the Firefighter’s Union. Instead, she retreat’s back to attempting to ensure equality of outcome instead of opportunity.

Well, I’m happy that the sane side won, but any decision authored by that pompous, Constitutionally-challenged gas-bag will

  • be needlessly complex
  • be unhelpful to lower courts in the future wanting to adhere to the ruling
  • leave the larger matters unsettled, meaning it’ll have to be revisited some time in the future

I so don’t look forward to hearing the particulars of this one unwrapped in the near future.

really… I’ve always known there were a good degree of folks asleep and the switch and looking to pull the JackAss lever so they could claim to “Care” and then go back to coasting by…. But I’ve gotta tell ya with the last Election I practically wept because of the realization that these folks are beyond lazy and asleep and just plain DUMB! Time goes by post election and we get more and more insult upon insult coming out of DC and so many Americans just prove they are just beyond STUPID! That Baracklash may not be coming, I fear for my Country really for the First Time! The SoSo purely Racist/Classism/Sexism appointment, and that many will still fall for it and say “sure, let’s let someone who just had their hand slapped for stupidity in a ruling” by the existing SCOTUS be seated upon it. There are a whole lotta folks that deserve the pain the have coming to them, but the trouble (of course) is that the rest of us have to suffer too for their stupidity (it is no longer a question of Ignorance, but wanton desire to remain Deaf, Dumb, and Blind).
