I need you on the phone right now. Tomorrow, July 22nd, the Senate will vote on John Thune’s Concealed Carry Reciprocity Amendment.
The amendment will be filed as part of the hate crimes legislation. The amendment will be fined as part of the Defense Authorization Bill, but will impact the hate crimes legislation.
The amendment, should it pass, would allow citizens with concealed carry permits in one state to continue carrying their guns into other states that also have concealed carry gun permit laws.
It looks like the hate crimes legislation is going to pass. We should be working to make it better.

Being licensed to use a gun isn’t like a law license, or a medical license, so this bill makes perfect sense. I’m surprised this hasn’t been proposed sooner.
But if you want to talk about election years… its Thune to look at. He could have proposed this much sooner.

The U.S. government is already too far down that road for my taste, so asking them to take one more step, even one that benefits me, is uncomfortable. I’m still deliberating.

Full Faith and Crdit

It also has the power under the current expansive Commerce Clause interpretation that allows them to regulate anything, even activities that take place entirely within a single state. In this particular case, there is actual movement (of people) between different states, so the Commerce Clause power is at least arguable.
Respectfully, whatever happen defending the original meaning of the Constitution?

Did the several States truly believe they were forfeiting this bit of sovereignty: the right to regulate whether people can conceal arms? I just can’t see it.
Maybe I’m the blind one, but the original meaning of the Constitution always seems to get (conveniently less certain) thrown under the bus by those factions who become blind to it when their pet issue can be championed at its expense. This why respect for the Constitution and the rule of law has deteriorated over the years. Sometimes respecting the law means telling yourself no, or is that only true for the other guy?
I’m sorry Erick, but as much as I believe in the right to keep and bear arms, I on principle, cannot support or ask others to support this provision.

But I can assure you I do not make it a habit make such accusations, whenever there’s a disagreement over policy.
However Neil, you are guessed correctly that my arguments are elementary, and that I care about the Constitution, and especially how it is interpreted to justify policy.
BTW, I never accused Erick of not caring about the Constitution necessarily, rather I implied proponents (including Erick) of the amendment he encouraged us to support seemed to not care about the original meaning of the Constitution as I interpret it to be; true only a subtle difference.
Erick wouldn’t be the first or the last to disagree with me over the interpretation of the Constitution, and I’m okay with it, but to be honest, I was hoping to discuss our possible differences. You see part of the reason I read and post at Redstate is because I respect and value the opinions of so many of the contributors, especially Erick, and have learned much in the process. It would have been nice to discuss and learn why my interpretation of the original meaning is wrong, if in fact it is wrong. What you took as an attack was my way of provoking just such a discussion. It is a common educational technique, as I’m sure you know.

Again, I am flattered and honored, political allies with Erick (and you too?), cool! But as I said in my post, I can’t be his political ally on Thune Conceal Carry Reciprocity Amendment, and as the discussion about its constitutionality of is apparently off limits, the chance of being won over to the cause is now unlikely. I hope this doesn’t jeopardize the greater alliance.
Also Neil, I certainly hope growing up doesn’t require me to avoid all discussions over the original meaning of the Constitution, especially when so many folks pursue policies based on what they conclude that meaning to be. Such a prerequisite to growth would be a shame, even in cases when the discussion is between political allies, but I’ll respect your wishes if necessary.
Finally, you did figure right, I tend to be silly, and I’m probably a crackpot too; probably much worse, but up until now I assumed I was already being ignored. Thanks for the attention even if it was a scolding; I need the accountability. Take care and God bless.

The actual language in any final bill must be examined closely. For instance, the bill does not prohibit agencies from placing their own restrictions on active police officers.
Additionally, while HR218 includes provisions for allowing retired police in good standing to carry nationwide, there are significant requirements that render the law meaningless for most affected individuals. For instance a retired officer is required to firearms qualify annually and possess a photographic ID from the specific agency he or she retired from, that indicates firearms re-qualification within the prior 12 months. The reality is that many or most police agencies refuse to issue such certifications for a variety of reasons, such as liability issues. Qualifying at another agency is allowed under the law, but the ID must still be issued by the agency the officer retired from. Due to the narrow language of this clause, HR218 cannot apply to many people, despite the original legislative intent.

As mentioned by several, the amendment would be another step from which to further inroad state sovereignty. Already we are far down that road. There is no reason to give the national government any more power.

While I am fairly knowledgeable on the 2nd Amendment, I am very ignorant on intersate commerce, etc. How do states agree to reciprocity with driver’s licenses? Is it purely a state to state thing?
