I sometimes see people here throw out Terri Schiavo as a religious right over reaction and not being religious myself I have questioned why? is it not just a human over reaction?

I know that a lot of conservative's went out on a limb (or so the MSM said) for this case....it was definitely a right to life issue....but it was with out a doubt a what if she was or could become "alive" case. The young lady Haleigh (in my link below) who was one signature away from being put to death for no crime is alive and well and we as a human race will never know if Terri Schiavo would have "come alive"....because of our rush to literally "starve" her to death.

I have not thought about that case in some time and when I do I always think of the parents and their love for their child....I know I would do whatever it took to fight for my child to live in the same circumstance...it would have hurt no one for that husband to allow those parents to have custody of Terri and in such care for her until either she died or they died....that was the true sadness of that case....I would expect the exact same reaction from the conservative members of congress today that spoke up in support of Terri and her family then.

I would hope that my parents would fight to have me taken OFF life support if a reasonable amount of time had past, and if the likely hood of my recovering was slim to none.

I don't want to live in a hospital bed for years with no conciousness or quality of life. I'm not that scared of death, having a firm belief in the afterlife. I might as well get on with my next life.

I have no idea what I would do as a parent, but I would at least have to take into consideration what I would what my own parents to do for me.

When your child is a married adult, by law (unless a living will or a court order states otherwise) the decision rests with the spouse. So are you arguing for parental rights to supersede spousal rights, or for life support removal to made illegal?

I am arguing that spouse in this case had "perhaps" a unnatural desire to see his wife pulled off of life support and in that type of case the law should be with the innocent....who of course was Terri....if little Haleigh's killer (her dad) had his way she would be dead now....the courts should always err on the side of caution....

The court used husband to make a dispositive ruling on what her intent was.

He was the only witness, and he was an interested witness.

For many different types of contracts, a certain level of formality is required. Land contracts need to be in writing. Many states require two witnesses for the execution of a will.

In the Schiavo case, the only evidence of the persons intent was a casual conversation Schiavo and her husband. Her husband was an "interested party" in that he had moved on with his life and re-married.

How could terminating her life require less evidence than the purchase of a house?

The person should be kept alive unless there is some substantial evidence that the person didn't want to be kept alive.

You can't enforce a contract to a buy a house without a duly executed written document, so why should someone's life be ended in the absence of a written document?

The 14th amendment applies to state's carrying out the death penalty of a convicted crininal. Congress required that when a state was carrying out the same against a disabled person, that a de novo hearing be held as a requirement of due process. The lower courts and the suo ct DEFIED congress despite the fact that congress, under the constitution, DEFINES the jurusdiction of the federal courts.

Maybe he did, but there was a hearing on the matter and the husband won. That's the most you can do without changing the law.

Jaded's post was a statement regarding right-to-life. At no point has she asserted that the case was judeged wrongly in the courts, she is decrying the current state. So how about you direct your snappy comments in that direction, please?

Because the truth is "you never know". My one son says "fight to the bitter end" for him on life support until they come along with a means to put his brain in another body ala Futurama...and myself I have in writing not to keep me alive as a vegetable...so it is indeed a moral and personal issue and Terri Schiavo never said.

Well if the goal is to prevent a person like Terri's husband from pulling her off life support, then I don't believe your moral argument would persuade someone who truly believed their spouse did not want to be kept in that condition -- and I can relate.

My mother, who died in 1994 from secondary conditions resulting from an insulin-shock induced diabetic coma. Although I never she never created a living will, she had told me many times over the years she did not want to be a "vegetable," and literally begged me to promise that I would not let her linger like that. To her, that kind of existence was not only taxing on the ones she loved, but deeply insulting to her sense dignity and self-worth.

Now I don't know if she ever told her mother what she wanted (my grandmother passed the day before my mother went into a coma) and my mother was never on life support equipment, but even so I felt very, very conflicted just letting her be.

So I think what you really want is for Florida to change the law to prevent the removal of life support equipment by the authority of a spouse, parent or legal guardian, unless there is a living will to the contrary.

is so very freaking important. From a moral standpoint, I think we need to err on the side of life, if we must err. That's honestly the only reason I'm against assisted suicide. There's too much room for abuse, and in the case of euthenasia, abuse has a rather permanent conclusion.

"More than a decade ago, a Supreme Court decision literally wiped off the books of 50 States statutes protecting the rights of unborn children. Abortion on demand now takes the lives of up to 1 1/2 million unborn children a year. Human life legislation ending this tragedy will some day pass the Congress, and you and I must never rest until it does. Unless and until it can be proven that the unborn child is not a living entity, then its right to life, liberty, and the pursuit of happiness must be protected.

You may remember that when abortion on demand began, many, and, indeed, I'm sure many of you, warned that the practice would lead to a decline in respect for human life, that the philosophical premises used to justify abortion on demand would ultimately be used to justify other attacks on the sacredness of human life—infanticide or mercy killing. Now, I'm sure that you must get discouraged at times, but you've done better than you know, perhaps. There's a great spiritual awakening in America, a renewal of the traditional values that have been the bedrock of America's goodness and greatness.

One recent survey by a Washington-based research council concluded that Americans were far more religious than the people of other nations; 95 percent of those surveyed expressed a belief in God and a huge majority believed the Ten Commandments had real meaning in their lives. And another study has found that an overwhelming majority of Americans disapprove of adultery, teenage sex, pornography, abortion, and hard drugs. And this same study showed a deep reverence for the importance of family ties and religious belief.

I think the items that we've discussed here today must be a key part of the Nation's political agenda. For the first time the Congress is openly and seriously debating and dealing with the prayer and abortion issues—and that's enormous progress right there. I repeat: America is in the midst of a spiritual awakening and a moral renewal. And with your Biblical keynote, I say today, "Yes, let justice roll on like a river, righteousness like a never-failing stream."

Now, obviously, much of this new political and social consensus I've talked about is based on a positive view of American history, one that takes pride in our country's accomplishments and record. But we must never forget that no government schemes are going to perfect man. We know that living in this world means dealing with what philosophers would call the phenomenology of evil or, as theologians would put it, the doctrine of sin.

There is sin and evil in the world, and we're enjoined by Scripture and the Lord Jesus to oppose it with all our might."
