Opposition to Gay Marriage Wins NY GOP Senate Control [UPDATED]

[UPDATE] As I’ve already noted in comments, Hiram Monserrate is in point of fact no prize: he’s currently under indictment for going after his girlfriend with a broken beer bottle.  Can’t say that he looks any better with an R after his name than he did with a D, although I’m perfectly willing to bet that his former compatriots will immediately proclaim that he magically now looks worse.  – Moe Lane

At least, those are the early indications.

I haven’t had occasion to write about the New York Democrat civil war over gay marriage in several months. The last occasion was here. Basically, New York Democrats finally won a majority in the State Senate in 2008 – the first majority they had in the Senate in 40 years. It seemingly gave them unified control of the state government – as long as they could reach some compromise between Democrat Senators who favored gay marriage, and those who opposed. That agreement eluded them for months. Senator Espada and several others sought assurances that the Senate would not vote on gay marriage legislation in this session. Eventually the two made a deal with Democrat leader Malcolm Smith, but they would not discuss the terms of that deal.

Now, as gay marriage legislation was gaining steam in New York, Espada and Hiram Montserrate have made good on their threat to quit the party. While I don’t see any confirmation yet that their switch is directly linked to same-sex marriage, that’s where the early betting is:

Chaos reigned in the State Capitol Monday as Senate Republicans pulled off an unprecedented mid-session coup to gain control of the chamber.

The GOP managed to flip two Democrats to their side, making one of them, Pedro Espada Jr. (D-Bronx), the temporary president of the chamber.

Sen. Pedro Espada Jr. (D-Bronx) and Sen. Hiram Monserrate (D-Queens) agreed to side with Republicans in what they are calling a new bipartisan coalition to run the Senate.

Espada, who said he will remain a Democrat, was voted as temporary president of the Senate. Republican Dean Skelos was installed as majority leader.

The man ousted as temporary president and majority leader, Malcolm Smith, and his colleagues are expected to sue to stop the coup.

“Life is circular, my friend,” Sen. Diane Savino (D-Staten Island) snarled to Espada and Monserrate as she and her fellow Dems stormed out of the chamber.

It’s interesting to see how differently Democrats are reacting to this party switch than they did to those of Jim Jeffords, Arlen Specter, and others. Those Senators were hailed as brave souls willing to stand up to an extremist party and agenda, and to stick to their principles. In New York, Democrats are threatening to go to court:

Smith spokesman Austin Shafran said as far as Democrats are concerned, Smith is still the legal head of the Senate.

“This was an illegal and unlawful attempt to gain control of the Senate and reverse the will of the people who voted for a Democratic majority,” Shafran said. “Nothing has changed…The real Senate majority is anxious to get back to governing, and will take immediate steps to get us back to work.”

‘Reverse the will of the people who voted for a Democratic majority?’ How quickly Democrats change their tune when a party switch costs them the perks of control.

    As a New Yorker and a Bronxite, I find this “coup” really interesting.

    Seems the details are still being sorted out, but i wouldn’t be suprised if this were about the gay marriage issue.

    As we saw in California, many Hispanics as well as other Democrats are socially conservative on some issues. Another Bronx State Senator, Reuben Diaz Sr. is a pro life minister!

    NY is a low down play it dirty kinda place-I look forward to see how this plays out..

      We had a republican state senator up until very recently (4/5 years).

      Google Guy Valella-he unfortunatley had to step down because of some funny money.

      He was the last republican elected official in the bronx…

    Will we hear you denouncing the NY Democrats for moving too far to the Left? Will you be touting the defection of Espada and Monseratte (who is really much more suited to the other side) as a sign that NY Democrats are not inclusive or “tolerant” of dissenting views?

Smith remains the duly elected Temporary President and Majority Leader. The real Senate Majority is anxious to get back to governing, and will take immediate steps to get us back to work.

    Just so we’re clear: RINOs can jump ship anytime they want, and that’s all fine, but let a Democrat switch parties and it becomes an “illegal and unlawful” act? When are Democrats going to bleat for the Pennsylvanians who voted a “Republican” into office?

    I’m pretty surprised that Ruben Diaz wasn’t one of the defectors. He’s well-known for his opposition to gay marriage.

    Where I work in Albany, there’s a restaurant not 100 yards from me that is frequented by a very well-connected Dem lobbyist. I’m on good terms with him, even though he knows I’m a conservative Republican. I saw him at lunch today, and if he had [i]any[/i] inkling that this was going to happen, I would have heard him say something about it. What’s that mean? The Dems had NO IDEA that this was coming.

    First let me make something clear. I don’t like these guys that jumped ship from the Dems to give the GOP control of the NY Senate. One of them is charged with brutally assaulting his girl friend, for goodness sake! Not really the kind of guy I want in the GOP at any level (local, state, or Fed).

    That being said, this IS a major coup

    Understand that the Dem controlled branches of the NY state government were trying to ram all kinds of things through the Senate. Major gun control legislation (part of which would have forced New Yorkers to either turn in some of their guns or face criminal charges and confiscation of their weapons), all sorts of tax increases, tons of new fees and fee increases on all sorts of state licenses, legalization of gay marriage, and so on. The list goes on and on, but I don’t have time right now to link to any of it.

    This doesn’t mean that NY is suddenly a red state, but I think some of this crap is going to be taken off the legislative plate for the foreseeable future,

    Let me put it this way. Some of this stuff the NY Dems have been talking about passing in Albany have been making my wife and I to seriously consider pulling up stakes and leaving NY for somewhere in the south (Texas maybe). We’ll probably still leave NY, but this will probably give us some more time to settle our affairs and make the move without having to take my guns to relatives out-of-state.

      That New York Republicans are under the gun. They will be expected to pass a budget. And since these are NY Republicans, most of them are probably more or less OK with tax increases.

      That’s one reason I was not really all that saddened when they lost control of the Senate in the first place. I rather liked the chance to run as the outsider in 2010 – with all the trouble the state is dealing with this cycle. Now it seems they’ll ‘own’ some share of the credit/blame. I hope they take this opportunity to stand for smaller, more effective government. I fear they’ll sign on to a bad deal.

        NY Republicans aren’t all that conservative, and so tax increases might still happen. I don’t want it to, and the state would obviously be better off with large tax and spending cuts. Economically, NY is essentially in the same boat as California; massive deficits and no will to cut spending (which is killing the budgets) or taxes (which is killing business and jobs, as well as tax revenue due to a smaller tax base).

        That being said, if this means that even some of the bad agenda that was being pushed by the NY Dems fails, well half a cake is better than no cake.

        When there are folks in Albany talking about forcing gun owners to “voluntarilty” turn their firearms in to the state troopers or face criminal charges and gun confiscation, things start getting really scary.

        As much as I hate the tax and spend mentality in NY, its my view that economic stuff can eventually get worked out to bring about a resurgence of prosperity for a state.

        Outlawing certain types of guns, forcing gun owners to turn in their weapons backed up by police powers to confiscate firearms and arrest gun owners… man that could get REALLY ugly.

    Mr. Espada has been fined tens of thousands of dollars over the years for flouting state law requiring disclosure of his campaign contributions.

    Mr. Monserrate was indicted in March on charges that he stabbed his companion late last year with a drinking glass, leaving a gash that required 20 stitches to close.

    … the Dems are saying they are still in power, and that they are going to refuse to reconvene the session until this “[Republican] coalition drops its challenge to the [Dem] leadership.” Paterson is saying that he’ll only recognize the former Dem leader as well.

    I’d really like to know how the Dems think they are going to stop this. They tried to adjourn the senate without a majority vote, failed to follow through with a roll call, and stormed out like children. Now they are threatening not to reconvene until the Repubs give up their newly consolidated leadership, and they’re going to take this to court?

    What are they going to do next, start arresting NY Republican senators?

    There is no way that the Dems can stop the Rs from forming a new majority if they have the votes to do so. Even if the vote today was out of order or whatever, at some point the Rs will just bring it to the floor again, and a 32 to 30 majority is going to mean the Ds are out of power in the NY senate any way you slice it.

    Who knows, maybe if the Dems get really crazy on this, a couple of the other Dem senators will flip to R as well. Given the fact that the Dem leadership broke their agreement not to bring gay marriage up for a vote this session, anything is possible I guess.

    I would really, REALLY like to see the Dems try to keep this R take over from happening. The Rs have a clear 2 vote majority on this, and I don’t see how this isn’t going to go badly for the Ds if they try and usurp the chamber without a clear majority in their favor.

    I read that Republicans are either “purists” or “moderates” with a big tent–but not both.The people that are maddest about this coup probably haven’t been preoccupied with such labels all day.

    He’s my boss’s boss’s boss. Very conservative Republican. He told me that he saw a story in the New York Post where five more Democratic senators were considering following the first two defectors and caucusing with the Republicans.

    Getting back to the very well-connected Dem lobbyist I referenced above, je comes into said restaurant today, and another big Dem I know and am friends with yells out to him, “Hey, Steve–have you changed to the Republicans yet?” Ten to twelve of us at the bar laughed our heads off. Said Dem lobbyist had to fight off the urge to flip us all the bird at that point.
