Democrats release 2300-page reconciliation bill *Updated*

UPDATE:  Some Twitterers are stating that this is a “shell bill” that will provide a base for actual language later.  Rep. Paul Ryan alluded to this move last week.

And Michelle Malkin weighs in, as does Philip Klein.

The Hill is reporting tonight that the Democrats have published a copy of the bill that they plan to use to update the original Senate healthcare socialization bill that Pelosi plans to bring to the floor this week.

And it appears they’ve decided to go all-in on this one.  Included in the bill appears to be the “public option” that was removed from the Senate bill.  From page 1167 of the bill:

Subtitle B—Public Health Insurance Option

SEC. 221. ESTABLISHMENT AND ADMINISTRATION OF A PUBLIC HEALTH INSURANCE OPTION AS AN EXCHANGE-QUALIFIED HEALTH BENEFITS PLAN.

(a) ESTABLISHMENT.—For years beginning with Y1,  the Secretary of Health and Human Services (in this subtitle referred to as the ‘‘Secretary’’) shall provide for the offering of an Exchange-participating health benefits plan (in this subdivision referred to as the ‘‘public health insurance option’’) that ensures choice, competition, and stability of affordable, high quality coverage throughout the United States in accordance with this subtitle. In designing the option, the Secretary’s primary responsibility is to create a low-cost plan without compromising quality or access to care.

I’m no legislator, but this sure sounds like a public option to me.

The logic escapes me.  If the Democrats didn’t write their own death warrant with the 12/24/09 Senate bill, this should pretty much seal it.

Let me add one other comment, based on a twitter msg from one of our colleagues:  when the Dems try to ram through legislation using an unconstitutional process like the “Slaughter Solution”, we should not trust them on anything.

    and perhaps ramp up poll numbers for this mess so that House members might feel more inclined to vote for the Senate bill? Why else would they do this? Now the House has to vote for a Senate bill that they don’t like so the Senate can then pass a reconciliation package containing goodies that they voted out of the bill in December. Great. Just add another trillion dollars in ‘stimulus’ spending to this, and perhaps they can reconcile Porkulus II while they’re at it.

    that under Reconcilliation Rules they have to use a bill that was sent to the budget committee by October 15, 2009 and that they are going to make all the changes in the Rules Committee to this bill; however, this can’t help with public perception if it *looks* like they’re trying to resurrect the Public Option. They’re trying to be too cute by half with this reconcilliation bill and it will hopefully cause them a PR nightmare over the next few days when Fox and the new media shout from the rooftops that they’re trying to resurrect the public option.

    I wrote this before the update. Now we get to lose sleep over a shell bill for the next week. Would I be completely insane if I asked if the CBO has to score a shell bill, or does the CBO even matter in this process anymore?

    You get my logic. We need to be diligent here. While this may be a “shell,” I don’t trust these bums as far as I can throw ‘em. It is not at all out of the realm of possibility for them to use reconciliation to resurrect the public option. Of all the items they could add in, this is probably one of the few where they could use “deficit reduction” as an excuse, based on totally fantasy numbers.

    The worse the perception, the better.

    With 4-5 days of markup there is no telling how much worse this thing can get. It could be 4,000 pages of tyranny before it’s over now that it appears the Democrats’ contempt for the public knows no end.

    THEY DID WHAT??!?!?! We’ll see what comes out of markup Monday. No pro-life amendments, basically a takeover of the student loan industry as well Wait, isn’t this supposed to be a health care bill? To put this bill toward mark-up in committee is just flat out stupid. It gives the GOP even more ammo that the stockpile they already had. This fight from now on is going to have plenty of fireworks.

    Who the heck can understand any of this legalese? I just tried to skim through it and unless you’re an attorney it’s nearly impossible to decipher. There really oughta be a law that these bills must be written in plain language so that every citizen can understand them. Ya know… kinda like the Constitution was. Duh!

    The one that REALLY counts is the 12/24 Senate bill that will be before the House this week. Per the Senate Parlimentarian, this one must proceed the other one.

    Keep calling those Congresspeople. Tell them how pissed you are that they’d even consider passing the healthcare rationing abomination.

    1. They must pass the Senate bill without changes before they can fix anything.

    2. They don’t have the votes to pass the Senate bill.

    3. They do not trust the Senate to fix things after the Senate bill goes to the President’s desk.

    Isn’t all this now just a bunch of noise to obfuscate the above?

    How does this mess make their job of kneecapping easier?

    Is it me or have they been setting this up all along and just might get a public option out of this. I wondered why the senate was talking about the public option. This is why: the shell presents the House healthcare language that the House wants, they insert parts of Senate bill they like, then Senate votes with reconciliation. Done deal. OMG!

    They’ll be spending this next week letting the media and right wing blogs stew about this newest abomination while they are busy trying to get enough votes for the Senate bill.

    If they don’t realize that they are ultimately the ones who are being played for fools, well, they’re more stupid than even I thought they were.

    It’s like someone said on another posting a few days back – they’re like that blond girl in the Indiana Jones movie (with Sean Connery) who wanted more and more. Things didn’t end up so well for her, either….

    Remember when Reid did the bait and switch in the Senate and placed the House bill number in the senate bill? I seem to remember this, and one has to wonder if really all that has to be done now is House to sign Slaughter amendment. Then, as the Senate bill is really House Language, they take out Cornhusker, et al and done. We then have now got the public option. I am so worried that Nancy has really got us on this one.

    Has anyone see this? I wonder if Pelosi is trying to push this now as the Senate just needs 50. See below:

    Captains and Majors at Quantico must be looking in the mirror and asking, “Dear Lord why in my life?”

    None of this has anything to do with “Budget Reconciliation.”

    The Republicans need to get the Stupak-Lieberman Democrats to physically sign on to a statement that this will not stand and there will be consequences. Specify that any Judge who supports this will be impeached and any Member of Congress who supports it in the Well will be expelled and any Member or Executive branch officer who attempts to enforce anything as unconstitutional as a Slaughter maneuver will be charged with Sedition. Issue it like Lenin issued his “Order No. 1″ from the Winter Palace and dare the Democrats to move against the Constitution.
