Where’s Obama’s proof of citizenship?

If he can post his birth certificate on the web, why can't he give it to the court?

Both presidential candidates have been accused of not meeting the Constitutional requirement that only “natural-born” citizens hold the presidency.

Last month a federal judge threw out a lawsuit seeking to remove John McCain from the California ballot because he was born in the Panama Canal Zone:

Judge William Alsup of Federal District Court ruled late Tuesday that the law at the time of Mr. McCain’s birth automatically granted citizenship to offspring of American citizens.

Mr. McCain’s parents were both citizens when he was born on Aug. 29, 1936, in the Panama Canal Zone, an American territory where his father was stationed with the Navy.

Obama still faces a legal challenge to his constitutional eligibility to be president. A lawsuit, Berg v. Obama, brought by Philip J. Berg, a Philadelphia attorney, alleges Obama is not eligible to be president.

Instead of producing records proving Obama is a natural born citizen, Obama and the Democratic National Committee have filed a motion seeking a protective order to block production of documents until a motion to dismiss is the law suit is ruled on by the court. Obama and the Democratic National Committee also claim attorney Berg has no standing – has no right – to bring the lawsuit.

What is it that Obama and the Democratic National Committee are trying to hide? Why not just produce documents that prove Obama’s citizenship and make the lawsuit go away?

I repeat, what is it that Obama and the Democratic National Committee are trying to hide? If Obama can post his birth certificate on his website why can’t he provide it to the court?

    We have our answer, and should Obama ACORN his way to an electoral victory, the nastiness that will be seen from challenges to his legitimacy after he takes the Oath will be dangerous.

    And after Gore set the precedent by taking back his concession to Bush in the 2000 campaign due to Florida, and the selected not elected/bush lied era we are in, the Dems will have to ground to stand on.

    it’s a certificate of naturalization, which unfortunately for me means I’m constitutionally ineligible for the presidency. That ineligibility does burn me up a bit. I’ve lived in these United States since I was a child, and have been a citizen since I was a teenager. I’ve served honorably as an infantryman in the Army, paid my taxes, served on a federal jury, I adhere to laws in much the same way as others, but since my birthplace is Prague Czech Republic rather than Prague Oklahoma I can’t even throw my hat in the ring. Well enough of that rant.

Tokaji, an election law expert at Ohio State University, agreed. ?It is awfully unlikely that a federal court would say that an individual voter has standing,? he said. ?It is questionable whether anyone would have standing to raise that claim. You?d have to think a federal court would look for every possible way to avoid deciding the issue.?

    I think this inquiry serves the purpose of reinforcing the notion that Obama is a shady shadowy figure that has lied his way to the top.

    But I think trying to derail his candidacy on a technicality is dangerous. the public will revolt against the Republicans if they are too hevay handed here.

    Why this is such an important issue that Senator McCain should not campaign on the real differences between conservatism and liberalism and just focus on these sorts of important issues….Ya that’s the ticket to the winning the White house.

      Why Obama Doesn’t Salute the National Anthem

      This is rather an old news but I think it’s relevant here. We have to link Obama’s citizenship issue with Ayers and Obama’s resistance to salute American Flag and the National Anthem.

      To quote Obama’s response to an inquiring General:

      Senator Obama Live on Sunday states, “As I’ve said about the flag pin, I don’t want to be perceived as taking sides,” Obama said. “There are a lot of people in the world to whom the American flag is a symbol of oppression. And the anthem itself conveys a war-like message. You know, the bombs bursting in air and all. It should be swapped for something less parochial and less bellicose.             It is a certificate of Live Birth (which merely registers the birth), and it has no official county seal… he has on his website a side by side with this document and someone from Hawaii’s birth certificate and there is a difference.

            I’m not saying I buy into it, or that I think that Berg is a credible source but he is making a compelling argument for which I would be interested in seeing an answer to. It is further interesting that the case has not been dismissed, and if it had no credibility at all, it would have been.

            It is not an argument I would use as a Republican, I think it might be legitimate for the Clinton’s to use with their own party, but if it is out there, and getting some traction how can you not watch the train-wreck?

    If that is is true legal and certified birth certificate, why not be done with all this and give it to the court, as Dan suggested?

    What about his passport? Did he even have one before entering the Senate? The State department (should) will not issue a passport w/o a certified birth certificate… I could get one… millions of people getting passports for the first time do… why not Obama?

    It’s too late in the election cycle for something like this. People are already early-voting and a blanket disqualification like a lack of citizenship should have come out very early in the campaign. I am afraid that people will instead see this is a smear and associate it with the McCain camp.

    This is a poor issue to bring up. It is only going to make Republicans look stupid and petty.

    McCain’s case was less certain. He was not born inside the US. But the opinion of lawyers on both sides was that the constitution means a citizen from birth and does not mean you have to be born inside the US.

    To win this argument it is not simply a matter of proving that Obama was born outside the US. That would also disqualify McCain and put us in quite a pickle. You would also have to prove that his mother was not a US citizen.

    Just drop it.

      things didn’t look so desperate. Events have transpired in an almost perfect storm against John McCain. He cannot be blamed for not having a quick and easy answer to the economic issues that have arisen-NOBODY does. As standard bearer for the party in presidential power, he is going to be the most visible target to blame. This means that his poll numbers are sliding and (some) republicans in desperation start to throw everything at Obama in an attempt to salvage the election. I have read Redstate for a long time, and this kind of nonsense is beneath it.

    I say this not because the underlying issue may be completely devoid of merit, but, tactically, it’s a non-starter.

    Let us imagine a theoretical voter out there. A voter who is somewhat inclined to vote for Obama who hears this message and says “whoa there, waitaminit!” and decides to vote McCain instead based on THIS piece of information.

    Can you do that? Because I cannot.

    I can imagine voters on the fence who could be swayed due to 2nd Amendment issues.

            They ordered Obama to provide the “long form” certificate which is much more difficult to forge because it is not “issued” by the state. It is kept in state records.

            Obama could easily get access to the document and provide it to the court. That would end this whole issue.

            Why doesn’t he do that? Hmmmmm?

            The birth certificate on Factcheck.org and on Obama’s website don’t match. The watermark from Hawaii is in the wrong spot and doesn’t match on both of them.

            I’d also like to point out that Factcheck.org is part of Annenburg Challenge, the organization that Barack Obama worked on with Bill Ayers.

            The truth is the DNC and Obama are hiding A LOT. Release his college transcripts, full birth records, and medical records and let us know who this Barry Dunham, er, Barack Obama is.

    There has to be a reason Obama does not want to produce his birth certificate to the court. Berg, the attorney who is suing Obama feels it is a forgerry and that Obama is using the birth certificate of his sister. Many people believe the BC Obaama has on his website is authentic because it was validated by factcheck.org, however the blogger TexasDarlin has written an excellent expose about factcheck.org. In her research, Texas Darlin has uncovered that FactCheck.org is owned by The Annenberg Foundation. Obama was the first Chairman of the Board of the Chicago Annenberg Challenge, a Division of the Annenberg Foundation that Bill Ayers was instrumental in founding.         Obama produced a second certificate upon his return from his vacation in Hawaii. (How convenient!) That document is a Certificate of Live Birth [COLB]as opposed to a “birth certificate” issued at birth.

          Unless there is a specific need to know such as committee assignment, etc., it isn’t necessary for any Senator to have a clearance. It isn’t automatically applied for or granted when you become a Senator.

          The requirements for POTUS vary greatly from that of a Senator.

          Senator:

          • At least 30 years old.

          • A U.S. citizen for at least nine years at the time of election to the Senate.

          • A resident of the state one is elected to represent in the Senate.

          President:

          *Must be 35 or older.
          *Must be a natural born citizen which means that you cannot be a naturalized citizen.
          *Must have been a resident of the US for at least 14 years.

          If Obama doesn’t produce a birth certificate, has anyone gone back and looked to see if there was one in his filing when he ran for Senator?

            this close at Obama, they are also going to look this close at McCain and Palin (because Palin is more in the news than Biden) and if you look at both of them…there are a lot of stories out there. I really don’t know if undecideds will look at these stories for either candidate.

            1. Hawaii became a state in 1959. A child born on American soil automatically gets U.S. citizenship, UNLESS the child is born to a foreign government official who is in the United States as a recognized diplomat.

            2. Persons born between 12/24/52 and 11/13/86 – If one parent was a US citizen and resided in the US for at least ten years, at least five of which were after age 16, you are a citizen.

            On the first point, Obama’s father was a Kenyan government official. If he was in the US on a diplomat visa then OBAMA is NOT American.

            Obama’s mother was very young, it is not clear she meets the five year requirement.

            If he is a citizen, then why on earth would the DNC try to stop a legal challenge by a prominent democrat? Because they know he isn’t.

            The only stands Obama has ever taken on anything in his life are those that involve hiding his past–his birth, College, Law school, sponsors for college, Illinois senate activities, Ayers, ACORN, everything. Only a fool would continue to turn a blind eye to this fake. I, for one, am not fooled. The fact that the Democrats and media will is a measure of their deceit.

    As a matter of national integrity, it’s imperative that this be sorted out before inauguration.

    An unconstitutionally elected President serving in the office would be disastrous on every level. It would destroy confidence in the American system of government that it could be allowed to happen. It would destroy his standing among the leaders of the world if he was an “illegal” ruler.

    Not to mention the question of what would happen? Would he be immediately impeached and forced to resign? With the economy in turmoil now, something like this has the potential to be crippling. And that’s not doom-and-gloom.

    Some 527 needs to join this to see that it’s verified before the election. Not to try to ban him from office, but to head off catastrophe if he gets into office illegally.

            1. Obama dissed the flagpin because it reminded of Iraq War.
            2. Obama pre not put his heart the National Anthem and the Flag based on the video/picture of him with Gov. Richardson and Sen. Clinton.
            3. Obama was one of the 30+ senators who voted NO against the Flag Desecration Bill in 2006 that would overturn SC ruling that says “political flag burning is an expression of freedom of speech”.

            But the E-MAIL itself is really a bogus.

    I think the guy bringing the lawsuit is a wacko, but Obama could have nipped this in the bud by showing the court his birth certificate. I mean all he had to do was spend $15 to overnight it to the judge and get this thrown out. Instead he spends a few K in legal fees drafting up legal motions. I mean the HRC went back and found essays he wrote in Kindergarten, I think if he was born in Kenya they would know it. Its odd for Obama to let this fester.

      And that’s what is so weird about this. All he has to do is fax the paperwork if he’s legal. It’s a slam dunk it’s legitimate. So why is it that everything about him has to be this big mystery?

      I mean, if I was running, and someone did this, it would be simple for me to get the paperwork from Carlton Cty. Courthouse and send it.

      So why can’t Obama? And as far as “perception” goes, the whole problem with the McCain campaign is it’s been awash in ‘perception’ issues all along. It has no course of it’s own. It hasn’t since the day the convention ended.

      But I’m not suggesting the campaign should do this. I’m suggesting that some entity with real standing needs to support this to force the paperwork out. And not to make Obama look bad…but to put an end to the issue for everyone’s good.

      From the DNC’s brief:

      … plaintiff Berg served on Senator Obama?s office a request for production of seventeen different categories of documents, including copies of all of the Senator?s college and law school applications, requests for financial aid, college and law school papers, and ?a copy of your entire presidential file pertaining to being vetted.? Plaintiff also served 56 requests for admission on Senator Obama. On that same date, plaintiff served on the DNC 27 requests for admission and requests for production of five categories of documents, including all documents in the possession of the DNC relating to Senator Obama.

      We can probably agree that delivering all these documents is a burden.

      Obviously, there are good (and not necessarily dishonest) reasons for trying to keep this guy from getting his crazy mitts every piece of paper with Obama’s name on it, ever.

    If you look at either Obama’s birth certificate or certificate of live birth, they put down father’s race as African. African is not a race it’s a nationality! Back in the early 60.s Obama’s race would have been put down as negro or negroid, not African. There are so many things wrong with his BC and COLB that it is ridiculous. If it was legitimate, Obama would have no reason NOT TO PRESENT IT TO THE COURT!

    According to the constitution, just being born on American soil does not make you an American citizen unless other criteria is met. Obama’s mother was under 19 when he was born (she was 18 and unmarried at the time)and his father was not a US citizen. That means that even if he was born in Hawaii, he would not be a US citizen.

      Any US citizen is harmed by a total disregard of the Constitution. Are we to rely only on a gentleman’s word in this matter? Is there no point that such a basic and well defined qualification is not subjected to authoritative scrutiny?

        The idea that a voting citizen wouldn’t have standing in this case is ludicrous.

        That legal experts would even make such a claim shows how much judicialism, and the entire concept of legal “scholarship”, has degenerated to the point where it’s actually injurious to the entire concept of this nation.

    They will try to delay any legal actions on this until after the Election. Wish everyone would do some research and post a blog. Believe Obama’s past has been hidden for years – think he was groomed, mentored and trained for the Presidential Election.

    is the proper response to this suit IF the facts and/or law are on your side. I’ve been a criminal prosecutor for 21+ years but I still remember enough of my civil procedure (2nd highest grade in my class) to know that the way to stop Berg’s suit dead in it’s tracks is to produce the birth certificate (an official, certified copy from the State of Hawaii) along with a motion for summary judgment. The criminal analogue would be for the defendant charged with murder to produce the alleged victim alive or for the alleged car thief to produce a valid title in his name. Any other move is trying to get off on a technicality. Now, I’m not a conspiracy theorist (I don’t see black helicopters) but it seems to me that The One and his cronies have more than enough money on hand to put a courier on a plane to Hawaii with directions to bring back the certificate and plenty of lawyers who know how to write a motion for summary judgment. That they haven’t done so makes me think Berg may just be a blind pig (who found an ACORN?).

    If you have the facts, pound the facts. If you have the law, pound the law. If you don’t have either, pound the table.

    Of course, all of the above plus $3.50 may only get you a latte. Oh well.

    The plaintiff didn’t just ask Obama to produce a birth certificate. He served requests for seventeen categories of documents, including copies of Obama’s college and law school applications, requests for financial aid, college and law school papers, and “a copy of your entire presidential file pertaining to being vetted,” whatever that means. Of the DNC, he requested five categories of documents, including all documents relating to Obama. He also served 83 requests for admission. All of these things are a major pain in the ass to answer, and it seems clear that few of them relate to whether Obama is constitutionally qualified to be president.

    Moreover, the motion is merely to stay the request until after the court rules on the motion to dismiss, which is entirely proper. The motion to dismiss argues that the lawsuit cannot proceed in federal court, just as McCain’s did in his lawsuit. If granted, there is no need for any discovery, as the case will already have been resolved.

    Litigation is frequently abused and used to launch fishing expeditions, hoping to find an embarrassing document among the opponent’s records. It’s entirely normal for Obama and the DNC to resist this.

    because it would just make the republicans look silly. Still, I think this would have had no traction at all if Obama had been more open with his paperwork from college, etc. His secrecy makes people suspicious. Even though the suit asks for a lot of paperwork, providing the vault copy of the bc would have shut a lot of people up. I can’t imagine that they wouldn’t want this to go away since even ridiculous notions may go viral. In this very interesting election, it makes a interesting sideshow.

My point is that if you can make the whole thing go away by filing one document, in this case the birth certificate, why would you spend all of the time and money employing the all of the standard delay and resistance tactics? Unless, of course, The One is just going along with what his lawyers are telling him and letting them run up the bill, which raised its own questions about his judgment.
