Obama’s stimulus bill protects the AIG bonuses

What outrageous crocodile tears.

President Obama feigns choked up anger and Democrat Congress critters bloviate and threaten confiscatory taxes. It is all an act — an attempt to cover one’s posterior.

The Associated Press reports the Obama administration and members of Congress have known for months that American International Group was getting ready to pay huge bonuses while surviving on taxpayer bailouts:

It wasn’t until the money was flowing and news was trickling out to the public that official Washington rose up in anger and vowed to yank the money back.

So far, the administration has been unable to match its actions to Obama’s tough rhetoric on executive compensation. And Congress has been unable or unwilling to restrict bonuses for bailout recipients, despite some lawmakers’ repeated efforts to do so.

The situation has the White House and Treasury Secretary Timothy Geithner on the defensive. The administration was caught off guard Tuesday trying to explain why Geithner had waited until last Wednesday to call AIG chief executive Edward M. Liddy and demand that the bonus payments be restructured.

Not only did lawmakers and administration officials know about A.I.G.’s plans to pay hundreds of millions of dollars of bonuses last fall, but even more infuriating is the fact that language in Obama’s so-called stimulus bill actually protects the A.I.G bonuses.

The “American Recovery and Reinvestment Act of 2009,” provides at Section 111(b)(3)(D)(iii):

`SEC. 111. EXECUTIVE COMPENSATION AND CORPORATE GOVERNANCE.

[. . .]

`(iii) The prohibition required under clause (i) shall not be construed to prohibit any bonus payment required to be paid pursuant to a written employment contract executed on or before February 11, 2009, as such valid employment contracts are determined by the Secretary or the designee of the Secretary.

I can’t help but wonder what, if anything, those bonuses Obama received from A.I.G. had to do with this mess.

    We may yet find a few people in this country (including the media) that can follow the facts on this issue. Obama’s fingerprints are all over the AIG bailout from beginning to end. The stimulus and his past statements will be the coupe de grace.

    Obama’s mendacity and feigned outrage will only take him lower. There is no escaping he pushed trillions of dollars in poorly conceived, poorly allocated, poorly managed political debt on future generations. We will see issues down the road of a magnitude that will make us laugh at $165 million.

    Perhaps he can get a permanent spot on Leno.

      I don’t buy that they did not know. When Obama’s popularity started taking a hit they started this display of phony anger.

        In fact, I’m inclined to believe it was probably the only part they knew about, because it was part of an unofficial conversation with their lobbyist contributors. But there certainly were significant parts of the bill they didn’t read. But a bit more time for the opposition to “read” the bill so these bits could get publicized… That’s a different issue.

          I wonder what Barney Frank and Chris Dodd have to say about this? Any outrage? Will we call their CEO before the committee for a grilling to prevent the payment of these quarterly bonuses? No, nothing here, just move along.

      I can’t think of a clearer example of an ex post facto law. The court has allowed some leniency to the legislative branch in requiring taxes to be paid retroactive to the point in time where the bill started being discussed, but not farther back.Since the tax wasn’t being discussed prior to the bonuses being paid, this is on the other side of the bright line.

    As outrageous as this all is, with the duplicity and stupidity running rampant on both AIG and the government’s side, we need to move on to all the other more pressing issues.

    $165M is a big deal, but we need to be working on an effective means to battle the $3.6T budget and the constant barrage of federal power grabs that are hitting all around us.

      I can’t find the article now, but a couple of days ago I read a piece that indicated that Obama’s popularity has been taking a big hit over this. The American public is up in arms over it, and his fingerprints are all over it. It’s working, and we need to continue to push it.

        The same sort of thing applies here. Most people’s eyes glaze over when you start talking about overnight interbank lending rates, default credit swaps, freezing credit exchanges, etc. On the other hand, when you talk about Sr. Executives and Sales people getting paid million dollar bonuses when the company is failing and THEIR tax dollars, well now you’ve got their attention and it ain’t no tragedy, it’s a hanging offense. If the hanging offense has Obama’s finger prints all over it, well that”s gonna be a whole lot of suck for him.

    Of course, they knew. Geithner helped write the bailout for AIG. Dodd did the amendment to protect the bonuses in the stimulus bill. They all knew. What changed was the fact the people are mad and now the Dems are looking for political cover. The only problem is that there isn?t any. They did this. It is their fault and they cannot hide from this one.

      They should come before the American people and take that deep bow and say I’m sorry and then either do one of two things: resign or go commit suicide.

      NOTE: In the case of the Japanese, they usually commit suicide before they make any apology

    There are two separate lessons here:

    1) Government shouldn’t be allowed to run a lemonade stand. The Treasury knew, or should have known about these bonuses. Treasury ratified those contracts. Trying to claw them back now is nonsensical. Someone should take responsibility (ahem, Geithner) and fall on their sword, Grassley style.

    2) If politicians don’t like how you make money, even if it was legal and contractually binding at the time, they will arbitrarily tax it to death. That 90% tax rate could soon fall on you. (Coal miners, fast food restaurant operators, mortgage brokers take note)

      That’s the mentality of these people. We see that everyday. They will pick the pocket any day. If you drive less to save fuel prices they will tax it more. They will get YOUR money no matter what you do. That’s what Chuck was saying.
