Mike Lee – Playing Utah or Being Played?


So is Mike Lee playing Utahns for fools or is he being played?

 Follow the money trail

EnergySolutions, the large Utah-based nuclear energy waste storage corporation, had a candidate in the Utah Senate race. That was incumbent Senator Bob Bennett. He did not make it through the May 8 convention, but never fear – ES hedged their bets with another EnergySolutions champion from South Carolina who endorsed the young lawyer who argues that EnergySolutions’ rights trump Utah’s.

Senator Jim DeMint of South Carolina has received thousands of dollars over the last several years from EnergySolutions. In addition, his state recently voted to ban foreign waste, so he needed to find a new place to park it. Utah was the “lucky” winner.

In addition to the low-level radioactive waste, South Carolina needed a place to send depleted uranium. Over the protestations of Utah’s Governor Herbert, several boxcar loads of that uranium was recently shipped to Utah but Herbert secured a temporary court-ordered stay. If that were not egregious enough, ES is now trying to “blend” the waste so that the Clive facility can take the “hotter” B and C waste that Utahns oppose. If EnergySolutions can force Utah to take the depleted uranium tailings, they stand to make money.  If Utah has to take the blended waste, EnergySolutions stands to make more money.

The big cash cow, however, is the foreign waste from Italy. If they are successful at forcing Utah to take the waste, EnergySolutions stands to make $6 BILLION in profit. $200K thrown on an election is pocket change.

Why Mike Lee?

Who better than a young lawyer who made over $600,000 in 15 months arguing that Utah had no right to refuse foreign waste?  Mike Lee also had stock in the company, which he sold the day before he announced his candidacy — stock that rose in value, thanks to the tens of millions of dollars in stimulus funds that poured into EnergySolutions. It is likely the source of the “personal” money fueling his race, but the voters of Utah can’t know that because he refuses to file accurate FEC reports, even when reprimanded.

Senator Bennett was consistently with EnergySolutions and would have remained an acceptable choice to the corporation had he escaped the convention.  However, Lee is the better choice as THE lawyer who won the case that Utah lost. To get around the fact that almost 80% of Utahns are opposed to the importation of foreign waste – including Utah’s governor – EnergySolutions resorted to hiring a lawyer who can argue both sides of a case without batting an eye. Will he also do this on the Senate floor?

When Mike Lee was the general counsel for Governor Jon Huntsman, he was against Energy Solutions and for states rights. He argued passionately AGAINST the importation of waste, saying he would “kill it, then dance on the grave” of that waste. 

However, when he left that position, he took insider knowledge, turned it around and used it to argue against Utah. Governor Huntsman said of the betrayal that he was ‘highly disappointed’ that Lee was working with EnergySolutions. In spite of that, the state refused to back down on the Italian waste.” (Judy Fahys, “EnergySolutions Sues To Block Panel’s Say On Waste,” The Salt Lake Tribune, 5/7/08)

One candidate, Mike Lee, argues to force the state to take the waste and the other candidate, Tim Bridgewater, argues that Utah, as a sovereign state, should be able to decide something of this magnitude – the choice was obvious for EnergySolutions.

Get out of the way

Long before the Utah State Republican Convention where U.S. Senate candidates Tim Bridgewater and Mike Lee emerged for a primary run-off election, Senate candidate Cherilyn Eagar traveled to Washington DC to meet with a number of people and to work on getting her own endorsements. According to her campaign director, David Kyle, South Carolina’s Senator Jim DeMint suggested a line-up of his colleagues who might endorse her candidacy.  All was going well until they discovered she publicly opposed EnergySolutions’ proposal to bring South Carolina’s depleted uranium to Utah. 

 

DeMint and the Washington Establishment are now lining up behind the man most likely to bring home the bacon for EnergySolutions — the ES lawyer Mike Lee.

As I-Caucus has clearly demonstrated, there are many ways around campaign finance laws. One is to use multiple PACs to get individuals, lobbyists and other PACs to donate money far above the campaign contribution limit, then funnel that money to their candidate of choice. Mike Lee claims to have raised $115,000 online, yet it is Jim DeMint’s PAC that is responsible for $106,000 of it, with an additional $75,000 put in the race as an “individual expenditure.” Cozy with Jim DeMint AND Energy Solutions are Red State’s Erick Erickson and California Congressman Tom McClintock, both recent endorsers of the EnergySolutions lawyer.

Wanting a Senator who can bring home the bacon also means that if you cross EnergySolutions and their puppeteering, it could very well cost you your job. Popular radio talk show host Bob Lonsberry was fired yesterday after 10 years on the air in Utah. He was given no warning and, in fact, had just had a big party where his decade was celebrated and his success applauded.

But – he openly endorsed the other candidate in the race as a fighter who stood on principle. Not coincidentally, the #1 advertiser for KNRS, the station that fired him, is none other than … you guessed it … EnergySolutions. Also not coincidentally, EnergySolutions went to Tim Bridgewater earlier this week with a campaign contribution. Bridgewater rejected it. Bob lost his job within 2 days of his strong support for Bridgewater and Bridgewater’s rejection of the EnergySolutions offer – an offer that clearly has strings attached.

 

Utah’s puppetmasters

So just who is the puppet and who is the puppet master in Utah’s Senate race? Why would an out-of-state PAC and a couple of out-of-state politicians care about this race so much? What benefit is there to pouring hundreds of thousands of dollars into this race? It’s because the trade-off is worth it. $200,000 in, BILLIONS out. For whom? EnergySolutions and the ones dancing under their strings.

Utah deserves better than this. Utahns are smarter than this. As a state, we have rejected the importation of foreign waste. Why would we want to turn a blind eye to a lawyer who uses the Constitution as a campaign prop to further his own career and line his own pockets? Make no mistake – electing Mike Lee means electing someone who has sold his soul lock, stock and barrel to EnergySolutions and outside interests. He will not be representing Utah to Washington, he will be joining Jim DeMint in “controlling the Senate” and turning Utah into the nation’s nuclear waste dumping ground.

What is going on in this Utah race?

There have been quite a few hard fought primaries and arguments between supporters, but nothing has approached the polar opposite characterizations of candidates as this race. Rational discussion has long passed; it’s now entirely about tearing down the other candidate.

I sure hope we do get to the bottom of this after the election, because the political process cannot survive this level of poisoning.

I was surprised and appalled at two “comparison” flyers printed since the convention by the Mike Lee camp. (Has their name on it and everything) Not only were the ads of questionable accuracy, they totally contradict what Lee has been saying he would do and say during his campaign.

Lee also seems to be very quiet lately on the recent attack radio ads by Common Sense Issues, who went after Mitt Romney in favor of Huckabee with push polling, Where is his outrage over the deceptive ads Freedomworks and Jim DeMint are running, or are they getting their message from Lee’s camp?

That those that are endorsing Lee are trying to smear Bridgewater with and use for fundraising for Lee, the “temple” flyer is pretty low.

The group that went after Lee prior to convention also went after Bridgewater with “polling” as well.

I am also amazed that Mike Lee is going after Bridgewater over his consulting work for Raser Technologies when the campaign director for Mike Lee since convention, had worked as Raser’s attorney for over 3 years.

The fact that Cherilyn Eagar endorsed Tim Bridgewater, and Bob Bennett endorsed Bridgewater, in my mind, has more to do with how the Bridgewater campaign treated those two campaigns with greater respect than Eagar and Bennett agreeing with Bridgewater on issues.

Tim Bridgewater has my vote.

Cherilyn Loosing any chance of future support

I greatly respected Cherilyn Eager for staying neutral at the Convention. Even more so, when she came on the radio talking about when the Bridgewater campaigned offered to pay her campaign debts if she endorsed them, and she turned it down.

Then she turned around and made the endorsement. I could have let that go. But now I see her being the “puppet” in this article talking about “playing or being played”. Cherilyn has totally abandoned her supposed conservative values by throwing her hat in with a government expanding candidate in hopes that it will politically benefit herself (and financially) in the future.

Now she is buying off on, and spouting out total garbage. This is almost as bad as the campaign e-mail she sent out about Mike Lee, and how she is so wonderful and calling Mike Lee a socialist. It was total garbage, and so is this.

Cherilyn Eager has totally destroyed any chance of a future political run. I would have seriously considered her before the last 3 weeks. now I will actively work against ANY race she makes in the future as hard as I have worked against Senator Bennet, and as hard as i have for a good, strong, conservative candidate, Mike Lee. I have volunteered 100% of my time for 3 months straight to help a great man, Mike Lee, get elected. I can afford to do so. This effort will go against ANY attempt at a political future this woman ever attempts.

I don’t even have time to refute all the nonsense here – from Energy Solutions, to Mike getting Bob Lonsberry fired. Lonsberry’s ratings were #27 out of 32 utah Radio Stations. He came in below AM classical music stations, his contract was up, and he was let go. This was verified by his OWN SON. It had nothing to do with Mike Lee, it had everything to do with that his ratings STUNK.

Too much crap here to refute, but Cherilyn Eager is self-destructing her political future.

Wrong about Eagar - She is right about Lee

I totally disagree with “laststand.” I received the phone calls rom DeMint stating that he endorsed Lee. The statements DeMint made in his calls about Lee being the first to do this and the first to do that were wrong. DeMint made sure to state that “no candidate paid for this call” it was paid for by Jim’s PAC. Doesn’t that concern any Lee supporters? That a senator from a state that needs to get rid of radioactive waste, who takes donations from ES, and pours money into Lee’s campaign even cares about a senator from Utah?
Also, Cherilyn Eagar did her homework on this one. Jim DeMint withdrew his support from her when she wouldn’t go in the direction Jim wanted with
ES. She has no reason to lie about this. She is a political force in Utah and remains the most conservative Republican voice in Utah. Why did Lee back out of the debate?

as a whole, generally is not interested in “blended A,B,C=A” waste, foreign hazardous waste, and is not convinced that depleted uranium coming from South Carolina is being stored properly and safely.

EnergySolutions tossed its previous leader over these issues.

This isn’t just the “liberal democrats”, but most everyone in Utah, republicans and democrats.

This one issue alone could easily cost Mike Lee wining in November if he pulls off his current tactic next Tuesday.

Bridgewater was too nice to even go after this issue.

I would guess listening to Jim DeMint, Redstate.com, Freedomworks and Common Sense Issues smears she decided to fight back.

Lee backed out of the debate – which was only one of many debates – I think there were 3 or 4 yesterday alone – because the venue was changed to one that was owned by Bridgewater’s clients. Not a neutral set up.

What really matters now is what Eager has done to her political future. The people with any sense in Utah have seen her for what she is, and they don’t like it.

Mike Lee remains the best choice for Utah – one who has never taken govertment funds (read “your tax dollars”) unlike the other candidate.

Eager is triangulating for Bridgewater at a great personal cost.

 
 
 

Mike Lee and Energy Solutions

Mike Lee represented Energy Solution in one case and one case only and that was when Utah violated the constitutional rights of Energy Solutions. Utah was in the wrong in that one specific instance. I have questioned Mike on this thoroughly and he has never hemmed, hawed or prevaricated when answering me.

Mike’s job as a constitutional attorney is to defend the constitutional rights of his clients, especially when they are being violated. Mike has made it very clear he has no desire to have higher levels of radioactive waste stored in Utah. It has not been reported accurately by many and I am disappointed this fallacy would be reported on RedState.com.

Mike Lee has not misrepresented his income and has been very clear that he does not make $600,000 a year. The form has options, broad ones, and you have to choose the ones your number falls into, even if it’s in the lower rather of that choice.

I have always found Mike to be a man of integrity, courage and strength. Never has he said one thing or done another since I began watching him., listening to him,, speaking with him and questioning him.. I have found him to be a principled conservative who desires bringing America back to constitutional government and Utah in control of her lands once again. He has fought tirelessly for the return of our lands and state sovereignty. He has the endorsements of people like Mark Levin, Carl Wimmer of the Patrick Henry Caucus, 31 Utah Tea Party leaders, the Tea Party Express, Ron Paul, Mark Shurtleff and many, many more. These people, myself included, do not give their endorsements lightly. As I have, they have come to understand that Mike Lee is the answer for Utah. With him he will begin the battle for the Constitution to be returned as the rule of law and the Republic to be fully restored. He knows how to do this and he has the backbone to get it done.

Constitutional Issue

Key word here: “international.” This key word is more important than all the others in this article, yet gets little attention. Should Utah legally be allowed to tell a company with which countries it can and can’t do business? Isn’t this a power reserved specifically for the federal government? This is my understanding of what Mike Lee fought for: legality and constitutionality. It’s what he says he fights for, and this is what he is doing even when a misinformed public construes his actions to be otherwise.

Seriously: what’s the difference between radioactive waste made in Ohio as opposed to France? If we don’t want to be nuclear dumping grounds, we shouldn’t be the dumping grounds for anyone.

Eager, I now have a lot less respect for you either because of your ignorance or your mud-slinging. If you’re going to have something negative to say, at least make it accurate.

Radioactive waste and spent uranium rods are a type of waste different in nature to just about anything else. If 80% of Utahns oppose ES than Utah has every right and moral obligation to stop it.

The argument that companies can overcome the sovereignty of the state of Utah, greatly degrades the sovereignty of the state and increases the power of corporate interests and the Federal Government over the people of the state.

Has Cherilyn Eagar come unhinged? I knew when I visited with her last December when it was rumored that Mike Lee would be entering the Utah Senate race that she had less than kind feelings for him. But the above is vile screed. It rivals the “temple mailer” that was unleashed just prior to the state convention in May.

Once the June 22 primary is over, we will need to live together with whomever the victor is as our candidate in the general election. Let’s not tear ourselves apart like ravenous flesh-eating packs of wolves.

I agree with Candice Salima above. Mike Lee is a constitutional attorney, and he defends constitutional rights wherever they need to be defended. Its a matter of principle to defend principles in a balanced manner, and not just when it is convenient. A lot of Americans hated John Adams when he defended the British soldiers who had been unjustly condemned in the so-called Boston Massacre. He was correct to defend their rights, and Mike Lee has been equally correct to defend the constitutional rights of the unpopular.

I still hold out hope that Cherilyn Eagar will run against and defeat Orrin Hatch in two years, but right now, I am expecting an apology from her first.

 

South Carolina Can Ban Foreign Waste

The Lee supporters (and likely campaign staffers) commenting scare me as they either don’t understand or have the courage to comment on the implications of Bob Lonsberry being fired, which Cherilyn Eagar so openly raises in her post above.

This is very real, frightening and blatant abuse of the 1st Amendment and should leave readers of this post in disgust. The corrupted influence on KNRS along with all of the other truths/facts mentioned in Cherilyn’s opinion piece demonstrate just exactly how disdainful politics have become and how wrongly influential Washington insiders have been here in Utah especially in association with Mike Lee.

If Bob Lonsberry was in fact fired because he openly supports Tim Bridgewater, and KNRS’s largest advertiser is ES, a Company openly in alignment with Mike Lee and who pours big $$ into the campaign coffers of anyone willing to promote its and their own monetary interests (i.e., Jim DeMint) as well as offered Tim Bridgewater campaign finance support just this past week right before the primary, all of the vicious, uncorroborated arguments are MOOT.

Yes, speckk, Utah and its residents have the right to say “HELL NO” to being a nuclear waste dumping ground especially if negligence can be substantiated and proven and should be pushing back hard on the Federal government on this matter. Businesses/capitalism and the federal government thrive on the same thing: being continually checked and balanced by the will of the majority, which we must hope fosters good conscience when managing profit and good legislation that benefits ALL Americans. I have to believe that is how the Founding Fathers meant it to be.

You can agree or disagree with Cherilyn Eagar on issues and policies, and that’s your right. But, the facts are the facts…so make sure you fact check before slamming the messenger.

One fact I can attest to is Cherilyn Eagar unlike so many of today’s politicians has the guts to speak the truth regardless of her future in politics, something I wish more candidates and politicians in Utah and nationwide could include on their resumes.

How many ads have EnergySolutions sent to state delegates and likely primary voters. If it was just Bob Bennett they wanted to protect the ads would have stopped with the convention.

Don’t forget Club for Growth as well. They have spent well over a hundred thousand on this race. According to OpenSecrets, they are Jim Demint’s largest single donor.

FYI, I am a UT state delegate, a precinct chair and on my city’s Planning Commission. I just refuse th drink the Mike Lee kool-aid. And yes, I finally registered to give my great wisdom & insights of this kooky UT senate race. Why being so elitist, Neil? Thought that behavior was reserved for Liberals.

I’m sure that you might even have comments on the Governor race between Bill “I blow money” White and Rick Perry. What Tim Bridgewater did does effect me, but state Reps and Senators like Debbie Riddle or Dan Patrick don’t everyone in the US, unless you have business here in Texas. Federal Office holders have a great sway on legislation and as such are needed to scrutinized before voting the in the Primary or General.

Utah has early voting for this primary. After reading Ms. Eagar’s comments, I’ve been motivated to go vote right now and not wait for Tuesday. I’m voting for Mike Lee. Good man.

Cherilyn, for being a principled candidate, you can fling mud with the best of them! I gained a respect for you that I hadn’t had before when you stood by principles and refused Tim’s offer at the convention. I was even willing to consider you as a possibility in the future, but that has changed now. Supporting Tim is one thing, but going after Mike with your phony innuendos via e-mails, phone calls, and now this? Not only will I never support you, but I will fight against you any way possible!

This is not the first tiem Lonsberry has been fired and it won’t be the last. Mike Lee represented the state defending our rights to NOT take NUCLEAR waste into our state. He defended ES on ONE case in regards to their Constitutional rights to continue taking Class A LOW LEVEL waste (that the state has allowed them to store for nearly 20 years now without any adverse effects) because it has already been allowed & crosses state lines it falls under the FEDERAL jurisdiction, not the state’s. There is a HUGE difference between NUCLEAR waste & LOW LEVEL waste. The exit sign in my salon emits too much to be stored in the ES facility yet people walk under it every day and don’t worry about it. I doubt if they would care if I got it from Italy or China or Utah.

Mike has NEVER flip-flopped on these two issues. He is AGAINST bringing NUCLEAR waste to Utah. He is FOR Constitutional rights of a company who stores LOW LEVEL waste in Utah.
