The Lawsuit Story Was Completely False


On August 24th, news outlets across the country carried a story detailing my apparent desire to pursue a lawsuit challenging President Obama’s standing as an American citizen. Unsurprisingly, the story garnered quite the emotional response from those on both sides of the political aisle. While the story has been quite popular, enjoying generous coverage from several blogs and television programs including Hardball with Chris Matthews, The Rachel Maddow Show, Politico, The Huffington Post, and The Daily Kos, the story also happens to be completely false.

My purported plan to question Obama’s citizenship in court was initially reported in a story printed by the Mohave Daily News: “[Franks] did say there was a lot of conflicting evidence of Obama’s citizenship and that he was considering filing a lawsuit, the only congressman to do so.”

The word “considering” apparently caused a great deal of confusion, causing many to believe that I am presently contemplating legal action against the President of the United States to force him to prove his citizenship status and therefore his eligibility to continue serving in the office of the President.

The original misrepresentation of my remarks was an honest mistake, and when brought to the reporter’s attention, he wrote a correction story that more clearly articulates the actual facts. My actual remarks were the exact opposite of that which was blindly repeated by countless main stream news outlets, and yet the original context of my remarks was completely ignored in a bid for an easy ratings-grabbing story (indeed, Politico’s stories regarding my alleged quote were among the Top 5 most read stories on August 24th).

For those interested, here is what I actually said, which immediately led to the vicious– however false– news reports that rapidly went “viral” throughout the leftist blogosphere:

“The ironic part about this is I was one of the few Members of Congress that was willing, if I could come up with a way to prove that Barack Obama was not born in this country, I was willing to go into a lawsuit. I don’t know of any other Member of Congress who was willing to do that, because I wanted to make sure that we were protecting both the Constitution and, quite frankly, I was terrified of this guy. But I wanted to do it in a way that comported with the honest evidence that I have in front of me. And so we did all kinds of research. We found all kinds of conflicting research. And we had to say, ‘Okay, I’m going to divorce myself from politics and I’m going to look at the evidence for what it is, and see what we come up with.’ And one of the things that happened, about three days before we were going to launch a lawsuit, is that we found several different newspapers that had shown that Barack Obama was born in Hawaii two years after it became a state. Now, there was no way to have forged that…I just don’t have evidence that shows me that he was not born here. Now, I know that everybody says that they’ve got it, but I’ve never seen it.”

Further, I continued: “…the fact that we found [the evidence that Pres. Obama is a natural-born, American citizen] made it impossible for me in good conscience to go into a big lawsuit.”

These comments are easily verifiable, if one merely exerts enough effort to actually listen to audio of the event. Instead, the above-mentioned media sources (among many others) seized on the opportunity to go on the attack, some of them even AFTER being told directly by my office that the purported comments were a misrepresentation of what was actually said. The story was apparently too “juicy” not to run - even knowing that it was based on a false report. The journalists who ran with it were willing to throw their journalistic integrity to the wind to pursue a sensational account that was based entirely on a one sentence summary (not even a direct quotation) of nearly ten minutes’ worth of remarks. That’s unbiased, fair, and accurate reporting for you. Way to go, MSM.

Unsurprisingly, these same journalists are not quick to apologize or print retractions. Nonetheless, in light of the information I’ve presented above, I encourage every media outlet that spread the claim that I am in the midst of pursuing a lawsuit, because I supposedly don’t believe the President was born in the United States, to have the backbone to admit their mistake.

it is their duty to make anyone on the RIGHT side of the divide who is not a “Maverick” and not succumbing to attacking the RIGHT to destroy you. I hope you all in Congress recognize that fact and act accordingly which is to say ignore them and trudge on. I would like you to go to all of the members of the Republican party and let them know that Americans do NOT want the government in our healthcare and stop whatever your leftist members attempt to pass.

Some of us expect this kind of behavior by now, particuarly because we’ve been around the blogosphere for many years, but there are a few people in Washington who are still learning the landscape. I read your original remarks and I took them to be exactly what they were, and so (I hope) would everyone here:

There just was no “there” there when it came to investigating the “birther” claims. We *knew* that because of people like you, in the first place.

And in my view, Congressman Franks, Barack Obama is proving himself to be more of an alien to this country through his actions than anything that could ever be contested about a birth certificate. I’m quite sure, in fact, that people in Chicago who had anointed him as the next President were careful to investigate the provenance and legality of his birth before he ever made it to the U.S. Senate: it was largely the intellectuals in Chicago who made him what he is today. That concern was addressed very early on, and in terms of popular “chaos” and headline making, it was a red herring. It was something that should never have even attracted attention.

Obama himself, on the other hand, is proving to be more than controversial enough to make any question of his birthright seem like small potatoes.

First, for basing your decisions on the facts, not suppositions, rumors, theories or blindly taking things at face value.

Third, for correcting the record when the media is too eager to embarrass Republicans with distortions and lies.

I too have seen the newspaper birth announcements for Barack Obama, that were in Honolulu papers in August 1961. While there is some remote and plausible scenario where he might have been born elsewhere yet get these announcements in Honolulu papers, that’s not how it works 99.99% of the time, and there is zero evidence for anything other than a birth in Honolulu. The birthers have become hermetically sealed to real evidence and facts.

I would not let ANY media source get away with this. Please DEMAND equal time to go on these shows, even the hostile ones (like Maddow) to correct the record.

Could you please follow up on this? I’ve been following this story myself and I have yet to see anyone prove the NBC issue in either direction. In fact there is a certain lawyer out there offering a $100K reward to someone who can prove Obama’s NBC status. I’d like to have that $100K so could you please provide the NBC evidence you uncovered?

Natural Born Citizen has everything to do with the nationality of the father and almost nothing to do with the place of one’s birth.

It appeals , in part, to the law of nations. The Constiution also appeals to the law of nations, meaning that phrases which have significance in the realm of international law we can be certain the framers had in mind by using such terms

Btw: One of the reasons why the XIV Amendment does not say “Natural Born Citizen” because the definition of Natural Born Citizen wasn’t up to them to change. The Definition of NBC was one born of American citizen parents.

The citizenship granted by the XIV does not necessarily fit that definition, thus they used general term “citizen”

A Natural Born Citizen is a (partial) subset of that.

Thanks for joining us on the pages here. It looks like the mistake was in clarity of message in the article. I agree that you were considering filing a court action, and made efforts to prepare, but in your research changed course. Had the report said “is considering” then it would have shown malice, but the “was considering”, though accurate, did not further explain you reversal.

Quite frankly, I think your honesty and diligence tells more about you than any article can. I hope you are able to tell your side of the story on an outlet that gets you wide exposure. As for the persistent “Birthers”, well, just tell them they aren’t doing us any favors.

I hope when his term or terms are up the supreme court has actually ruled on what a natural born citizen is.. I know I would not want for example Osama Bin Ladens son from perhaps an American woman to run for president just because the woman is a US citizen. That sounds a little crazy. The birth certificate is irrelevant regardless where he was born. It is the natural born situation. Natural born is only used in reference to the president of the united states.

You do yourself no favors by sitting upon the fence on the subject of presidential eligibility.

You make no friends on the left or the right by having made the point an issue that you yourself brought to the fore and then distancing yourself from it.

It matters not whether Obama himself is a natural born citizen or not. The issue at hand is do we still live by rule of law or not. If your answer is yes, then your conservative duty is to attempt to legislate a method to ensure compliance with the law. The law says a President must be eligible to hold the office. This President has skirted the law by stonewalling the question and thumbing his nose at the people and the courts have let him do it to the great frustration of the people. You as member of congress have the opportunity to pass legislation that would put a stop any brazen show of contempt for the US Constitution with respect to elegability, if not for this President, then certainly for the next. HR-1503 was written as a federal remedy for this problem. So tell us, do you support HR-1503 or no?

If nothing else, the ‘birther’ movement has shown me the inadequacies of how candidates for president can be placed on state ballots.
Forgetting about Obambi, the fact that 3rd-party candidates like Roger Calero can make it onto all but 9 state ballots for president is cause for concern. (Sorry - not sure how to do links.)
There is no uniform state-by-state vetting of candidates. We are a nation of laws, and we need a better way to make sure the ones in the Constitution are upheld for this critical office.

At this point, there will not be enough people who really care whether he is or isn’t as far as it goes and hardly anybody believes he isn’t, including me.

However, there is payback. I remember the furor over John McCain because he was born in Panama and the hoops he had to jump through to prove he is a citizen because of it. The left did that.

You should look at this as an opportunity to show equality under the law.

Obama has spent millions to block anyone from seeing his records. Now, his personal worth isn’t so great that he can afford to do that without some deep pockets protecting him or he’s using tax payer money to do it.

Forget the birther conspiracy. Whether you do or don’t believe it’s a nonstarter in any court. If you want to spend money on stuff like that then there are other things that can be done that will resonate with the people and you might get your “truth” at the same time. As long as you keep beating the Birther drum, less and less people are going to listen to you.

We’re too busy fending off the takeover of the country while you take years and millions of dollars getting a birth certificate that more than likely will prove he is a citizen whether you like it or not.

I am afraid you must be ill informed; the eligibility issue holds wide popular support. Just one relatively minor internet news site has registered nearly half a million signatures demanding action on the issue and nearly a dozen congressmen have signed on as co-sponsors of a bill (HR-1503) to use federal law to mandate that candidates for president and vice-president must submit documentary proof that supports their claim of eligibility. The issue has legs and will continue to grow as we move closer to the next election cycle.

People don’t like their Constitution trampled, nor do they like arrogant politicians who refuse to acknowledge that the law applies to them in the same way it applies the rest of us.

If the SoS in each state has no power to verify the eligibility status of a candidate for POTUS how was Calero denied ballot acces in those states?

Either eligibility is decided by the SoS in denying ballot access or it is up to Congress to ensure eligibility when the electoral votes are counted.
