My interest in Switzerland was spurred around 7 years ago after reading a book, The Seven Myths of Gun Control.   The author argued that America was originally founded on the republican form of Swiss governance.

My how we have strayed from the Swiss, and original American model.

Additionally, I have always admired Switzerland’s unwavering foreign policy of not meddling in foreign entanglements and until recently, their banking and monetary policies.

In his article Why Switzerland is Still Free and America Is Not, posted at Lew Rockwell dot com, Ron Holland highlights reasons to admire the Swiss and look to their model for answers to solving our dire political problems.

In Switzerland, the people still rule and have the ultimate right to decide decisions above the government or parliament. Through the right of referendum they can cancel legislation and with the initiative they can pass or create legislative action on issues parliament refuses to act upon.

The bias and closed statist views shown in the article is business as usual for the US media elites out to protect the American political establishment and are so evident in this headline and article. It isn’t the question they asked but rather the question they didn’t dare ask is the “700-lb gorilla in the room.”

Quoting from the article, “Critics say the SVP, the largest party in Switzerland’s coalition government, has taken advantage of the country’s unique brand of direct democracy to push its populist, anti-immigrant agenda on the Swiss electorate. Citizens have the right to propose new laws in Switzerland – the only thing they need to force a nationwide vote on an initiative is a petition of 100,000 signatures.”

Mr. Holland goes on to wonder how America could benefit from Switzerland’s style of direct democracy.

How America would be different if we had Swiss-style political rights to restrain government where the people rule instead of the special interests. Imagine an America where the billions in graft and political influence that control Congress could still buy legislation but not ultimate control if we as a people could overrule their actions.

What if the will of the people still ultimately controlled the political system and direction with true limited government at the federal, state and local level? Imagine the American electorate overriding Congress and demanding a strong dollar backed by real gold reserves, an audit of the Federal Reserve, a rollback of the bailouts, a declaration of war for foreign military intervention, the abolishment of the Patriot Act and a return to banking privacy.

Yes, a Swiss political party (The Swiss Peoples Party) promotes a nationalist agenda to the Swiss voters and they will ultimately decide in referendum yes or no on the issue. This is currently impossible in the United States but Swiss direct democracy and limited confederation government have worked in Switzerland for hundreds of years.

This is far superior to the two-party monopoly in America where the elites controlling both parties can push their self-serving agendas without restraint. Currently, short of the Tenth Amendment movement, state nullification or outright state secession, there is no real effective way to push back against Washington.

The supposedly enlightened elite in America are constantly prattling about the need to look to Europe for political guidance, how about Switzerland?

Thousands of Detroiters lined up Tuesday, outside Detroit City Halls, to apply for a share of federal, economic, “stimulus” funds. $15 million dollars was taken from taxpayers and given to the City of Detroit to battle homelessness. There were so many people in line that they ran out of applications.

Here are the guidelines for eligibility from ClickOnDetroit dot com:

Application Guidelines

To qualify, a person must have been a resident of Detroit for more than six months, must be homeless or facing eviction and must be able to maintain housing after receiving assistance.

Also, a resident must make 50 percent less than the median area income, which would be less than $24,850 for single Detroit residents and less than $35,500 for a family of four.

No mortgage assistance will be available through this program.

Once applications are reviewed, only applicants eligible for funding assistance will receive notification from a service provider.

WOMAN: I sure did. And I filled it out, and I am waiting to see what the results are going to be.

WOMAN: I believe it’s coming from the City of Detroit or the state.

ROGULSKI: Where did they get it from?

WOMAN: Some funds that was forgiven (sic) by Obama.

WOMAN: Obama getting the funds from… Ummm, I have no idea, to tell you the truth. He’s the president.

Barack Hussein Obama has become the first president to boycott the Dalai Lama since he began visiting the nation’s capital in 1991.

Interestingly, Obama’s boycott comes a little over a year after he, and now secretary of state and then democrat party opponent Hillary Clinton, called on president George W. Bush to boycott the Beijing Olympics opening ceremony.

That was then and this is now.

Sophie Richardson, an Asian advocate for Human Rights Watch said:

“This idea that if you are nice to the Chinese Communist Party up front you can cash in later is just wrong. If you lower the bar on human rights they will just move it lower and lower.”

Sadly Ms. Richardson only one U.S. President has had the fortitude to stand up against communism.

Jada Harper, a seven year old girl from Green Forest, Arkansas, was diagnosed in June with a malignant brain tumor.  The tumor is a brain-stem glioma and is inoperable.

In July, Jada was taken to the world renown M.D. Anderson Cancer Center in Houston.  She was given chemotherapy and radiation which began to shrink the tumor but the little girl was given only 18 months to live.  Unfortunately, three weeks ago, part of her brain was killed when she had a seizure and slipped into a coma.  She is currently unable to breath without the use of a ventilator.

From Harrison Daily Times:

The child’s grandmother said medical experts at M. D. Anderson’s recently gave Jada’s parents a choice: to give her further radiation, which might buy her six months — “They said she could stay here, and let her lay here and let us keep her alive for maybe six more months. Or — you could take her home and give her three months.”

Wanda said Savannah and Jason “couldn’t bear to think about her lying there in that hospital for six more months. They decided to take her home to her family, to everyone who loves her. Everybody is here.”

To bring Jada home to Arkansas to spend her final days with her family and loved ones would require transport by air ambulance.  The cost of an air ambulance would be $10,000 - $15,000.

Enter the greedy, capitalist, pigs at Federal Express.

Tiffany Gilliam, a close friend of Savannah’s (Jada’s Mother), kept updating Andrea Martin, Green Forest Elementary principal, with what was going on with Jada. Andrea called someone she knew at FedEx to see if they could help. She called the right person when she called Kelly Madewell, who is flight operations specialist at FedEx Freight in Harrison.

“This all took place on Thursday,” Wanda said. “The next thing we knew, Savannah called us from Houston, and she was crying and crying. She said they had called her to tell her that FedEx had a flight coming to pick her and Jada up and bring them home.”

Add the student loan industry to the list of enterprises taken over by Obama.  I heard Rush mention the house vote on a bill that put an end to private, student loans, then read a blog about it by Rep. Michelle Bachmann (R-MN).

Advocates like the President maintain that if passed, this bill will bring a "level playing field"  between government and private options. Sound familiar?

WCBSTV is reporting that on top of failing to report $1 million dollars of outside income and $3 million in business transactions as required by house disclosure rules, Mr. Rangel refuses to discuss how the he could fail to report the income when he is in charge or writing the nation’s tax laws.

Apparently, Rangel feels confident that his “insurance policy” will guarantee that the House Ethics Committee will exonerate him.

Just what is Rangel’s insurance policy?

There may be a reason for Rangel’s arrogance. CBS 2 HD has discovered that since ethics probes began last year the 79-year-old congressman has given campaign donations to 119 members of Congress, including three of the five Democrats on the House Ethics Committee who are charged with investigating him.

Charlie’s “angels” on the committee include Congressmen Ben Chandler of Kentucky, G.K. Butterfield of North Carolina and Peter Welch of Vermont. All have received donations from Rangel.Unfortunately his faith in his insurance policy will probably prove to be well founded.

No man should be able to afford such arrogance.

The warning comes just a week after a report by the Patients Association estimated that up to one million patients had received poor or cruel care on the NHS.

Of course, the good intentions have to be considered.

The scheme, called the Liverpool Care Pathway (LCP), was designed to reduce patient suffering in their final hours.

Dr Peter Hargreaves, a 20 year practitioner of “palliative medicine” (hospice like medicine?) is concerned that a “near death” diagnosis in Britain is becoming a self fulfilling prophecy.

He said: “I have been practising palliative medicine for more than 20 years and I am getting more concerned about this “death pathway” that is coming in.

“It is supposed to let people die with dignity but it can become a self-fulfilling prophecy.

“Patients who are allowed to become dehydrated and then become confused can be wrongly put on this pathway.”

He added: “What they are trying to do is stop people being overtreated as they are dying.

At least everyone in the U.K. has health insurance.

High-frequency trading

Obama and his minions continue their attack on capitalism. Scheming with the ACL-CIO, democrat politicians seek to impose a tax on investment firms that earn billions of dollars in profit through high-frequency trading.

The nation’s largest labor union and some allied Democrats are pushing a new tax that would hit big investment firms such as Goldman Sachs reaping billions of dollars in profits while the rest of the economy sputters.

The AFL-CIO, one of the Democratic Party’s most powerful allies, would like to assess a small tax — about a tenth of a percent — on every stock transaction.

Small and medium-sized investors would hardly notice such a tax, but major trading firms, such as Goldman, which reported $3.44 billion in profits during the second quarter of 2009, may see this as a significant threat to their profits.

How, exactly, does imposing a tax on profitable Wall Street firms benefit AFL-CIO members? And why is a labor union involved in tax policy?

Thea Lee AFL-CIO policy director, says the tax would have two benefits.

“It would have two benefits, raise a lot of revenue and discourage speculative financial activity ,” said Thea Lee, policy director at the AFL-CIO.

What’s wrong with financial speculation? Isn’t capitalism and a free society based on speculation? What is an entrepreneur doing when they start a business and employ those who can offer only their labor, isn’t that speculation? There are no guarantees of success. The entrepreneur is at risk of losing their capital.

Liberals are furious that anybody, except the 100% profit government industry, is not being crushed by the recession they induced.

The proposal would hit especially hard those hedge funds and large banks earning hefty profits despite the shaky economy from a practice known as high-frequency trading. High-frequency traders use powerful computers to conduct hundreds of thousands of orders in mere seconds, taking advantage of slower traders.

Liberals are angry the company, which immersed itself in the frenzy of speculation leading to last year’s financial collapse, is now making huge profits after accepting (and repaying) $10 billion in government aid. Goldman employees are on track to earn an average of more than $700,000 this year.

If you didn’t want them to be profitable, why loan them the money? They should have been allowed to fail. That way liberals wouldn’t have to be angry and Goldman couldn’t earn their profits.

Rep. Peter DeFazio (D-Ore.), chairman of the Highways and Transit Transportation Subcommittee, has a better idea. Let’s tax commodities speculators.

“The tax is simple; it imposes a small burden that penalizes short-term traders for speculating on the price of oil,” DeFazio said in a statement. “This legislation exempts legitimate hedgers from the transaction tax. Since the tax is on speculation only, it deters speculation and undermines much of the crude oil price bubble .”

Wrong congressman, if you want to prevent bubbles, first, take an economics course, second, cut spending and third, stop printing money.

“President Obama’s $787 billion stimulus bill has done more to help convicted criminals than it has to actually boost our economy and create jobs,”

The Boston Herald is reporting that as many as 4,000 criminally convicted individuals were sent federal stimulus checks with a cost to American tax payers of almost $1 million.

Twenty-Three inmates in Massachusetts received checks and among their ranks are a prisoner convicted of first-degree murder, three prisoners jailed for second-degree murder and five convicted rapists.

Not surprisingly, only five of the inmate recipients in Massachusetts have the money to pay back the improper payments.

The Inspector General of Social Security is now tracing the checks that were mailed to 3,900 prisoners at a cost of nearly $1 million after yesterday’s report in the Herald.

Social Security Administration spokesman Stephen Richardson said yesterday none of the prisoner recipients receive monthly Social Security benefits, meaning they should not qualify for a stimulus check. Such benefits are generally cut off to the incarcerated.

The IG also is investigating whether any improper payments were made to dead beneficiaries, felons on the run from the law, individuals living overseas and recipients no longer legally authorized to live in the United States, said IG spokesman George Penn.

Perhaps, in this case, crime does pay.

Akin to borrowing our way out of debt, the AP reports that "neither spending cuts nor broad tax increases would be prudent deficit-fighting measures".  Really, how can spending cuts not be prudent?  What should be done, print more money, borrow more?  Those two options don’t seem to be working but God forbid cut spending.

The country’s economic output looks more bleak.  Our deficit approaches $9 trillion dollars, unemployment soars, the dollar plummets, the economy contracts, and nobody in the nation’s capital can figure out how to subtract.

White house projects bigger deficits, bigger debt

Republicans were ready to pounce."The alarm bells on our nation’s fiscal condition have now become a siren," Senate Minority Leader Mitch McConnell, R-Ky., said. "If anyone had any doubts that this burden on future generations is unsustainable, they’re gone — spending, borrowing and debt are out of control."

Mr. McConnell, perhaps alarm bells should have gone off eight years ago when Republicans were in control of the White House, Senate, and House?

If not then, weren’t they ringing in the fall before the first "stimulus" bill was passed?

Alas, America and the rest of the world should be heartened, Obama has the solution. He has nominated one of the architects of the current recession, Fed Chairman Ben Bernanke, for another term.

Obama himself may have drowned out the rising deficit news with the announcement Tuesday that he intends to nominate Ben Bernanke to a second term as chairman of the Federal Reserve. The Bernanke news could neutralize any disturbance in the financial markets caused by the high deficit projections.

We better make sure the printing presses are powered up.  Hopefully, D.C. will start powering them with Obama’s green energy.  That’s the only way they will be stopped.

Only in government can ineptitude be rewarded and looked to for salvation.

Dear Congressman Peters,

I have a few questions about the “Health Care” bill.

First, it appears that the president’s statement that Americans can keep their current health care coverage is a subterfuge at best and an abject lie at worst.

Please refer to page 16, section 102 which reads:

GRANDFATHERED HEALTH INSURANCE COVERAGE DEFINED.—Subject to the succeeding provisions of this section, for purposes of establishing acceptable coverage under this division, the term ‘‘grandfathered health insurance coverage’’ means individual health insurance coverage that is offered and in force and effect before the     first day of Y1 if the following conditions are met:

LIMITATION ON NEW ENROLLMENT.—IN GENERAL.
Except as provided in this paragraph, the individual health insurance
issuer offering such coverage does not enroll any individual in such coverage if the first effective date of coverage is on or after the first day of Y1.

DEPENDENT COVERAGE PERMITTED.—Subparagraph (A) shall not affect
the subsequent enrollment of a dependent of an individual who is covered as of such first day.

LIMITATION ON CHANGES IN TERMS OR CONDITIONS.
Subject to paragraph (3) and except as required by law, the issuer does not change any
of its terms or conditions, including benefits and cost-sharing, from those in effect as of the day before the first day of Y1.

The “Limitation On New Enrollment” appears to be saying that I can keep my current coverage as long as I have it before the health care bill goes into effect and stay in the same program.

However, the “Limitation on Changes In Terms or Conditions” says that any changes to my current coverage are not allowed.  I read this as if I change jobs or features or premiums in my current coverage that I will be forced to accept Obamacare.  I DON’T WANT YOUR HEALTH CARE.  I will pay for what I want.

Tell me where I’m wrong?

Further, how are private insurance companies supposed to stay in business if they are not allowed to enroll any new clients as outlined in the following sentence, “the individual health insurance issuer offering such coverage does not enroll any individual in such coverage if the first effective date of coverage is on or after the first day of Y1”?

Next, refer to page 59, Section 103, lines 21-24, which read as follows:

21 ‘‘(C) enable electronic funds transfers, in
22 order to allow automated reconciliation with the
23 related health care payment and remittance ad
24 vice;

This text seems to giving the federal government access to MY BANK account to extract funds whenever it wants.  I don’t want the federal government, or anybody else, to have unfettered access to my bank account.

How is this not a violation of my rights under the IV amendment of the Constitution?

The IV Amendment reads:

“The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”

How is federal, unauthorized, access to my bank account not a violation of my right to be secure in my papers and effects?

Next refer to page 167, Subtitle A-Shared Responsibility, Subpart A which references Section 59B of the Internal Revenue Service Code.  This section reads:

TAX IMPOSED.—In the case of any individual
who does not meet the requirements of subsection (d) at
any time during the taxable year, there is hereby imposed
a tax equal to 2.5 percent of the excess of—
the taxpayer’s modified adjusted gross income for the taxable year, over
the amount of gross income specified in section 6012(a)with respect to the taxpayer.

This section seems to be taxing subjecting me or any other American that chooses not to buy health insurance, or health insurance coverage not to the government’s liking, to a 2.5% of AGI fine.  Why should I be fined for not buying something I don’t want?

Finally, page 838, section 1904, seems to be allowing the state to invade my home and privacy.  Section 1904 reads in part:

GRANTS TO STATES FOR QUALITY HOME VISITATION PROGRAMS FOR FAMILIES WITH YOUNG
CHILDREN AND FAMILIES EXPECTING CHILDREN.
Part B of title IV of the Social Security Act (42 U.S.C. 621–629i) is amended by adding at the end the
following:
‘‘Subpart 3—Support for Quality Home Visitation Programs
‘‘SEC. 440. HOME VISITATION PROGRAMS FOR FAMILIES
WITH YOUNG CHILDREN AND FAMILIES EX12
PECTING CHILDREN.
‘‘(a) PURPOSE.—The purpose of this section is to im14
prove the well-being, health, and development of children
by enabling the establishment and expansion of high quality
programs providing voluntary home visitation for families
with young children and families expecting children.
‘‘(b) GRANT APPLICATION.—A State that desires to
receive a grant under this section shall submit to the
Secretary for approval, at such time and in such manner as
the Secretary may require, an application for the grant
that includes the following:
‘‘(1) DESCRIPTION OF HOME VISITATION PROGRAMS.
—A description of the high quality programs
of home visitation for families with young children
and families expecting children that will be supported
by a grant made to the State under this section,
the outcomes the programs are intended to
achieve, and the evidence supporting the effectiveness
of the programs.

I read this section as any state that accepts funding is given the right to “Visit” my home, against my wishes, to council me and my family on how to raise and educate my family.

Again, this appears to be another infringement of my rights under the IV amendment, “to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures”.

The president and congress keep telling us that what we read in the bill is not true.  If this is the case, please provide answers to my questions and a better explanation of the sections of the bill outlined above.

Most people, including the fifth columnists in Washington D.C., know that Global Warming is bunk.  It is not even junk science.  It is a pack lies designed to tear down the United States and remake it into a police state; void of any individual liberty or economic prosperity.

Why do some people think the planet is warming because of air conditioners and bar-b-q grills, without a shred of credible evidence?  David Deming author of Death of a Civilization, provides some insight in his post Global Warming Is a Fraud, posted at Lew Rockwell dot com.

One reason is that the temperature data from weather stations appear to be hopelessly contaminated by urban heat effects. A survey of the 1221 temperature stations in the US by meteorologist Anthony Watts and his colleagues is now more than 80 percent complete. The magnitude of putative global warming over the last 150 years is about 0.7 °C. But only 9 percent of meteorological stations in the US are likely to have temperature errors lower than 1 °C. More than two-thirds of temperature sensors used to estimate global warming are located near artificial heating sources such as air conditioning vents, asphalt paving, or buildings. These sources are likely to introduce artifacts greater than 2 °C into the temperature record.

To validate their idiotic claims, eco-Nazi’s cook their data in a manner some Wall Street financial firms would be envious of.

Another cause of global warming hysteria is the infiltration of science by ideological zealots who place politics above truth. Earlier this month, the Obama administration issued a report that concluded global warming would have a number of deleterious effects on the US. In 1995, one of the lead authors of this report told me that we had to alter the historical temperature record by “getting rid” of the Medieval Warm Period.

Deming goes on to provide an anecdotal history lesson of climate change hysteria that dates back to the early 1900’s.

If we had an appreciation for history, we would not be fooled so easily. It has all happened before, albeit on a smaller scale in an age where people had more common sense. On May 19, 1912, the Washington Post posed these questions: “Is the climate of the world changing? Not only is David Letterman not funny, he is also a liar.  In response to advertisers pulling their advertising from his show, Letterman issued an apology for a joke he made last week about the statutory rape of Sarah Palin’s 14 year old daughter, Willow.

From the Live Feed dot com:

“All right, here – I’ve been thinking about this situation with Governor Palin and her family now for about a week – it was a week ago tonight, and maybe you know about it, maybe you don’t know about it.  But there was a joke that I told, and I thought I was telling it about the older daughter being at Yankee Stadium. And it was kind of a coarse joke. There’s no getting around it, but I never thought it was anybody other than the older daughter, and before the show, I checked to make sure in fact that she is of legal age, 18.“

Above Letterman tried to justify his attack by saying that he thought she was at the game with her 18 year old daughter Bristol.  He goes on to say:

I had, honestly, no idea that the 14-year-old girl, I had no idea that anybody was at the ball game except the governor and I was told at the time she was there with Rudy Giuliani …

First Letterman thought the governor was at the game with her 18 year old daughter.  Then he says he thought she was at the game with just Rudy Giuliani.  If Letterman really believed the latter statement, on whom did he check to make sure was of legal age, Giulliani?

Letterman’s apology is as pathetic as his show.  The only reason he is making any type of statement is because his show is being threatened with the loss of advertising revenue.

the Bible, American capitalism, and Jews.  James von Brunn, the man who shot and killed a guard at the Holocaust Memorial Museum in Washington, D.C., also advocates Hitler style socialism and uses his deep faith in Darwinism to justify his hatred of Jews.

WorldNetDaily has a compilation of many of von Brunn’s posts on anti-religion websites.  Among posts that were scrubbed from anti-religion sites, von Brunn refers to Judaism as “the Holocaust Religion” and calls Christianity and Judaism “Hoaxes”.

The article references comments by Kathy Shaidle, a writer at the Examiner dot com, which include:

“The anti-Semitism of von Brunn is the first thing one notices when visiting these bizarre websites. However, like those of most ‘white supremacists,’ many of von Brunn’s political views track ‘Left’ rather than ‘Right.’ Clearly, a re-evaluation of these obsolete definitions is long overdue,” she wrote.

Von Brunn, for example, hated both President George H.W. Bush as well as George W. Bush, and the writer confirmed his posting “reveals a hatred of, say, big corporations that is virtually indistinguishable from that of anti-globalization activists.”

Shaidle finds the timing interesting between von Brunn’s murderous rage and antisemitic comments made by, pastor, friend, confidant, and mentor to Barack Hussein Obama, Reverend Jeremiah Wright.

That this shooting occurred shortly after President Obama’s former mentor, Rev. Jeremiah Wright, blamed ‘the Jews’ for his lack of access to his former parishioner is a troubling confluence of events as well,”

A critical look at von Brunn’s beliefs put him in lock step with the American left and little or nothing in common with conservatives or Libertarians.

The lunatic left’s obsession with Sarah Palin seems to be never ending.  MSNBC anchorette, Contessa Brewer, interviewed California, talk show host, John Ziegler regarding an interview he did with Palin and her reaction, or lack of a reaction, regarding disparaging comments Letterman man towards Palin and her teenage daughter.

Brewer considers herself a common sense thinker and asks why Palin would get upset about Letterman’s comments.  Letterman referred to Palin as sleazy and said her daughter got knocked up by Yankee’s third baseman Alex Rodriguez during a Yankee game.

If you watch Ziegler’s interview with Palin, she said that Letterman was pathetic but didn’t seem to be affected by his comments.  You can watch the interview here.  If you don’t want to listen to the entire interview, the Letterman discussion begins around the 5:20 mark.

Contrast Palin’s reaction with that of Brewer’s during her interview with Ziegler.

Why would Brewer be insulted by Ziegler essentially calling her and her station a blatantly biased, mouthpiece for the left and the Obama Administration?

While Washington D.C. pushes business stifling, global warming legislation, cold temperatures blanket the globe.  Recent frosts on the prairies of middle and western Canada threaten the Canadian canola crop.

Two overnight frosts last week have already resulted in some Saskatchewan farmers reseeding their canola, a Canadian variant of rapeseed, said Jim Bessel, senior agronomy specialist in the province for the industry group Canola Council.

Using liberal, eco-Marxist, logic if energy production and consumption increase global temperatures, which it doesn’t, shouldn’t America concentrate on producing and using more energy, thereby increasing carbon emissions and reversing the global cooling that is actually happening according to natural cycles?

In Manitoba, the frost is the worst in memory for its frequency and area covered, said Derwyn Hammond, the province’s senior agronomy specialist for the Canola Council.

Global warming is nothing but a dangerous fiction that is being used by American and European globalists that seek to punish the productive and control the masses.

The science is conclusive and not debatable, there is nothing humans can do to influence the weather.  Increases in carbon levels are a result of natural cycles of the Earth that won’t be increased by driving a Hummer or decreased by changing your light bulbs.

Unfortunately, the fifth column has a strangle hold on the nation, and we Americans handed it over to them.

reads signs posted above several Burger King restaurants in Tennessee.

The franchisee, Mirabile Investment Corporation (MIC), has been contacted by Burger King’s corporate offices, but is refusing to take the signs down.

J.J. McNelis, MIC’s marketing president. had this to say to an eco-lunatic / “reporter”:

Reporter: BK Corp issued a statement saying that ‘global warming is baloney’ wasn’t their view and that they had asked you to take them down. Is that your understanding of it?

McNelis: I can’t speak for them. I would think they would run from any form of controversy kinda like cockroaches when the lights get turned on. I’m not aware of any direction that they gave the franchisee and I don’t think they have the authority to do it. The franchisee can put on a sign whatever he wants.

Reporter: They’re saying that within the terms of the franchisee contract it says something along the lines that signs outside a restaurant can’t be used to express any political or religious views.

McNelis: Well, it maybe a religious belief for some folks, but it’s certainly not for the franchisee here and I don’t think that it’s necessarily political either. But I have to tell you that I don’t read the franchise agreement with regularity or else I would have a bad case of insomnia.

Reporter: BK Corp are saying that they’ve demanded that these signs get taken down and that they have now been taken down…

McNelis: Burger King can tell me to use my left hand when I scratch my nose instead of my right but that doesn’t mean I’m going to use my right. They can say whatever they want. The management team can put the message up there if they want to. It is private property and over here in the US we do have some rights, not withstanding a franchise agreement that I could load a Brinks vehicle with I’ve got so many of them. By the time the BK lawyers work out how to make that stick we’d be in the year 2020. I don’t think the franchisees are particularly concerned about that. BK can bluster all they want about what they can tell the franchisee to do but we have free speech rights in this country so I don’t think there’s any concerns. Don’t come away from this conversation with the impression that the franchisee did anything because the BK Corporation told him he had to. They’re only printed words on paper. The contract is only as strong as the ability to enforce it. Some things can be enforced, other things can’t. I know BK would like to have you believe they have the authority and the willingness to make us do all kinds of different things, but that’s not how the world works.

We have some free speech rights in this country Mr. McNeils, for now.  However, the fifth column is firmly in charge.  Don’t be surprised if that “changes” soon.
