Sen. Nelson (D-NE) Rejects Abortion “Compromise” — Not at Yes is the New No

The left-right-center squeeze is on. (See this post for the latest parade of liberal attacks on the bill.)

Now, Senator Ben Nelson has rejected the abortion “compromise” language. It’s not just abortion either, Senator Nelson also cited other concerns he had with the legislation.

So, if you are counting Senators who are not YES votes, that count would be:

1. Senator Ben Nelson (D-NE)
2. Senator Burris (D-IL)
3. Senator Sanders (I-VT)
4. Senator Feingold (D-WI) — from The Hill: The Wisconsin senator said he has not yet made a decision on whether to support the legislation. “I am not making a judgment until I see the CBO numbers and that’s only the beginning.”
5. Senator Webb (D-VA) — “Webb wrote in an op-ed published in the Winchester Star on Wednesday that “I have yet to decide whether I will support final passage of the bill.”

Who knows where Senator McCaskill (D-MO) is, she says she will decide based on the CBO score. Gee, I wonder how that will turn out? Senators Landrieu (D-LA) and Lincoln (D-AR) are both at Yes — according to A1 Senate sources. The same sources say Senators Snowe and Collins are at No, a firm No.

However, the bottom line is this, Senator Reid does not have 60 votes. He cannot, therefore, have a vote on his hidden-not-yet-released-vapor-bill.

Senators Not-at-Yes matters because what the Senate ObamaCare bill has been doing for weeks is spinning-in-place.

And support has eroded, not strengthened as Senator Reid keeps trying new formulations to get to 60 votes. He never has had 60 votes for the bill (only 60 to proceed to consideration of it) and he may never get to 60 votes. I do not think he will ever have 60 votes.

So if you are Senator Reid, why have a vote just to lose it?

Especially when other No votes will start to show up on the floor once it is clear that 60 votes will not be achieved, since Senators know that Senator Reid and the President will not need their vote. These Senators would rather not get the earache (as in you are yelling in my ear) in their home state, so they would just vote No. It is the smart vote, since those voters who feel most passionately — on the left and the right — are at No, and so is the general public.

In short, not at Yes is the new No.

Here is how the Associated Press is reporting the not at Yes statement by Senator Ben Nelson: Associated Press:

“As it is, without modifications, the language concerning abortion is not sufficient,” Nebraska Sen. Ben Nelson, a key holdout on the health care bill, said in a statement after first making his concerns known to Majority Leader Harry Reid, D-Nev.

“Nelson said there were positive improvements dealing with teen pregnancy and adoption, and that he was open to further negotiations. But in a radio interview earlier in the day with KLIN in Lincoln, Nebraska, Nelson also said that abortion wasn’t his only concern and he didn’t see how the Christmas deadline was achievable.

      They could have called for reading the bill from the jump, but other than that, they never had the filibuster to not have the bill brought to the floor. At least with Sander’s amendment, they called for the reading, and it got pulled. I think any action before this would have galvanized the Dems because it would have been more about screwing Repubs and putting them in their place instead of having the Dem civil war we are seeing now.

        that the Republicans will get 80+ in the House and will also retake the Senate. He said his reading of the trends data is (and I’m paraphrasing) that a sea-change is taking place among the voting Americans — the unemployment, the deficit spending, the bail outs, the incompetence, Cap&Tax, etc., have finally caused vast numbers of Americans to realize that Obummer and his Debtocrat cabal are dangerous incompetents and must be tossed out of office.

        It was music to my ears.

        But I won’t hang my hopes on Dick Morris’s predictions — I’ll just keep urging all conservatives I can to come into the Party as precinct committeemen so we can ensure as many conservative candidates as possible win the all-important primary elections.

        I want the Republican Party at the grass roots level to be at 100 per cent strength rather than the half-strength it was at on Election Day in 2008.

      What I read about his tactics (think over at NRO) that one of the procedures to slow down the bill is that he can have 30 hours to read the bill. Perhaps he is waiting until Christmas eve to request a 30 hour period to read the bill without interruption and pull back?

        And when they do get the majority back, that should be one of their first steps…push for true health care reform based on free market economics.

    Question: if Reid gets his 60 votes, probably 9 Democratic Senators will vote against it to pass it 51-49. Will those 9 be protected by voting against it even though they voted for cloture? The could make the argument that a reform bill like this deserves an up or down vote. “I was not voting for it when I voted for cloture, I just wanted it to come to a vote and then I voted against it.”

    Mara Liasson was making that argument today on Fox News. She said it would be comparable to the argument made by Republicans over judicial appointments (“everyone should be allowed an up or down vote, no filibustering”). I don’t think voters will look at it that way, what do you think?ll

      I do support Tea Party folks challenging GOP incumbents in the primaries…but when push comes to shove, we need to vote for the most conservative WINNABLE candidate…and that person is going to be in the GOP.

      Anything else is a de facto half vote for the Democrats.

      One of the things I like about RS is that unlike many other conservative sites, it categorically rejects any notion of a third-party movement and shuts down any attempt to boost one. These guys are all about the practical advancement of conservatism, not ideological spitting into the wind.

          to do so, but there is a way to do it. People are calling troll on you because you sound like you are ranting and saying things real trolls come here and do. Act like they are crazy for our side, but really want to see if they can elicit same response. What you are saying makes you suspect. Especially, the third party quest, that is a no, no here. We will work from inside the GOP, to turn out those that we need to, but that is only way to succeed.

    Do you think Reid will even schedule the cloture vote this weekend, then? If he doesn’t have 60, then filing for cloture will just be an official stamp of defeat on an already failed process. Would he let the vote happen if he knew it was going to fail?

    I don’t think he would myself. If he did file cloture knowing he didn’t have 60, you’d have to assume then that he just wants this to be over and done.

      I’m still thinking though that if he tries for a vote on Christmas Eve, he’ll hit a brick wall in the way of Sens. DeMint and Coburn…who I think will require a full reading of the bill.

      Which is roundabout way of saying Reid will *not* file for cloture this weekend.

      As Dan said, he doesn’t have 60 votes – Nelson is basically a firm No, and I don’t think they can really count on Lieberman until he sees a “final” deal with all the i’s dotted and the t’s crossed. And if they don’t have 60, they won’t have 45 on the cloture vote.

      So I don’t see how this doesn’t go past New Years.

      My guess is they may use the “excuse” of the “problems” with the military funding bill to push the schedule back.

      The real question is – will they even bother to take it back up again after New Year’s?! I have my doubts, but we’ll see…

        If the GOP make a firm commitment and promise to have a GO SLOW and READ THE BILL approach, then Sen Reid CANT make it to a Christmas vote … HE CANT.

        The time is already up.

        Another thing – if Ried DID have the votes, why can’t he wait for Jan 5th to have the vote? 2 1/2 short weeks? … THE RUSH TO PASSAGE SINCE SUMMER WAS ABOUT GETTING IT DONE BEFORE THE THING WENT OUT OF CONTROL… WELL GUESS WHAT? IT’S ALREADY GOTTEN OUT OF THE CONTROL.

        The Democrats are now in a deathmarch mode, with a very unpopular bill and the inability to craft a bill that will satisfy enough people on all sides.

        They do not have 60 votes for public option and never will get it. They do not have 60 votes for a ‘non-public opion mandates’ bill and never will get it.

        It’s possible that Reid will forge ahead just to show how much he tried, so the left will accept the half-loaf measure.

      The downside is that if he loses only one vote, the loses lots of votes, because the stampede to get out of the way of the toxic ObamaCare will run Reid over.

    The Christmas Eve vote makes no sense. Even US Senators can’t be clueless enough to think they can pass this piece of legislation in the middle of the night and nobody will notice.

      Christmas vote because the tea-partiers would be celebrating Christmas and not going to town hall meetings or calling.

      Really. Even back then, they had a whiff of desperation.

      Now, they are fully desperate.

    Other than the “read the Bill” strategy finally implemented late, What have the GOP Senators really done to stop this abortion of America’s soul?

    If all the GOP Senators just packed up and left Friday for the Christmas break, would the socialist democrats stay to vote the 60 number they already have?

    Reading aloud every bill prior to a vote is a good thing, get’s America to November 2010.

    I understand Nelson, but where are you getting the information that the others plan to vote no?

    I believe Nelson has some legitimate issues with the bill, although he has equivocated for a while now over various elements. The others have problems too, but I believe they will vote for the bill. They just need to see it. Reid hasn’t gotten the scoring from the CBO yet.

    I, for one, would call all damn day long if I thought it would help…and even drive to DC. It’s too important not to bombard them when they think we won’t. We can all forgo thirty seconds to phone….

      60 seconds of unbridled fury if they do this. Nothing says “Christmas” like telling the Senate that they have hearts two sizes too small and souls that are shriveled like raisins.

      And jobs that are looking increasingly less stable…..
