very detailed - very well explained. my gut tells me - the conventional wisdom - 5-4 to take out the mandate (could Kennedy reallly live with himself making such a monstrous historic policy change - opening the door for "broccoli" legislation?) but leave most of the rest of the bill standing.

Sotomayor seemed to be fishing for a compromise in her questions during oral arguments. Wonder if there is a trade - 6-3 for the mandate, but Soto gets a say in what over provisions, if any, are struck. That would smack to me of a typical Beltway solution - disrespectful of the Constitution and the Rule of Law, but the kind of Rodney King (cant we all get along?) solution that creatures of DC break arms patting themselves on the back for.

I pray that Roberts doesn't get tempted by the Beltway siren songs to go 6-3 to uphold the mandate, bringing Kennedy along. Everything about him tells me he is principled. Tomorrow we find out a lot.
