The Supreme Court and Three Cases They Decided Not To Take On
By: davenj1 (Diary) | March 21st at 08:23 AM |
On Monday March 19, the Supreme Court denied three cases of interest- two involving religion in the abstract and another involving reapportionment and the census. The latter is a case being pursued by the state of Louisiana which seeks to invalidate the 2010 Census results. They claim that is inherently unfair and unconstitutional to count illegal immigrants as part of the population for reapportionment purposes. | Read More »
Obamacare and the Supreme Court: The Mandate Question
By: davenj1 (Diary) | March 18th at 11:37 AM |
In past articles, I have mentioned that the Supreme Court can conceivably delay a decision on the constitutionality of Obamacare if they determine that the penalties through the tax code essentially are a tax and, therefore, the Anti-Injunction Act would put off the issue until 2015. To do so, the Obama Administration would have to prove that the penalty is a tax, something they argued | Read More »
Just a Few Things to Think About…
By: davenj1 (Diary) | March 18th at 08:12 AM |
1. Why do liberals refer to “social justice” or “economic justice?” Shouldn’t it simply be “justice?” 2. If global warming is shrinking the polar bear population due to loss of habitat, why has their population increased from 5,000 to 25,000 over the last 50 years? 3. Why is Obama our “first black President” if his mother was white? Wouldn’t he be our first “half black | Read More »
Governor Christie, Obama & Education
By: davenj1 (Diary) | March 17th at 11:13 AM |
A lot has been written lately about the Federal government granting states waivers from the ill-designed mandates of NCLB. On many conservative websites, the main argument has been the abrogation of state authority over educational standards to federal standards in return for federal education dollars. I have written extensively in the past that for the better part of the history of this country, public education- | Read More »
Obama and Bush and Terrorists
By: davenj1 (Diary) | March 14th at 04:48 PM |
I believe it was either on Real Clear Politics or Politico where I recently read an article about five Obama policies that have drawn the ire of Liberals and Conservatives alike, but for different reasons. I cannot really get into the head of a Liberal (can anyone?) and the gist of this entry is to underscore the huge discrepancy in treatment by the media when | Read More »
Upcoming Obamacare Cases: Part 2- A Side Issue
By: davenj1 (Diary) | March 12th at 01:18 AM |
Perhaps the most surprising aspect of this series of cases before the Supreme Court is their willingness to rule on the power of Congress to expand the right of “poor people” to health care benefits under Medicaid. The aim of theory at stake is to put limits on the power of Congress to spend money on public programs. It has only twice taken on the | Read More »
The Tenth Amendmenters
By: davenj1 (Diary) | March 11th at 06:49 PM |
There is much talk here on these pages and on other conservative sites that the Tenth Amendment is some broad grant of state’s rights. Many argue that because of the 10th Amendment, the federal government cannot wade into areas that traditionally have been the province of state governments. However, to assert that argument is to read way too much into the Amendment as stated. In | Read More »
Upcoming Obamacare Cases: Part 1- Its Not a Tax, Yes Its a Tax
By: davenj1 (Diary) | March 10th at 09:35 AM |
To do justice to this subject, this must be presented in several parts because there are several issues the Supreme Court must decide. I should say up front that I am adamantly opposed to Obamacare. I believe that there are better ways to address health care reform than that which was chosen. Additionally, the method used- budget reconciliation- to pass a law that reordered 16% | Read More »
A Coherent Energy Policy: Nuclear Energy, part 2
By: davenj1 (Diary) | March 9th at 03:26 PM |
Unfortunately, the other half of the equation regarding nuclear energy needs to be addressed- that of safety and waste. This is the direct result of unsubstantiated fear-mongering by the anti-nuclear groups, usually with some dumb Hollywood actor as the spokesman. They usually trot out Three Mile Island. However, every single direct study of residents near TMI (one conducted over a 13-year period) showed no bad | Read More »
A Coherent Energy Policy: Nuclear Energy, part 1
By: davenj1 (Diary) | March 9th at 07:33 AM |
One of the most cost effective (once actually built) sources of energy production and one that releases 1% of the greenhouse gases as a coal plant (if that is your concern) is nuclear energy. Its unfortunate that those who wail about global warming will likewise wail against nuclear energy. This illustrates the hypocrisy and stupidity of their beliefs. Today, we get 20% of our energy | Read More »
