By: davenj1 (Diary) | March 3rd at 09:06 AM |
This is the first of a three part series dedicated to some potential future Supreme Court cases. Each issue is near and dear to conservatives and liberals alike- campaign finance reform, gay marriage, and affirmative action. First up, there is a case making its way to the Court out of Montana challenging a state law that bans direct corporate expenditures on elections. Citing the fact | Read More »
Roberts vs. Obama and Holder: Round 3- Arizona
By: davenj1 (Diary) | December 28th at 09:22 AM |
As expected, the Supreme Court has decided to weigh in on Arizona’s illegal immigration law- SB 1070. As most are aware, the law was signed into effect by Governor Jan Brewer and was immediately challenged in federal court by Holder’s Justice Department. The District Court then issued an injunction against certain sections of the law and the very liberal Ninth Circuit Court of Appeals has | Read More »
Roberts vs. Obama and Holder: Round 2- Obamacare
By: davenj1 (Diary) | December 22nd at 02:46 PM |
The single act that broke the camel’s back and galvanized the Tea Party into electoral action was the passage of the Affordable Care Act, more commonly known as Obamacare. Some in the Democratic Party have objected to the term “Obamacare” as being derogatory. However, if you want to lay claim to it as your signature piece of legislation, it is quite hypocritical for your Party | Read More »

Health Care and the Supreme Court: A Prediction
By: davenj1 (Diary) | November 23rd at 01:53 AM |
As a long time observer of the United States Supreme Court, I am going to go out on an early limb here and make a prediction. First, it needs to be mentioned that there are so many controversies and subplots involved here. For example, there is the controversy over whether Elena Kagan should recuse herself from this case. Quite frankly, it is hard to believe | Read More »

Recently, a piece of human scum was executed in Texas- Humberto Leal. To restate his crime, he was convicted of murdering and raping a 16-year old in 1994. Not only did he rape her with a stick, which he left in her bloodied nude body, but she was bludgeoned with a 35 pound piece of asphalt. The US Supreme Court, in an unsigned opinion, decided | Read More »
Beating Up on John Roberts….Again
By: davenj1 (Diary) | July 12th at 09:23 AM |
Erwin Chemerinsky, a California law professor, recently wrote an editorial that has been making the rounds in certain newspapers. In it, he asserts the Supreme Court under John Roberts is limiting access to the courts. This follows on the usual accusations of the Court being (1) pro-business, (2) pro-prosecutor, (3) indiscriminately sending people to the death chamber, and (4) eviscerating the exclusionary rule, among other | Read More »

This past Thursday, the United States Supreme Court upheld an Arizona law which allows the state to revoke the business licenses of repeat offenders who hire undocumented workers. The case in question was Chamber of Commerce vs. Whiting. Chief Justice John Roberts wrote the majority opinion in a case decided 5-3 with Elena Kagan having recused herself. This case has been widely watched in order | Read More »
Mohammed, the Flag and Orientals

There was a recent article in American Thinker regarding Supreme Court Justice Stephen Breyer and some comments he made regarding the burning of the Koran and the fact that a case that doing so may be in violation of exceptions to free speech tenets in our Constitution. The article focused on concepts of international law creeping into our Supreme Court jurisprudence. Although many may find | Read More »
Happy Birthday S.B. 1070- a Few Days Late
By: davenj1 (Diary) | April 27th at 12:11 AM |
With the anniversary of Arizona’s S.B. 1070 signing into law a few days ago, it is interesting to note that there is currently a case before the Supreme Court which may give future guidance and hints to the lower courts in ultimately deciding the constitutionality of S.B. 1070. Up front, let me state that on grounds of legal principle, I personally find nothing wrong | Read More »
