Score one for the good guys:
The Florida Supreme Court this morning unanimously rejected a lawsuit by state Sen. Thad Altman, R-Viera, who sought to make Gov. Rick Scott accept $2.4 billion in federal stimulus money for a high-speed rail route through Central Florida. [...]
"The Governor is gratified that the court provided a clear and unanimous decision, he is now focused on moving forward with infrastructure projects that create long-term jobs and turn Florida’s economy around," press secretary Brian Burgess said in an e-mail today. [...]
Florida is at least the third state with a new Republican governor turning down the rail money. Ohio Gov. John Kasich and Wisconsin Gov. Scott Walker earlier said no to Washington.
The Supreme Court said Sens. Thad Altman, R-Rockledge, and co-plaintiff Sen. Arthenia Joyner, D-Tampa, did not make their case. They had alleged that the 2010 Legislature and Gov. Charlie Crist had started the project with an appropriation of $130.8 million in federal money, and that following through by spending the subsequent $2.4 billion federal allocation was just a "ministerial" duty for Scott.
The governor's lawyers argued that he was not retroactively vetoing legislation passed before he became governor. If the courts could order Scott to spend the rail money, they contended, then judges could just as logically order the Legislature to pass or defeat certain bills, or tell the governor which laws to sign or veto.
