Who doesn’t know the words of the 2nd amendment. I take these words literally. But there are some who don’t. Witness now SCOTUS Justice Sonia Sotomayor. She stated during her Supreme Court nominee hearings before the Senate that she understood how important the 2nd amendment is to the American public. She has friends who are members of the NRA. And friends who hunt. How nice for her. I’m glad to hear it. However, Sotomayor did just the opposite after she was confirmed. According to the NRA last year Sonia Sotomayor deliberately misled the American people by claiming she believed it was “settled law” that the Second Amendment protected an individual’s right to keep and bear arms. This year, she proved she never really believed that by ruling against the Second Amendment in McDonald v. City of Chicago.
Nothing in the 2nd Amendment text…seeks to protect the keeping and bearing of arms for private self-defense purposes.
She said one thing, she did the opposite. Now Elena Kagan, another Supreme Court nominee from Mr. Obama is making promises. Senator Leahy asks her:
Is their any doubt in the decision of Heller v. McDonald secures a fundamental right for an individual to own a firearm for self defense in their home?
Their is no doubt, Senator Leahy, there is binding precedent and entitles all the respect of binding precedent in any case. So that is settled law.
