Yes, The Dangerous Left Wants The U.S. To Fight Wars In The Courts

Ever since 9/11, but especially since the U.S. invasion of Iraq in 2003, American leftists have been filing lawsuit after lawsuit challenging the war against terrorists, the war against Saddam Hussein, you name it. From the terrorist surveillance program, to extraordinary rendition, to the holding of terrorists in Gitmo, to trying terrorists in military tribunals, to suing the CIA on behalf of terrorists who claimed they were “tortured”, and so on and so on, based on this provision of the Constitution, or that statute in the U.S. Code, or a violation of so-called international law. Many of these were thrown out, but some were won by the leftists; in the egregious Hamdan decision, the Supreme Court said terrorists, unlawful enemy combatants, are protected by the Geneva Conventions, something no person with such a status ever had in history.

With the rash of suits that have been filed over the years, the obvious question one could ask the leftists is, “What do you want to do, have the U.S. fight a war against its enemies in the courts?” Naturally, they never admit that this is what they want. But this is exactly what is happening; “U.S. Civil Liberties Group Questions ‘Legal Basis’ Of Using Drones To Kill” (the complaint is here; I’m not going to quote from it).

So in the immortal words of Rep. Joe Wilson (R-SC), my response to these leftists is, “You lie!!!”

From the Fox Chicago News link, here is what one of the charlatans at the ACLU says:

“The public has a right to know whether the targeted killings being carried out in its name are consistent with international law and with the country’s interests and values,” said Jonathan Manes, a legal fellow with the ACLU National Security Project.

“The Obama administration should disclose basic information about the program, including its legal basis and limits, and the civilian casualty toll thus far.”

If all was right in the U.S., the federal judge assigned to this case would put a shredder next to the gavel, put the complaint in it, dismiss the case outright, charge the plaintiffs and their lawyers with contempt for filing such a meaningless and frivolous lawsuit, and work on getting every lawyer involved in filing this suit disbarred. If one wanted to go to the extreme, these clowns could be charged with the one crime that is identified within the Constitution:

Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court.

The Congress shall have power to declare the Punishment of Treason, but no Attainder of Treason shall work Corruption of Blood, or Forfeiture except during the Life of the Person attainted.

But all is not right in the U.S., and a ridiculously stupid and dangerous court challenge will be allowed to be filed. And forget about any charges of treason against the ACLU; “civil liberties” charlatans would whine that the ACLU is just expressing a right to free speech, which, of course, is utterly false.

As far as the merit of what the ACLU is doing, there is no merit whatsoever. Here’s what they want (from the Fox Chicago News piece):

In particular, the lawsuit asks for information on when, where and against whom drone strikes can be authorized, the number and rate of civilian casualties and other basic information essential for assessing the wisdom and legality of using armed drones to conduct targeted killings.

Up to this point, the Obama administration, which I give credit to, has ignored these FOIA requests, and should continue to do so all the way up to the Supreme Court if necessary. There is nothing with the Obama drone attacks that is inconsistent with either international law or the country’s interest and values. All the ACLU is doing is seeking to apply it’s own political opinion of how a war should be fought and make a ludicrous legal argument to get these drone attacks stopped. I would argue that what they are doing is putting Americans in danger, but the liars at the ACLU dismissed any such argument on a variety of issues years ago and don’t bother addressing it.

About the only thing that will stop the ACLU is some judge who will laugh these jerks out of court, or for someone with standing to sue them for putting the lives of the American people in constant and unnecessary danger.
