I cannot believe that President Obama of all people would be so tone deaf as to allow the official response posted by Stephanie Cutter. The quote below comes from an official White House blog post:
Today, a judge in Florida issued a decision in a case filed by 25 Republican Attorneys General and Governors striking down the Affordable Care Act. This ruling is well out of the mainstream of judicial opinion. Twelve federal judges have already dismissed challenges to the constitutionality of the health reform law, and two judges – in the Eastern District of Michigan and Western District of Virginia – have upheld the law. In one other case, a federal judge in the Eastern District of Virginia issued a very narrow ruling on the constitutionality of the health reform law’s “individual responsibility” provision and upheld the rest of the law.
Today’s ruling – issued by Judge Vinson in the Northern District of Florida – is a plain case of judicial overreaching. The judge’s decision contradicts decades of Supreme Court precedent that support the considered judgment of the democratically elected branches of government that the Act’s “individual responsibility” provision is necessary to prevent billions of dollars of cost-shifting every year by individuals without insurance who cannot pay for the health care they obtain.

In 1858 When President Buchanan was president the democrats had the dominant influence over politics. Buchanan was a Democrat. Dred Scott was consistent with judicial thinking at the time. It was wrong, but the consistent. Using the force of the courts to impose on people an obligation they must discharge may be well within the "mainstream of judicial opinion", but wrong none the less.
The Democrats have a history of this kind of abusive behavior, so it doesn't surprise me. Dred Scott was mainstream judicial opinion until a half million dead Americans brought about a correction. But the Democrats never quit. Within a few decades the southern Democrats began restoring their power pushing through laws that became known as "Jim Crow". The Jim Crow laws in essence gave the politicians and their cronies the power to coerce any member of society into obedience and service to their desire. Segregation was one obvious example.
ObamaCare, hustled through the legislature by the Democrats is a blatant expression of power by Democrat Political elites over the will of the majority of people. And like Jim Crow, ObamaCare threatens to create a bureaucracy with unlimited potential for abuse and corruption by unelected government officials, The only defense against them is the good will and support of a Democrat politician. Everyone KNOWS what the Democrat politicians, the unelected bureaucrats and Democrat Cronies of the Jim Crow era demanded for that good will and support.
Dred Scott, Jim Crow, and now ObamaCare. It doesn't strike me the Democrat elites have changed much from the days of James Buchanan. Only the game has evolved.
The first President of the United States that, to use President Obama's own words, "doesn't look like those other guys", has become a caricature of Governor Wallace. What a terrible disappointment.
