Why are we allowing our gov’t “servents” to exempt themselves?

Dear Moderator:  I haven’t posted in a long time, so please instruct me as to the appropriate place to post this discussion.  I ran a search for “exemption” and couldn’t find a thread where this would fit.

One of the greatest fears of our Founding Fathers of forming a “national government” was placing too much power in the hands of a “ruling elite” that could ignore the will of the people and/or pass laws that applied to everyone else, but “exempted themselves”.  In short, placing themselves “Above the Law”.  The U. S. Constitution and the Declaration of Independence are two of many documents which are based in this most important aspect of our Republic:  “… that those that write the laws MUST be subjected to those same laws.”

Congress has “exempted”, not only themselves {regardless of party}, but anyone who works for the federal government, from this “Health Care Reform”.  Add the union exemptions, and we are talking about nearly 60% of the population that is at least in part, not bound by this law.  How many votes do you think this abomination would have gotten if it applied to THEM??  ZERO!  This is nothing new.  The ruling elite has been placing itself “Above the Law” for decades.  It has become so common for these elitists to add the “self-exemption clause” to every bill they pass, that it is scarcely even mentioned anymore.  Even now, with dozens of State Attorneys General commencing lawsuits against this bill, NONE are suing on this clear violation of our Constitution.  Why?  Would some of you constitutional scholars out there please show me the “Government may exempt itself from any laws they write” amendment?  It sure as hell is not in the original document.

In my opinion, this is the single greatest threat to our liberty (or what’s left of it).  This alone would stop the Obama/Reid/Pelosi Socialist/Marxist/Facist takeover in its tracks.  Rescind ALL exemptions to ALL laws passed since 1791.  Make ALL laws binding on the people who write them.  Just maybe we can save this Republic.  I pray its not too late.

How do we do this?  On November 2nd, we will be voting for 435 Representatives and 33 Senators.  Each one of them will take an oath to uphold the U.S. Constitution, but only AFTER the vote.  How about we insist they take this oath BEFORE they get our vote?  And we add one additional oath, just to clarify.  Any candidate must vow to rescind all exemptions to any past, present or future laws, or alternatively rescind the law itself, which benefits any public servant over any private citizen.  Pick any bill introduced in the past 100 years, no matter how hair-brained or misguided, remove any exemptions for the public sector, and you tell me how that bill will miraculously become better.

To be Continued …

Couple your thoughts and the oath to include a requirement for Term Limits and I think you might have something.

I find Term Limits intuitively appealing, and clearly Jefferson, Madison, et al, never envisioned the “career politician” to be so common. Frankly though, if the elitists were unable to exempt themselves (or anyone else to buy votes) from the laws they write, it would remove one of the primary advantages of an incumbent. That is, to hand out favors (exemptions) for the sole purpose of buying votes for the next election. They obfuscate the issue by calling it many things (special interests, “bringing home the bacon”, earmarks, etc.) but its all the same thing and in clear violation of the U.S. Constitution. At least its clear to me. NO ONE is above the law, period. Case closed. No exceptions. In the words of Rush, “Zip, Zero, Nada!”
So take away this advantage, and Term Limits become much less needed.
Secondly, the Founders HAVE Term Limits built in. Only federal judges get lifetime appointments, and they can be impeached if needed. Everyone else has to face the voters each term. Take away incumbents’ unconstitutional advantages, and they would have to get re-elected based on their record instead of how many monuments they built for themselves in their home state with taxpayer funds.
We the People in Ohio are about to elect the Constitutionalist Reaganite Conservative John Kasich as our next Governor. For those of you who don’t know him … yet … he was part of Newt’s Revolution of 1994 and was one the handful of congressmen that actually kept their self-imposed term limit promise. We also have a good chance of replacing a RINO Senator with a Conservative.
Outside of Cleveland & Columbus, you might be surprised to see how red Ohio really is, but we are crippled by the fact that there are
so many college towns, plus EVERY media outlet (save a couple talk radio stations), that are in lock step with the Leftist LameSM.
King Barry’s theft of GM and Chrystler has left a huge hole in our industrial base and The Omnipotent One has graced us with several visitations to spew His venomous “hate-speech” for everything capitalist far too often for my taste. Couple this with a jihadist appointed by the current occupant of the state house, and Buckeye Land is ripe for a Conservative Rebellion this fall.
Ironically, Kasich is an example of the downside of Term Limits. We could have used a few more like him in Congress these last 12 years.

    DocJohn,
Are you a Republican Party precinct committeeman? Start there.

As for your “pre-oath” idea, I do this. I have one I give the Republican primary candidates who want my vote. No signee the form, no supportee.

The BEST place to organize like-minded conservatives for the kind of grass roots activity you are advocating is INSIDE THE REPUBLICAN PARTY ITSELF. As precinct committeemen. Go to my link below to find out more (and forgive me if you already are an active precinct committeeman — if you are, I urge you to write another Diary here about your experiences IN the Party).

    Thank you.

Would love to see the text of your “pre-oath”
As for the precinct thing, I actually looked into that in the Dark Ages of Clinton. The precinct captain at the time was a major competitor of the family business, and I was excluded out-of-hand. Quite frankly, I wanted no part of any organization in which that scumbag had a position of power. I don’t know who’s there now, but I’ll check it out.
My Congressman is John Boehner, who I’m quite pleased with and
is likely to win this fall quite handily. Boehner is a 1994 “classmate” of John Kasich, who I would love to help move into the governor’s mansion this fall. Boehner’s 1994 Contract pledge was to refuse “All earmarks”, and he’s kept his pledge for 16 years. Because of that, I would peg him as the one most likely to introduce my “dream-bill” of No Exemptions, Past, Present and Future. As Speaker, he could get this on the floor of the house in January 2011. I would LOVE to see these elitists defend their “Above the Law” status. Health Care Takeover – Dead. Cap and Tax – Dead. Hell, 90% of Tax Law is giving one citizen advantage over another. The far reaching effects of enforcing this one simple constitutional precept is astounding.
