The times test a man, and fortunate is the man who finds a battle that tests his limits. Still more fortunate is the man who is proven worthy by that battle. Such men were Nathan Hale, George Washington, John Paul Jones, and the men who stormed Normandy.
In a couple of short years, the Left has wrought on America, on freedom, such damage it is scarcely comprehensible, the culmination of 4 generations of chipping away at it. What they are planning and attempting in the next 6 months is an even further destruction of the most grand, noble, and free nation the world has ever seen.
This is a time for great men and women to be tested to their limits. It is a time that will forge this century’s George Washington, Patrick Henry, George Patton, William Still, and Clara Barton. Men and women with the bark on. It is an epic moment, at our nation’s greatest point of peril since 1861. Against this backdrop, you, John and Eric (and let’s throw Mitch in here too) have been placed in history.
And you have failed utterly to lead.
Over the last 18 months, sometimes the leadership of the House and Senate has done us proud, yet at some of the most crucial times, you have failed miserably and embarrassingly. When push came to shove, you’ve shown yourselves untrue and unfaithful to the plain, basic tenets of conservatism. And this, the back-of-the bus fisking of Congressman Joe Barton (my congressman, by the way), a man who stood up and told the truth for the world to hear, is the final insult.
You, for the sake of……I don’t even know what, really…… tossed Barton under the bus, threatened to remove him as ranking member of the Energy & Commerce committee, because he openly declared the Obama shakedown of BP to be……. a shakedown.
Now hear this, John Boehner and Eric Cantor. I am dead to you.

When it came time to stand up and fight, you did not. I blame the conservatives in their respective districts who are too damn lazy to get involved as precinct committeemen. Until sufficient numbers of conservatives in their districts actually get into the Party and change it at the grass roots level as precinct committeemen, these two have no reason to change.
As long as Boehner Cantor have no fear that the status quo is changing in their respective districts, they have no incentive to stiffen their spines and “act really conservative.”
I suspect there’s been no significant increase in the PC ranks in their respective districts since the 2008 election. With no significant increase in the number of conservatives, they know that they’ll never be challenged by a “more conservative” conservative in the primary. Besides, their primaries have already happened and I suspect there was no threat of a “more conservative” challenger to either of them. So, why call attention to themselves? Keith Overbite and Chrissie Matthews might call them a bad name!
Until the grass roots ranks of the Party become “more conservative;” that is, until conservatives flock into the Party, and fill up that HALF of the party precinct committeeman slots nationwide that are currently VACANT, you can expect the same jelly-spined “leadership” in the Party.

I blame all the conservatives in their districts who have not become active, voting members of the Party. If we conservatives don’t learn, and engage in, basic civics, NOW, I believe we will lose this country after Nov. 2. We need to make Get Out The Vote, as never before, for the best conservatives in the Republican primaries, and all Republicans in the general elections, our highest priorities now, and the BEST way to do that, in my humble opinion, is in conjunction with the Republican Party, boots on the ground, in our own local precincts. All the while “learning the ropes” of your local GOP committee (the bylaws, rules, getting to know the existing leaders/officers) so that you’re not a PC yet, you can figure out how to become one. (Voter turnout in the 2008 presidential election was about 65 per cent. It was around 22 per cent in the first special election in NY (the one for Gillibrand’s seat) for Republicans and I seem to recall reading that it was only 25 per cent in the recent Nevada primary. That’s just pathetic.)
Because HALF the PC slots are vacant nationwide, the Party is there for the taking. We have sufficient numbers of conservatives nationwide, we just don’t have enough of them actually involved in the real ball game of politics — party politics.

Yes, we Know — How to achieve a free market, pro-growth agenda by reducing every other federal entitlement program across the board ten per cent per year for ten years to transition to a more free market system, by eliminating the Departments of Education and Commerce on the same schedule, by ending all mass transit subsidies including Amtrak, and by the elimination of the following wasteful government programs: [list].
We need concrete examples and pledges to achieve them along the lines of the Contract With America.
Maybe call it the Yes We Will Pledge. Or the Republican Real Promises Pledge. Or the “We’re Not Lying To You” Pact.
Our conservative leaders need to do this YESTERDAY and we need to pressure them to ACT on this ASAP.

The fact that they had this accident does NOT give the government title to do anything it wants to this company. I have a right, as do you, and as does Barton, to call it a shakedown. Barton, as a United States Representative, has a right to apologize to BP during this show trial for the behavior of his peers and the behavior of the executive branch.
Before the shakedown, BP has passed out crap-piles of money all over the place, and pledged publicly and privately to meet every obligation. You should look up AL Govermnor Riley, and read everything he is saying.
Preview: he says BP has been passing out money to the local and state people in charge to pass out as needed for cleanup and for compensation. He additionally says that the only things actually getting done are under the auspices of BP, and NOT of Uncle Bambi.
Now I’m good and pissed. You want to continue this argument, then bring it. But you better start arguing with facts and not with feelings. That’s what Democrats do.

Now as to your final 4 paragraphs, I would say it was hit and miss. Absolutely, I agree the feds owe huge, big-time apologies to the states and to America in general for not only slow and ineffective response and leadership, but for what is mounting evidence for active obstruction
The last paragraph, i don’t really agree. First, the government will end up using that money for all kinds of clean-up related things that “coincidentally” will be union-related. And second, the feds will botch it up good (see Katrina) with astounding levels of graft and inefficiency. Third, with every other word out of their mouth, when there are any criticisms, they will find a way to blame BP. This includes in the offices where legitimate victims have to stand, hat in hand, filling out tons of paperwork, just to get what is due them.
The management of that $20b will be exceedingly badly handled, and BP will get much of the blame for it, because that’s what bureaucrats do, and that is especially what the Democrats do.
I am highly opposed to your absolute insistence, here and elsewhere on this page, on the theme of ‘we don’t know what was said behind closed doors’, therefore we can’t establish for certain that this was a shakedown.
The only place that standard would be suitable would be in the court at the actual RICO trial, where we have to produce properly gathered evidence under rules of prosecution. For example, the fact that the defendant stands accused of 50 more examples of this crime and other similar crimes is inadmissible.
Everywhere else, the 99% proof rule should do just fine. The Obama administration, including and especially the DOJ, has established such an overwhelming, irrefutable record of thuggery, politically selective prosecution, and frankly outright crime, that when you see the evidence we DO have regarding the BP $20b fund that will be administered NOT by BP but by an Obama insider, the reasonable person has to call it like he sees it.
For the record, AG Holder has specifically stated that he would be looking at prosecuting BP. According to Mark Levin, it is a federal crime for an officer of the court (prosecutors, who are executive branch members) to elicit political behavior from anybody who is under threat of prosecution. While Obama is not technically an officer of the court, one sees immediately why it would be illegal and that the same unfair inducements apply. In fact, if Obama were charged with that crime in this event, the prosecution would have a very strong case that the law applied more generally to the executive branch and perhaps especially to the top executive.
This is paraphrasing Mark Levin, who is not a talk show host but a highly regarded lawyer who has argued before the Supreme Court. I think he does the talk show so he can yell at people for free.
You may not have noticed that either Obama or other administration officials said after the deal, that it was not limited to the $20b. So I fail to see any benefit to BP of ‘getting the monkey off their back’. That sounds so much like an extortion racket you have to smack your palm on your forehead. They’ll keep coming back to BP for more, even as they are wasting it and splurging with it. And because BP is the scapegoat, for which no amount of effort or aplogy will ever make right, they’ll have nobody to argue their side.
It was a shakedown, JS. It was forced from them under threats. Surely by now you know the story about how the 9 banks were taken into a room and not allowed to leave if they didn’t accept money (and a shipload of new regulations that came with it). Surely you know about Obama telling the Wall Street people that “I’m the only one standing between you and the people with pitchforks. So, sign here.” Surely you know why Big Pharma was willing to sign onto BambiCare. Literally, I could write 5 pages of examples, and so could you.
This is what they do. Not some times. Every time. I don’t get why you demand proof that in this case water is wet, when it’s been true 5000 times already.. I am honestly frustrated by that.

Time may very well prove you right, but I try to limit myself for to the known facts and acknowledge that in many respects, we want the President to leverage the power of the country on behalf of the country. How this operationally plays out will be interesting. However, at least this way, the process will be 100% open to the public.
BP may (not necessarily a wise long/medium term decision) want to unload the administration of making the compensation payments.
There are three aspects to this disaster:
(1) plug the leak. Here BP is best suited to address the challenge. The government is basically of no help unless they use a nuclear blast to end the damage (something Obama will never do).
(2) clean the mess. Here BP still has a comparative advantage over the federal government.
(3) administerting payments to injured parties. As bad as the government is at this as well, the government probably has a competitive advantage over BP on this point—at least the individual in charge of this has implemented such systems in the past. In any case, BP has other things that only it can do well (see 1 and 2 above)
Given how beat up BP is getting in the press (as well as by our beloved “public servants”), I can see why they would cry uncle to get out of (3). The alternative to the $20B fund would be to be more vocal about the WH’s failures, and its clear that nobody at BP has any stomach for this.
Bottom line: It is not necessarily improper for the government to leverage government contracts, etc. to get acquiesence from BP. If there was an explicit tradeoff for dropping a criminal prosecution (which in my view could only be persued in bad faith by the government) and the fund, then BP should out the WH on this.
My suggestion for Barton would have been to ask good questions about the WH meeting, and not simply characterize the transaction as a shakedown. To be honest, the $20B fund is about the only illustration of executive leadership (presuming again that there is no quid pro quo)in this entire oil mess that the WH has shown.
Rush and Levin are both people I respect, but it doesn’t make them 100% right (just 99% right). I am not even saying that they are necessarily wrong on this, I just acknowledge that we know virtually nothing about the meeting and that the application of leverage is often just another way to describe leadership. For example, there are boats that could be used to help the cleanup that are not being used. We want the President of the United States to apply leverage to get things moving, and moving quickly.
Thank you for acknowledging that I am not somehow mindlessly jumping on the bash-BP bandwagon. Frankly, I wish the company would stick up for itself more–I am a shareholder and would like better leadership.
The better approach would have been to ask questions about the WH meeting and push for answers about the “leverage” used by the WH. This would have kept the team united, and frankly, the entire public generally wants to know these things. Barton made a tactical blunder in my view. If you are going to go that far on a limb, you shouldn’t retract. Screw the leadership if Barton really “feels” the thing was a shakedown either share the evidence, get the evidence, or just have the strength of his convictions. Backing down in response to the leadership was a poor move.
Republicans have to be smarter tactically, as well as from a policy perspective. The Iranians and Russians play chess, the Americans play checkers, and the Republicans in Congress play tic tac toe.

The O has been saying, since he was seen as ignoring the issue, that they have been on this since day one. The Coast Guard has been directing the clean up effort from early on, and, their actions have left alot to be desired. Thad Allen said he didn’t know anything about the gazzillions of feet of Boom sitting in a manufacturers facility, despite having communicated with Allen directly much earlier than he made the statement. Thad Allen seemed to be a pretty up-front guy in the beginning of their involvement, but, was cut off, and the message was controlled by the admin. The admin has also ignored the many requests by Jindal. It is the federal governments responsibility to protect the environment, and, not sit around waiting for BP to do what they will. Either they are so incompetent to do what has been necessary to mitigate the damage, or as some suspect, they want to insure that the damage is as great as possible, in order to pass Crap and Tax. The O covered that aspect well in his address, more so than talking about the spill, and, any ideas the admin. may have.
A point that many have missed is the fact that it didn’t matter what happened in the closed door meeting with the O and BP, the amount of $20 billion had already been decided by the Democrat Senators long before that meeting. When Hayward sat across from the O, and Holder, he had his lawyers with him, and, it is obvious that the papers, and terms, were already drawn up.
All but 4 Democrat Senators sent a letter to BP’s Hayward, not sure of the date, but according to a 6/14 article, requesting the $20 billion. They claimed- “While we are pleased that BP has admitted liability for these damages and vowed to provide full remuneration for economic losses and clean up costs, history has taught us that corporations often fail to live up to their initial promises.” In other words, they used actions that were/were not done by Exxon to immediately say that BP, a totally different company, was going to try to cheat before BP had been given any chance to make good on their promises.
In addition, Gov. Haley Barbour had requested funds from BP, and stated that he was pleased with BP’s timely response. BP’s statement- “Working in partnership with the state is important to an effective spill response. So we are pleased to make these additional funds available per the Governors request”, said BP’s COO Doug Suttles.
The O made public statements in the beginning of June where he claimed that BP was sent a bill for $69 million dollars, and that was only a first in a series of bills to be sent. So, the question is, was the $20 billion in addition to the bills being sent by the Government. It seems that the $20 billion is set up for reimbursement to the people in the region affected, and that BP is sending large amounts of money to DC, and the Governors, and who knows how many others.
BP has said they will pay all “legitimate” claims. The O and all the Dems. want remuneration for everyone, including those unemployed by the O’s decision to put them out of work with his drilling ban. There are many reports where the Katrina funds were rampant with misallocation, and, outright fraud. Many many people who had no “legitimate” right to Katrina monies got their palms filled. The same will happen with this new government slushfund, because the government can’t handle any effort with any efficiency or credibility. In a way, BP was correct with handing the responsibility of the slushfund over to the O admin. The O admin. now owns whatever happens from here on out. I await the screams from those affected (and some not, they just want free money) when they see how completely and totally the feds are screwups. And, you think Katrina was a disaster, huhhhh. You ain’t seen nothin’ yet.
In all, it wasn’t only the O who participated in an unconstitutional move, in which they had no legal right to do what they did, it was all the admin and D Senators as well. Even Markley asked aloud, do we have the legal right to do this?
The response to the spill, and the protection of the environment was clearly the responsibility of the US Federal Government to make every effort to avoid the destruction to the coastline, the wetlands, the marshes, and the beaches, and to protect the fish and wildlife. I keep going back to Mara Liason’s statement on FOX- When you have a problem that is hard to solve, make it bigger. President Obama can use this as a means to push his Cap and Trade legislation. And, the O has once again proven that he is willing to be as evil as they get with not only allowing the killing of the gulf coast and all the animals, but seemingly making it happen the way it has.

I think this is a situation that is unique from the previous shakedowns of Banks, Auto shareholders, etc. I have written often defending BofA CEO Lewis and the quotes from the meeting on CEO and exec pay that Obama explicitely threatened to release the “pitchforks” on them lest they succumb on pay ceiling. At the time AIG execs had mobs outside their homes. But we don’t know what was said behind closed doors, but
I also agree with EPU that Obama, Holder, Salazar PUBLIC statements amount to the predicate to a shakedown.
That said, I favor the result of the fund even if it was a shakedown based on all the facts and circumstances, which I will cover in a later column.
Also think that Feinberg appt is a good omen that the fund will be administered pretty well. Time will tell.
Liz Cheney basically articulated my position in brief comments on FNS today.
Haley Barbour and Landruie convince me that the Coast Guard, etc are doing a good job now and when Libs are calling for Jones Act waivers, I think we can pivot our emphasis to making sure ObamaDems don’t raise energy taxes/regs to exploit the crisis.

We do need to be more articulate than the other side since we don’t have the MSM on our side. This is a fact of life. Those who are less articulate than others should be a bit more careful.
A Paul Ryan-type could have used the hearing to get some points. Barton did nothing but preclude the ability of Republicans on that day to get points.
I don’t think they hate his statements—they are relieved at finding soft targets. We shouldn’t make it easy for jerkoffs like Chris Matthews. Barton is a professional politician, and should conduct himself like a pro. If he can’t, he should get some coaching and work at it.
I could find some local kids who are JV on their high school debate team who would be more effective in building up the argument that Barton wanted to make.

Actually, “slush fund” was more damning that “shakedown” and I’m not sure he backed off of that accusation. A lot of GOP members want his head so I’m not sure whp’s doing what right now.
This is just not a good time for the right-leaning GOP in the House to make war on itself, or its most fervent conservative backers out here. I think Boehner should see the necessity AND DUTY to fix this quietly by making sure people like EE (and thru him, us) are in on the game plan. This is not the time for a bloodletting.

Barton on the word shakedown, but, what has transpired with the BP escrow fund, and the Democrat Leadership has no basis in the Constitution, or with our laws in this country. Yes BP is responsible for all costs related to the spill, however, we have a functioning legal system in this country in order to insure that their responsibilities are met. We should be focusing on stopping the spill, and the clean up efforts, not pointing fingers of blame.
For whatever reason Boehner never seems to be able to turn anything into a positive for the Republicans. Was it him that also forced Joe Wilson to apologize for his “you lie” comment? yet Greyson can stand on the floor, in front of TV cameras and say that the Republican plan is “Die Quickly” with no punishment or apologies. Look at the Dems that have publicly called the Republicans, and the Tea Party people Nazis. Did Boehner have anything to say when the O accused the SC of wrongly deciding law with respect to Citizens United? even though his claim was not factual? What did Boehner have to say when the O, again in a very public speech, accused the Mass. police as having acted “stupidly” before he even knew the facts or circumstances?
And, then you have Mitch McConnell on Wallace’s show this morning piling on with respect to Barton.
The Republicans (currently in DC) will never ever gain any trust or respect when they keep allowing the Democrats to construct the message against them, and not ever figuring out how to turn the message in the R’s favor. It’s not only the D incumbents that need replacing.

If done properly, the issue of a shakedown could have been established with some facts. Heck, if the BP folks gave non-answers to questions about a possible shakedown, the non-answers would have at least been consistent with intimidation. Simply saying we know its a shakedown will not convince people who don’t think it is. Some decent Q&A could either have better established some facts to establish a shakedown or at least show that BP is afraid to answer the question.
When you are out of power, the ticket to power is either persuading the neutrals to get power or to make legal arguments in front of judges. This is clearly scenario #1.
I agree that we are in a different paradigm in many respects, but I still maintain that it is not the RS view (or the Moveon.org view) that matters—it is the swing voters who have managed to vote for people like Reagan as well as people like Obama.
If the rule of law is truly absent, nothing we say on this site will matter and I will make my way to the upper penninsula of Michigan to live out my days in the woods.

First, you ask the questions at the hearing to see what happened

If they obfuscate on that point, i.e. if they do not clearly give answers that Obama didn’t coerce us, then you build up to the conclusion, a conclusion supported by some evidence, be it implicit or circumstantial. For all of the lawyers in Congress, I am amazed at how few people are actually capable of asking questions in an effective manner.
The point is to end up with a conclusion that is defensible, and not merely conclusory. Folks here at RS are convinced that the $20B is the result of a shakedown because frankly that is the pattern of the Obama administration. However, for those still sitting on the fence, we need to come accross as people concerned about the specifics and knowledgeable about the facts. Starting out with an apology to BP (who may in fact be owed an apology) is just bad strategy.
I believe in playing to win, not to lose with the right position or to play nobly. This is a serious game for serious players, and Barton’s accusation followed by recanting is the opposite of serious.

He could have spent his time asking short pointed questions to illustrate that a shakedown had taken place. Instead, the Republicans were on defense for the rest of the day.
If someone is unconvinced/neutral on the administration, simply characterizing the meeting as a shakedown without first building up the argument is a mistake.

If those that watch the alphabet channels to get their news, believe the “shake down” language, as being portrayed by the D’s, they will be in for much more trashing of the R’s until eternity.
The R’s need to get some plans together (in addition to Paul Ryan) in order to attract fence sitters. They also need to stop demonizing their own, and turn the message around, and to stop letting the D’s define the party.

I seriously doubt that Boehner, saying what he did, as well as McConnell this morning, would attract many converts. Getting back to EPU’s main point in the diary, the R leadership in the House and Senate don’t exactly win hearts and minds with their lack of ability to stand firm with other R’s, and create a positive R message.
We mostly agree JSobieski, and the only way back from the wastelands is to offer the voters something better, and a brighter future. Then they have to stick to that long beyond election day.

It seems to me that we’re at an interesting crossroads. For the last couple of decades, we’ve looked to academia for answers, and we’ve pretty much gone along with what the “smart” people say. You, me, and many other conservatives have always disagreed with this, but the general public bought in.
It doesn’t seem to me that the general public is still buying in to it. I’m getting a feeling that the general public is moving to the “yeah, you might have a great education, but you really aren’t all that smart” when it comes to actual troubleshooting.

I’m not a lawyer, and I don’t have the time to research all the ways BP could be sued and held liable. But I suspect that the “$75 million cap” protects BP along only one dimension. Certainly, there are others from which BP could rightfully be held accountable.

This is not how the United States is supposed to operate under the Constitution! BP was the one being shaken down. To whom should he have apologized – a company not being shaken down? He was quite clear that he felt BP was responsible for damages. BP was planning to pay for damages. I think I would have done the same thing. I have never seen an administration go after its citizenry, states, and companies like this one. It is appalling and scares the daylights out of me.
I’m very disappointed in Barton – he set his conservative principles aside in order to secure a seat on a committee. I’m not surprised at Boehner – to me, he is a career politician and has shown zero leadership except when safe, and how dare he engage in the very thug tactics that the Obama administration is engaging in! I used to like Cantor, but it seems Washington, D.C. has gotten into his veins, and he has lost his true conservative roots.
I understand the argument that we should not have any in-fighting. That is a valid argument. But when we conservatives are fighting for the future of this country, we have to call out our own. Not doing so is what got us into this place.

I am operating under the working assumption that this was driven by Boehner. I am giving Pence, provisionally, the benefit of the doubt, as he has an outstanding track record. But he better chime up pretty soon.
You will notice in my PPS that I as much as said that if Pence really was in on this, I want him gone too. I fail to see what you find inconsistent in either direction about my treatment of Pence (too lenient, too strict).
Now as to the ‘circular firing squad’. Not every case of red-on-red violence is a circular firing squad. I do not lightly call for this (I have a history here, you can check – I don’t run around demanding resignations by Republicans all the time). Sometimes housecleaning and purging are required. We have people occupying leadership positions that are UNABLE to lead.

The danger posed by the oil disaster is minor compared to the danger posed by the unconstitutional measures being taken by Obama using whatever happens as an excuse.
The oil will dissipate. The water will clear. But if we will abdicate our defense of the rule of law because we’re mad at a company, it doesn’t even matter that the company was acting at our behest in the first place. There are legal ways to hold a miscreant responsible, but they don’t include standing in front of them, brandishing a billy club and saying, “You vill giff us money. You vill do vat ve say, und you vill not complain. Ve haf vays uff making you agree mit us.”
My gosh, folks, you lefties who might read this have been blowing your tops because people already being questioned by the police are asked to show identification as part of the process. This is a case of a company which is under threat of criminal investigation being told by the Attorney General and his boss that they have to turn over $20 billion, even though there is no legal, moral, or ethical right for them to demand it.
In the first case, that is normal minimal procedure under every law in the world. In the second case, that is called extortion or a shakedown, and it should severely compromise any criminal or even civil case the government might try to bring at a later date.
Further, the idea that it’s being administered by an “impartial third party” is ridiculous on the face of it. Ken Feinberg works for the President as a “czar.” Why hasn’t anybody except Rush Limbaugh noticed that? Obama now has a $20 billion fund to “distribute” as he sees fit. If a dollar goes to pay health insurance for somebody that Obama’s policies (shut down the Gulf) have caused to lose his job, it’s a dollar that can’t go to somebody who really was damaged by the oil. This IS a slush fund.
Gentlemen, START YOUR ENGINES. GET ON THE BALL. At least, FIGURE OUT WHAT A BALL LOOKS LIKE! You’re a bunch of friggin’ idiots.

The only upside for BP in the shakedown by Cormrades Obama and Holder is that BP may be able to defend itself later based on the inherent coercion. Then again, notions of due process may be dead in this Country now. The regime and their allies in Congress have demonstrated that show trials and political prosecution figure prominently in their transformative toolkit. You have to wonder just what assurances BP got from the Administration in exchange for the $20 Billion. If that was the price of not being nationalized and having prosecutions limited to low-level functionaries, it was probably a good deal for BP – if the Administration’s word is worth anything, because you know there’s nothing in writing and any dispute would automatically go to the government.
Don’t get me wrong, only people in the Gulf have more reason to dislike BP than do Alaskans; they’ve made some pretty good messes here too and tend to treat any oil province like some raj in the old British Empire where if they pay off the nobility, the masses can be kept sullen but not mutinous. They were at the root of the corruption scandals here; Veco was merely a proxy.
That said, they’ve also been on the outs with unions for a very long time and many of the safety complaints and the source of a lot of Waxman’s “information” about oilfield safety issues is a part of a union driven “safety” campaign in which they orchestrate safety complaints about everything, often in concert with state and federal regulators where they have a friendly administration.

I think I’m done with comments on this subject until some new facts are revealed. The biggest fact is that whatever happened for whatever reason, Obama’s response has been questionable in more than one way, and we aren’t paying much attention to that.

We are in an election year with higher stakes than we’ve had since 2000 when we kept Gore from turning the country into a socialist slide show for Global Warming. This election is more important than in 1994 when we killed Clinton’s legacy.

If we want Republican majorities in Congress to stop this thuggery we have to play the game as it is right now. When we win we can change the game, but Joe Barton has done a fantastic job in handing Democrats a political talking point to slam us with.

Barton is the problem because he made a statement that not only helped our enemies and hurt us, but his statement had no political upside which basically meant he hurt us, helped them, and did nothing positive in the mean time.
This is the time to be wise. We need to draw an inside straight and keep all the attention on this awful administration. Not having loose-lipped congressmen grabbing headlines and doing the party no good.
The Democrats are the party that says government will make you smarter, taller, richer, and remove the crabgrass on your lawn. The Republicans are the party that says government doesn’t work and then they get elected and prove it.

Maybe EPU went too far in calling for the leadership to resign (although he sounds dead serious), but what good would it have done for him to say they should go sit in the corner for an hour? The first rule in mule training is “get the mule’s attention.”
For me, the key to this column is that leadership screwed up by compounding whatever mistake Barton may have made. It may be an attack by EPU, but they’ll survive, and if by some chance they read it, they may recognize a different perspective. But nothing will happen at all if nothing gets their attention.
“if Barton had the courage of his convictions, the leadership could not sway him.” My understanding is he was shaken down himself to recant, as they threatened to take his ranking committee position away. Maybe he didn’t think the principle was that important, maybe he was weak, but that still doesn’t make him wrong and them right. In fact, that was a pretty minor thing for them to hit him about.
As far as how many people have been extorted, broaden your horizons. I’ll bet you have been extorted at one time or another. Maybe not big, but whenever you’ve been forced by someone in a position of power to do their bidding in any way, that’s extortion. Donated to the boss’s charity? Have your lunch money taken by threat? Pay union dues to a union you don’t want or don’t even belong to? Have to buy a special permit to keep emus on your farm? Pay a high tax rate? Those are all forms of extortion, some by government. It ain’t hard to understand what Barton meant, even if he didn’t say it well.

The leadership, particularly Boehner, missed a tremendous opportunity for the R’s to point out the “underhanded” methods used in extracting the escrow account. It’s like you invite someone to a fancy expensive dinner out, and the invited can’t find the restaurant. Boehner created a very public “circular firing squad.”
Everyone sticking up for Boehner and Cantor seem to forget they were a part of the Bush admin. that spent and spent, and gave the D’s precedent to do the same, although by larger margins. Both Boehner and Cantor have voted for No Child Left Behind, Medicare Part D, TARP, and Cash for Clunkers. Now that the D’s have the majorities, they are suddenly fiscal hawks. If we do get at least one house back in Nov., will they stay fiscal hawks? That’s what everyone should be asking? So far I haven’t seen any “come to Jesus moments.” They remain dumb and ineffective.

The Big Book of Beastly Pronuciations is highly reccoed by the Doc. If you care about the language, you will find this book a blast, it is actually fun to read. I don’t agree with everything the author says, but he always makes an argument to support his conclusions.
Some examples, people who say “flasid” for Flaccid, when it should be Flaksid. Or those that say off-ten for often, when it should be awwfen. then there are those that visit the op-thamalogist, when they should be visiting the awwfthamalogist. Anyway, it is a fun book and makes you better than everyone else

No need to argue with you GC. I am a person who loves to learn. I mostly study history, but I have a thirst for all knowledge. If something is right, and proven right, I am glad I have learned it. I don’t tell others how to speak, I follow my own path. When I speak French and Spanish, I try to pronounce those languages as well as I can. I learned long ago that with foreign languages you are better off speaking fewer words properly than many words wrong.

My dispute was simply with the mispronunciation of a couple of words, one because of pretentiousness (di-viss-ive), the second probably because of a local New York pronunciation (tore), which I despise because it’s spreading across the airwaves and nobody seems to notice.
I can’t imagine anybody saying “Clim-zon.” Are they confused? Do they think they’re in Alabama, watching the Climzon Tide?
People have been mispronouncing nuclear since the nucleus of anything was described to them. Laura should have taken W. aside before he ran for governor of Texas and explained to him that he sounds stupid when he says “nuculer.” In fact, he knows the right pronunciation but decided to continue with the wrong one. To me, that’s double-stupid.
Language does evolve. And I’m agin’ it.

Of course you are right about pronunciation changes over time. We know the French, Spanish, Italian, etc came from mangled Latin and regional differences for example.
What I am talking about is modern AMERICAN English usage and pronunciation changes that occur/ed because of Ignorance. If nothing else, I prefer to know what is correct and why.

There are more dumbo’s on FOX than only O’Reilly and Geraldo. I prefer How It’s Made or Food channel to most of them. The Lefties claimed that FOX is not a news channel, and in some ways they are correct. For the most part, they do not report the news for you to decide, they are talking heads trying to push their views on the audience, with a little news reporting on the side, which often is not accurate or up to date.
I don’t know where O’Reilly was in the political spectrum in the past, but, since the O’s coronation, it is not hard to see where his persuasions lie. His reaction to the “shakedown” comment is not surprising, it was predictable. I’m sorry that Bachman lowered herself to appear on his so-called show. It reminds of the chick that caught Rand Paul up. What does surprise me though is that O’Reilly has the number 1 rated show. He is nothing more than a pompous peacock strutting his stupid stuff, that starts loudly squawking when he doesn’t agree. And, anything said against the O is beyond his tolerance.
I admit I went just a bit overboard with this one.

Lately he’s annoyed me about the sailor girl, giving Obama the benefit of the doubt, being “a simple man” (he’s so right there), and not recognizing the real danger that Obama represents, even though Beck is sitting there leading him by the hand. Basically, he can’t bring himself to even consider that Obama is not only on a different page, he’s reading from a different book.
But to be fair, I admit that I left out some exculpatory dialogue. He did ask some good questions of Bachmann, which she completely blew herself for some reason. The time delay on the satellite feed may be part of an excuse. And Bill doesn’t claim to be conservative at all. He is slow, and he doesn’t do much quality show prep, apparently, but he gets it really right sometimes, too. E.g., when he blew up at Geraldo regarding the illegal alien who killed somebody in a DUI incident.
He’s the #1 rated commentary show because the rest are even worse, and less interesting. And all news these days amounts to little more than, “So and so said today on Capitol Hill that…” In depth is when they follow with, “In response, Senator Whosis countered that….”

I’m sorry that you only got angry with him over only the Michele Bachman interview. That wasn’t an isolated incident, he does that kind of thing all the time. Beck’s show, for the most part, is well researched, and provides a view into the O and his administration. O’Reilly says crap to him like, you take all this info. and then come to conclusions that just aren’t there. O’Reilly apparently can’t or won’t connect the dots, it would go against his own fiery rhetoric that gets him ratings. O’Reilly cares about only ratings, and if supporting the O is going to keep him at number 1, that’s where his paycheck is, and he will continue to incite for that reason. He was a great child advocate before the O coronation, he should have stayed with child advocacy.

We wonder how an intelligent person (as Juan obviously is) can be so blind about this stuff at some times. Other times, he does admit Obama doesn’t walk on water. I suppose we may be as blind, ourselves, about something, but I don’t know what.
I watch to see the panel for a range of perspectives, even though they are often not as interesting as the ones we see here. I record the others so I can pick out the good interviews and skip what isn’t informative. It’s possible with Fox because they do have interesting people, even from the left.
I’d watch CNN for the same reasons, but it’s just too painful. “John King’s America” is like watching paint dry. I wasn’t kidding when I asked about a source of straight news. Even the WSJ doesn’t fill that bill. Is there a source on the internet?

When the phrase shakedown is used, it typically refers to organized crime threatening to do something ILLEGAL, like break your legs, hurt your family etc.
When the phrase leverage is used, it typically refers to non-controversial situations like, I am your lendor, the contract says that if you miss a payment, X happens, etc.
Hardball is something in between. If Obama threatened BP with bogus criminal action, then I agree its a shakedown. However, for all we know, it was BP’s idea in the first place. BP was taking heat for making slow comp payments, and this way, that stuff is off their plate.
Would it make sense for BP to want to focus on the cleanup and not on administering the payment of claims? Yes it does. Moreover, by specifically spreading out the escrow payments, it buys BP time in which things can cool off, particularly from a legal perspective.
BP has neither accused the WH of a shakedown or volunteered that the $20B was BP’s idea. This might be implicit evidence in support of a shakedown, but it is hardly conclusive.

The fact is, hardball or extortion, the power of the Presidential office has been used to “encourage” a company to act in a certain way. Not any better now than it was when Henry Paulson forced some banks to bend to his will. At least in that case they believed the financial system would collapse if the banks didn’t “voluntarily” comply and if ALL of them weren’t part of it.
But the child of TARP was Government Motors, and the child of GM is Oiled Slush. We don’t want this to become “politics as usual.” In fact, we don’t want it to happen again.
Notice that it’s having its desired political effect–Obama’s incredibly inept performance in protecting the beaches isn’t being mentioned.

Barton was telling the truth, to power, and he will pay the price as did General Billy Mitchell, who was forcibly retired but also warned in a book before it happened that Pearl Harbor would be bombed from air by Japan. Barton -sadly for us all – will be vindicated some day. Talk about your Cassandras. But Barton if he chooses to run will be comfortablyu re-elected by his contituents south of Dallas. He is answerable to them, not to Pelosi Markey or Boehner. If our guys were smart they would take this on and use it to steer to more favorable debating grounds, not run from it. I think many would agree, their philosophy of dealing with liability and claims very different from BP’s. BP’s actions here are consistent with their reputation of settling fast, up front, go along. They had to, foreign corp got caught walking down a very dark street late at night in Chicago. They have agreed to the squeeze to save the company, wihch by the way is a fiduciary duty of the CEO. Exxon’s reputation is very different. I’d characterize it as “we are American corporate citizens, we know our rights, see you in court chump.” And double security on the refineries, lock the gates, and get ready to rumble for 15 years. I did not advocate this before but you know, with this crew in the WH, we may be very close to some kind of sharp legal confrontation now, and as O keeps pushing not everyone is going to rush to settle as did BP. Jindal’s starting to feel the O “push” too. How long can they let their people or assets be harmed?

The place for it is in a long thoughtful analysis of the whole issue. Like it or not. we have become a nation of soundbites. Both sides are constantly damaged by minor gaffes or careless wording. Look at how Rand Paul let himself get trapped by that lefty babe on msnbc into a soundbite that sounded like he wanted segregation. Words count.
As far as Boehner and Cantor go, they have held the GOP together on some pretty tough votes. They are entitled to some party discipline.Apparently at RedState, there is zero tolerance for leaders who fail to meet the standards of perfection that have been established , even on the smallest issue.
Cantor is right on economic and fiscal issues, right on defense and foreign policy, right on social issues. I’d be thrilled to see a person with his views in the White House—even if I sometimes disagreed with him.

He is truly a part of the Republican establishment. He’s one of those helping to pull the rope holding the next stone going up higher on the pyramid of Big Government. I’ll give him and Boehner some credit for holding the House R’s in line with voting Nay on most of Pelosi’s legislation, but, I promise Cantor is for Big Government when the R’s are in power. All House members are looking at their re-election campaigns just about now, including Cantor.
I’ve said before, Cantor is my rep. and I have heard him interviewed on the closest (geographically) conservative radio show in the area, which is broadcast from the neighboring 5th district. He has brought many loud sighs from the show host, and his emails and call ins incite a spate of emails and call ins that are usually furious with what he has to say. Most messages are that Cantor isn’t for less or smaller government, he is for Bigger Government, but only when the R’s are in power. He has not been invited back on in quite some time. And, that radio station covers most of my area. And, the show host is about as kind, forgiving, and fair as you can get.
Cantor has always run unopposed, even by the Democrats. This year that may be different. There is a Democrat running against him that has a family name that is very well know. They have the largest Harley franchise in the entire surrounding area. They have much influence, and much money. Don’t know if they have as much as an incumbent, but, the DC crowd would come with big bucks to help him. I have always gone to vote for Cantor, in the past several elections, even though it doesn’t matter. This year my vote may matter, and I will be taking along the same nose clamps I used when voting for McCain. I think that this year Cantor may have to actually campaign, and work for his votes. I’m spending my time in the 5th district trying to get rid of the Soros candidate Tom Perriello.

The problem with the Boehners and the Cantors is that they can’t seem to get past the Lefty game. I don’t know if they think they are taking the moral high ground, but, if so, they are playing croquet while the Libs are playing contact sports. The Libs have no morals, and they don’t operate in that realm. Maybe Barton was wrong in using the term shakedown, and he would have been much better off pointing out the unconstitutionality of the scheme, or pointing out that the O was using powers of persuation, which he was not authorized to do, but Boehner was terribly wrong in his immediate take-down of Barton. If Boehner was such a great leader, he could have turned that whole incident into a matter of constituionality or legality, rather than all but agreeing with the O’s methods. The Republican Study Committee called the scheme a “Chicago-Style shakedown” and, Boehner never came out against them. And, as Vassar pointed out, Boehner called it a “slushfund.”
It’s pretty clear and obvious that Boehner and Cantor don’t have the ability to turn a message into a positive for the R’s. They can’t seem to get off their knees and stand up and fight. It makes me wonder what wrongs they have done that they are trying to hide. We know that they were a part of the big spending R’s during the Bush admin., but, it feels like there is something much more sinister there.

The facts are that after an accident that killed 11 men, BP has accepted full financial responsibility and, not once, refused any request from the government. 23,000 out of 51,000 claims (to date) have been settled. This has been done at a cost of about $60 million. An appeals process is setup for any unsatisfied claimant. What would you have the executives do? Kill themselves? You think they weren’t coerced? The AG had already threatened criminal prosecution. They went into a room with Obama and the AG and came out agreeing to halt all dividend payments, an act that will harm literally millions of people. $20 billion is an amount equal to their net over the last year and a half. But it’s only a down payment. They agreed to an open-ended commitment. They have no control over the legitimacy of any payouts, including for losses due to Obama’s political halt to deep-water drilling for which they bear no responsibility. Sure, they did this voluntarily. The money will now be doled out to political cronies as with everything BHO touches.
To use threats to compel someone to do something against their will is a crime whether we like the victim or not. Government officials must be held to a higher standard not a lower. Giving them a pass on criminal transgressions is a sure route to tyranny. Very fuzzy thinking this morning GC. Maybe more coffee.
Fox News operation has the same sort of reporters as everyone else. It’s only slightly less biased. The big difference with the others is a reporter isn’t fired for letting a conservative bias show as well as liberal bias. Bill O’s father was a petroleum jobber. Being at the mercy of his suppliers, he naturally had a low opinion of oil companies. BO inherited this disdain. He’s completely irrational on the subject of oil.

I just think that given the emergency, extent of suffering, risk that businesses could be forever lost, the level of BP negligence, the level of BP profits, and being for “charity” (even if encouraged by a “shakedown” – part of the shakedown is, you must admit, simply advising BP of legal possibilities that could destroy the company), I am glad this fund is in place.

I am not sure why you favor the fund. First , BP has not been shirking their responsibilities on paying claims for those harmed by the spill. More than a third of the claims so far received have been settled. An appeals process is in place for anyone not satisfied with their determination. I expect this will all come to a halt soon and everyone will be waiting on the Feds to set up their system., Hardly an improvement.
Secondly and possibly not pertinent, much of the damage and suffering is being caused by the actions and inaction of the Federal agencies who make a dog in the hen house look like an organized affair. I am not sure why BP shareholders should pay for the stupidity of Obama and his dunce parade.
Thirdly, The amount. Even if the number of claims rises 20 times over the current level, which is possible, at the current average payout, all claims could be settled for 3.6 billion. $20 billion exceeds the combined annual budgets of LA, MS and AL.. Seems kinda high.
Why are you so confident this money will get to gulf residents? If past history is any guide, Barry takes care of his supporters first. The people put in charge ran the 9/11 victims fund. A lot of this money was paid to people who had never been in NY before submitting their claim. and some huge awards went to people who just happened to be supporters of local Dems.
If BP had tried to deny responsibility I’d be with you on action against them.. As it stands, I think many people along the Gulf will rue the day Barry got involved, if they already aren’t. If we ever meet I’ll be glad to buy the coffee.

If they are slow in paying (think Cash for Clunkers), its the Feds fault. If there is fraud and abuse (think Katrina, cash cards for strip clubs), its the Fed’s fault. If payments are insufficient (everybody always claims this), its the Fed’s fault.
With so much to do in terms of the well itself and the cleanup, BP could very well have wanted to be rid of this particular responsibility. Moreover the $20B is over a rather extended period of time, and yet, that number is all over the place, so BP is getting immediate credit for something its not doing today or tomorrow.
These aren’t necessarily reasons why people at Redstate should support the fund, but they are reasons why BP may itself find the fund desirable. If I were BP, I wouldn’t want to go this route, but it wouldn’t surprise me if BP is actually happy (or at least relieved) by a lot of this stuff.
If I were the WH, I would be wary of pulling this off well. I remember a lot of auto dealerships bitching about the lengthy delays in the cash for clunkers program. This plan will likely backfire on the White House.

a) BP has caused billions in recoverable damages to businesses and individuals along the Gulf Coast and those that work there.
b) It usually takes many years to settle claims for loss of income damages due to their speculative nature
c) It is crucial to the economy of the Gulf and the US that private sector jobs be saved
d) If damages are not recovered before winter, many of the businesses in the Gulf will fold permanently
e) BP could fight all claims tooth and nail for years and try to rely upon the supposed puny $75 million cap on such damages in the post-Valdez law (The exceptions in that law for gross negligence make it likely that courts would rule BP is not entitled to the cap)
f) BP is worth hundreds of billions of dollars
g) $25B is a puny amt to BP but could be crucial for the Gulf

The banks are in thrall to the Treasury, the Federal Reserve, and the SEC. The auto makers are at the mercy of the USDOL and the EPA. The hospitals live or die by how health insurance is regulated and by how Medicare/Medicaid pays. The oil companies are at the mercy of the USDOI, NOAH, NMFS, USCG, Corps of Engineers, EPA and God knows who else. If any company doesn’t play nice with the government, the government can either punish it directly or give its competitor(s) a telling advantage. How do you think Ford is going to fare with the National Labor Relations Board if it ever tries to get tough with the UAW?

Sure there would be states who would act the same way the feds do now, but companies could relatively easily move out of their jurisdictions to another state, and when they did the jobs would still be in the United States. Now they go overseas and so do some jobs.

Frankly, I wouldn’t have been surprised if the had simply let their US subsidiary go into immediate bankrupcty like Dow Corning did re: the breast implant litigation. Takes everyone out of state court, and introduces an attitude of scarcity when it comes to damages. Also makes punitive damages far less likey.
The oil companies are far better situated than the autos, insurors, or big pharma to make any kind of stand. Of course, BP was and is a suck-up company which cynically runs all sorts of “green energy” marketing campaigns knowing full well that the greenies are absolutely nuts.
In communist Poland such people were known as collaborators. BP is the least sympathetic western oil company that I am aware of.

I also think this was a shakedown, and that in itself does not bother me. I wish that the shakedown deal had been set up for a private third party entity set up by the Governors of the gulf states to administer the escrow account instead of the White House. Shakedown deals are simply a political reality. What is really bad is that Obama and his minions don’t have the stones to shakedown North Korea and Iran. The rest of the world sees this of course.

The State of Boehner & Ohio

Ohio existed under the senatorial liberal weight of Glenn and Metzenbaum (G&M) for decades. We finally, voted in DeWine and Voinovich. Both drifted to the middle once hitting D.C. but they were and are a vast improvement over G&M. Unfortunately DeWine lost his seat. V is retiring.
At the state level, the governor’s mansion has traded hands back and forth between centrist Rs and liberal Ls. Voinovich finally established a foothold in Columbus. Sadly, he was replaced by Robert Taft, a corrupt, moderate R. Taft’s corruption undermined the entire party. We lost all the state level offices (governor, treasurer, secretary, etc…).
We also lost quality conservatives in the U.S. House. 2006 to 2008 was a tough stretch for Republicans in Ohio.
Fast forward to 2010.
The state offices are up for election. Voinovich’s U.S. Senate seat is up for election. Many quality conservatives are attempting to reclaim their house seats and could use your help!

While I observe it in our esteemed politicians, it has been commonplace in the “politically correct” world of policing for many years dating back to the 70′s and since. Maybe that’s when it started in politics but I fear its’ seed was sown long before the 70′s.
As a strongly conservative Republican living in the South (Florida) it’s time that is not held against me. My message to the “good old boys” of this party is your time came and it has now gone. You all didn’t do what you were supposed to do after 1988 and look how great things are now. That is why I heeded the call and became involved in my country’s living document, the Constitution which is being twisted and distorted by the “good old politicians” of both parties.
I am terribly tired of the rhetoric, yes rhetoric of the Cantors and Boehners and the pretentiousness of their reported “leadership”. Where I come from , leaders are those who “walk the walk” to justify their “talking the talk”.
Boehner, Cantor, and the NRCC, you are .losing many of us by just “talking the talk” and then “jaywalking”.

Barton did something stupid and it may be the one thing that will get some traction for the Democrats. I have seen a ton of articles that say GOP supports BP against Obama quoting this incident.
Barton should have to pay a price for it. This isn’t a court of law, it’s politics … when you do and say stupid things that can be used against you and your party, there is a price to pay.
There may be other reasons that we should have new leadership in the house, but this doesn’t seem to rise to that issue.
So in summary the answer to your “Well I don’t know why” would be: for giving the Democrats a sound bite that resonates with people when we’re in the middle of being on a roll.

And I think we all agree that the BP thing was a shakedown. I think where Barton went wrong was in apologizing to BP. He should have skipped that part and apologized to Americans for such a corrupt Congress and prez administration…and the farce of a show trial that was going on.
And to Cold Warrior…As far as the whole precinct committeeman thing goes, on what basis do you say that we’re lazy not out here taking our party back? I am a GRAPHIC DESIGNER, for God’s sake, and I’m running to be a delegate in my district. There are four openings and six of us are running. I’ve been to several candidate forums and the delegate candidates from all the districts are drilling them on what they stand for. I am not going to blankly endorse the people my county office likes. I will endorse who I believe in. I will tell people in my district the truth and relay the information that I discover about the candidates. I have sent out postcards at my own expense and started a FB page. I have already begun doing the job I’m not even elected to do yet – informing people in my district about their candidates. I will call or personally go door-to-door to meet the rest of the people who weren’t contacted by postcard (the older Republicans). I will make my own homemade signs, once again at my own expense. And I only make about $14.50 an hour so don’t think I’m made of money to be doing this. I also volunteered several years ago to do the web design for the local county office (for free) because theirs sucked at the time. Don’t tell ME we’re not doing anything out here. The current Republican party is a joke, but there are many of in the trenches willing to do what we can to change it. My motto is PUT UP OR SHUT UP. Action, not just words.

The main reason this is being spoken of is because so-called republican leaders attacked Mr. Barton and Mr.Barton gave an intense apology. Obstacles to right of center people now are immense. Gingrich does nothing but kick us back down the hill every chance he gets. I heard Rush today too. Gingrich is a different story. He stands with Beltway elites, not the people.

Of course, that doesn’t mean it wasn’t a shakedown, but it does mean that folks were thinking it made sense from an efficiency/PR perspective, and that the idea was not per se an Obama grab (i.e. that there were good faith reasons to support it)
That makes the entire PR fiasco of Barton’s statement and subsequent reprimand by the leadership even more sad.

The Democrats environmental agenda is to tax and regulate, but you can’t tax or regulate an oil spill, so they’re simply clueless. BP of course caused this mess in the first place, likely because they didn’t want to spend the money necessary for proper safety measures. I don’t see a logical reason for saying anything positive about either group.
If we’re going to talk about Boehner and the need for better leadership, I’m totally for that, I’ve been for that for a MIGHTY long time, this is a guy who supported the Bush bailout and then opposed the Obama bailout. It was nice that he opposed the second one, but after having supported the first one he just looked totally like a hypocrite, which of course he was. We don’t need leaders who support things and oppose things based on the party of the guy proposing them, instead of on the merits of the ideas themselves. We need principled leadership, Conservative leadership, real leadership who will stand for what is right and oppose what is wrong, and not care one bit who proposed it in the first place.
I would love to see somebody like a Bachman or a Scott (should he win the runoff in SC tomorrow) be made the new GOP Leader (and likely House Speaker, since the GOP will probably control the House next year), somebody who is a true blue Conservative, you know where they stand and they don’t back down, and they don’t care about party, they care about right and wrong. Thats the type of person we need in there, not a career politician who has proven himself to be a ‘party first, Country second’ kind of guy. We need someone we can point to with pride, and say ‘this is our leader, this is why I’m proud to be a Republican and this is why you should be a Republican too’. Our current crop of leadership is, sadly, the complete opposite of that. So I agree with the Diarist, we need new and improved leadership, and hopefully after the midterms we will get it.
