Mr. Burris Goes to Washington [UPDATED]


UPDATED: The Illinois Secretary of State is refusing to certify the appointment. Blago could constitutionally force him to as it is a clerical act, but would he?

Rod Blagojevich has laid hands in the pocket of Roland Burris and extracted a United States Senate appointment for him.

That Burris would accept such an appointment means he is (A) an idiot; (B) corrupt as hell; or (C) all of the above.

Harry Reid has already leaked that Burris is unacceptable.

Someone should audit Burris’s finances to see how much he paid. Someone else should start asking Burris if he paid for the seat.

As a reminder of the awkwardness of Blago’s decision to go on and appoint someone while the cloud of corruption hangs over him, here is Harry Reid’s letter to him from earlier this month. The relevant portion is bolded.

Dear Governor Blagojevich:

We write to insist that you step down as Governor of Illinois and under no circumstance make an appointment to fill the vacant Illinois Senate seat. In light of your arrest yesterday on alleged federal corruption charges related to that Senate seat, any appointment by you would raise serious questions.

It is within the authority of the Illinois legislature to remove your power to make this appointment by providing for a special election. But a decision by you to resign or to step aside under Article V of the Illinois Constitution would be the most expeditious way for a new Senator to be chosen and seated in a manner that would earn the confidence of the people of Illinois and all Americans. We consider it imperative that a new senator be seated as soon as possible so that Illinois is fully represented in the Senate as the important work of the 111th Congress moves forward.

Please understand that should you decide to ignore the request of the Senate Democratic Caucus and make an appointment we would be forced to exercise our Constitutional authority under Article I, Section 5, to determine whether such a person should be seated.

We do not prejudge the outcome of the criminal charges against you or question your constitutional right to contest those charges. But for the good of the Senate and our nation, we implore you refrain from making an appointment to the Senate.

Rolland Burris (a man who Blago claims has had an “impressive career” in Illinois politics) has, in truth, an “impressive career” of racking up a series of primary LOSSES.
He ran for mayor of Chicago and suffered a humiliating drop-out defeat against Richard Daley.
He ran for governor (for which he struck out THREE times at bat –1994, 1998 and 2002, against Blagojevich)
And when he RAN for the position of U.S. senator, he LOST… BADLY… against challenger Paul Simon.

Still, Rolland pompously informs us that Obama’s replacement “should be able to win a RE-election”… (I guess being elected in the first place is meaningless if you can BUY the seat and bypass the voice of the voters, who have repeatedly made it clear they don’t WANT him in any of those positions)

And, in spite of Roland’s embarrassing string of primary losses, he still believes he deserves this job because he’s “never lost to a Republican”.

On FOX, just now, they reported that Rolland claims he never contacted Blago about the position. He insists he was the one who received the call to duty about 48 hours ago.

While the senate does not have the legal right to adjust “qualifications” to prevent Burris from being seated, legal experts say the Senate DOES have the right to look into whether a senator’s election or appointment was valid and lawful.

According to an article in the LA Times:

“It’s true the Senate cannot add qualifications, but it has to recognize an election or a selection as valid,” said Trevor Potter, a Washington lawyer and former chairman of the Federal Election Commission. “If it has questions about that, such as after a contested election and a recount, the senators can delay a decision on seating and defer the issue to a committee.”

In Wednesday’s letter to Blagojevich, the Senate Democrats warned the governor against choosing a new senator, but they did not flatly refuse to seat such an appointee.

“Please understand that should you decide to ignore [our] request . . . we would be forced to exercise our constitutional authority under Article I, Section 5, to determine whether such a person should be seated,” the letter said.

This provision is the one the Supreme Court described in 1969 as having a narrow scope. It says: “Each house shall be the judge of the elections, returns and qualifications of its own members.”

As it stands, ALL of the democratic senators have said they will refuse to seat Burris. After that, the best hope Burris has of maintaining his appointment would be to go to court and challenge the decision as unconstitutional.

At that point, it will be a matter of how much money Burris wants to spend to claim a seat in the senate where he is clearly unwelcomed to represent the people of Chicago, who have repeatedly refused to elect him.

And, perhaps you ARE right… However, I am having considerable difficulty (as I am sure you are) accepting this unfortunate turn of events.
I have nothing against Mr. Burris. In truth, I am not familiar enough with him to put forth a qualified judgment.
But I can say, with all honesty, that it is truly sad that this man who (as Charles Krauthammer described tonight on FOX) has been “reaching for the brass ring all of his life” must, out of desperation to snag it, accept the appointment of a man who (only a few days ago) barely considered him as a qualified choice for this position in the senate.
It is unfortunate that Mr. Burris is so obsessed with obtaining this seat, would lower himself to this level.
I cannot help but wish that he would have passed on this appointment and suggested for himself that the people of Illinois be given the opportunity to give HIM the chance to EARN this position with honor… for that is the only way Mr. Burris will ever obtain pride in the accomplishment he has been striving for.

Please accept my apology if I at any point during this exchange appeared to be disrespectful of your argument.

Burris is about the only guy that Dingy Harry would be forced to seat. Burris was not considered a candidate the first time around and has a reputation for being someone of intergrity, so it can be argued he was not involved in any pay to play stuff.
Also given Dingy Harry’s tough fight for re-election in 2010, he needs all the AA support he can get and not seating the man who would be the only AA senator wont help. If Reid blocks Burris, Reid will not win re-election so he really poltically has no choice but to seat Burris. Having Rush come out and not only playing the race card but dump race gasoline on this fire only amplyifies Reid’s dilemma as now this turns into a racial and not an ethics thing.
The moment Reid seats Burris, Blago gets some legitmacy as the being the Governor and the more he looks like an active governor than a lame duck he needs to halt the impeachment momentum aganist him. He can use his resignation as Governor as a chip to get a better plea bargin from Fitzgerald. I wonder how a guy this tactful got into this mess in the first place.

Blagojevich cannot be an effective representative of the people of Illinois and, as we have said, will not be seated by the Democratic Caucus.

If they seat Burris, they’ve all just admitted in the pages of the Washington Post that every single one of them is a liar, on the public record.

Now, we can imagine scenarios where everyone mentioned in that article being demonstrated as a liar to the public, in the press, in the pages of a newspaper favorable to Liberals, would not matter.

But if that’s the point we’ve reached before this next President and Congress even take office, there’s not much left to speak of in terms of this Republic anyway.
