Some want the White House to make Judge Sotomayor say she “misspoke.”
Some Democrats and political analysts are urging the White House to shift course and concede that Supreme Court nominee Sonia Sotomayor made an error when she suggested in 2001 that Hispanic women would make better judges than white men.
“She misspoke,” said Lanny Davis, a White House lawyer and spokesman for President Bill Clinton. “Every day that goes by that they don’t say she misspoke and she used the wrong words … they just feed it and give it life and give Rush [Limbaugh] and [Sean] Hannity more airtime unnecessarily.”
How exactly is saying what you believe misspeaking?
I think it was very honest of her, but let’s also be honest. Were a white man to say “I would hope that a wise white man with the richness of his experiences would more often than not reach a better conclusion than a Latina female who hasn’t lived that life,” he’d be dragged out onto the National Mall and beaten to death by the left and right alike. Heck, he would not have even gotten the nomination.
A white man would not be given the chance to say he misspoke on something like that.
Judge Sotomayor’s statement reflects her view that she sees the world through her experience, and not through the text of the constitution. That is probably why many lawyers find her rulings unpredictable. And unpredictable justice is no justice.
Judge Sotomayor’s statement reflects a race based world view. But then again, that’s no different from the guy who nominated. She told what she believed to be true. The Obama administration should be forced to deal with it as they believe the same thing.
We need somebody who’s got the heart—the empathy—to recognize what it’s like to be a young teenage mom. The empathy to understand what it’s like to be poor or African-American or gay or disabled or old—and that’s the criteria by which I’ll be selecting my judges. Alright?

Remember Trent Lott
Jeff Emanuel Thursday, May 28th at 4:49PM EDT (link)Who not only lost his position, but had to make an apology tour that included Black Entertainment Television.
Of course, the fact BET exists isn’t racist, despite the fact a White Entertainment Television’s mere existence would make its operators and advertisers the object of liberal firebombs and death threats, just like Sonia Sotormayor isn’t racist for saying something worse than Lott said.
No apology tour for her!

Look, the issue here isn't whether she gets confirmed...
MacAoidh Thursday, May 28th at 5:25PM EDT (link)…she’s going to get confirmed. The fact that she’s going to get confirmed means the Republicans don’t have to vote for her and I think this business of “fight her and you’ll hang yourself” that our wonderful friends in the Democrat Party are feeding us is so much BS. They should vote to oppose her. Not to filibuster her, because filibustering a Supreme Court nominee is unconstitutional and should never be done.
What you want to do with this is to bleed Obama as badly as you can. Sotomayor has as much business being on the Supreme Court as Al Franken does - but her gross inadequacy as a nominee isn’t her fault, it’s the President’s. This nomination is a wonderful opportunity to hammer home the total lack of commitment to the rule of law and the Constitution on the part of this administration and show them to be completely lawless. Build a meme of this administration as reckless teenagers drunk behind the wheel and as they destroy the country you’ll have a chance to be cast as the adults.
I agree that a filibuster of court nominees by Republicans
Justin_Case Thursday, May 28th at 5:38PM EDT (link)should not take place.
When the Democrats were in the minority and they held up nominations by filibuster, all I heard were complaints from Republicans about how Bush’s nominees deserved an “up or down vote”. Excuses were made for the Abe Fortas.
There is no excuse for following the example of unprincipled Democrats.
Now, do I think a fight should take place? Absolutely. But, in the final analysis, the words of Mr. Limbaugh and others comes into play, “elections have consequences”.
Soto' should receive all the consideration and courtesy shown Robert Bork
olsmithie Thursday, May 28th at 5:50PM EDT (link)Please elaborate why Republicans should treat her any different than the Demoncrats treated one of the finest legal minds in the country?
Regards
I certainly dont think we should back off of legitimate criticism just because she is Latina or a woman
kyle8 Thursday, May 28th at 5:54PM EDT (link)Because the haters already hate us, and those who are not haters will not blame us for pointing out real problems with her judgements.

The only elaboration I will offer regarding filibusters
Justin_Case Thursday, May 28th at 7:01PM EDT (link)is that Republicans are not Democrats in that we stand on principles.
Now, if the Republicans wish to rake her over the coals during the committee hearings, I’m looking forward to that. However, if she gets the majority of votes from the Judiciary Committee, then she is entitled to a vote on the Senate floor.
as a contrarian point of view
gazill Thursday, May 28th at 6:43PM EDT (link)I think the Republicans should attempt to fillibuster (please remember that the Democrats generally do not concern themselves with respect to the Constitution), time and time again, until the Democrats decide to create legislation that prevents filiibusters. I’d bet the farm that even if we take the high road, the next time roles are reversed, the Democrats would still fillibuster.
so sickntired of hopenchange
My view is this
Neil Stevens Thursday, May 28th at 6:45PM EDT (link)Republicans should filibuster, but if the Democrats want to change the rules to end filibusters of items on the executive calendar, I’m fine with that as well.
Want to run for conservatives? Give.
There Is No Crisis
Of course the Dems would still filibuster.
Justin_Case Thursday, May 28th at 7:06PM EDT (link)But, for now, the roles are not reversed.
Frist and the Republicans he lead in the Senate should have chosen to change the rules. I bet had he shown a pair back then the GOP would not be in the minority today.
That part has some merit...
MacAoidh Thursday, May 28th at 7:11PM EDT (link)…but if you go that route you fuel the meme which says “there’s no difference between the Republicans and the Democrats.”
Frankly, what I’d like to see is Sotomayor get completely eviscerated in the committee hearings and reduced to mush by either the GOP senators or their lawyers (and I’d like to see them find a sharp-as-a-razor Hispanic guy to serve as minority counsel and turn him loose on her with gusto), damage her as a racist, left-wing kook and judicial mediocrity, and then vote her out of committee and onto the floor where she wins confirmation by something like 57-43 with a couple of Democrats voting against her thanks to pressure from constituents.
And in such a scenario hopefully the conventional wisdom will be that Obama has through affirmative action debased the Supreme Court and put on the bench the worst justice of the nine.
Short of the ideal (her not being confirmed) I like your scenario
JLenardDetroit Thursday, May 28th at 7:31PM EDT (link)to once again let us remind folks again, Bi-Partisanship has really been Democrats joining with Republicans (here) and as in here… Eventually, despite the MSM Spin to the opposite (since they have trumped up for years Bi-Partisanship being the end all be all of Politics and that it is ALWAYS somehow Rep’s joining Dem’s)…. NOT TRUE lately…. so the MSM has just dropped it - but we will get people to notice again and that it is AGAINST the ObamAgenda

Didn't that already happen
molybdanthan Thursday, May 28th at 7:37PM EDT (link)No less than Obama himself did so during the Judge Roberts nomination. Heard that on Brian & the Judge this morning.
She needs to be Borked, bad. For any Republican Senator thinking of voting for her, I say you won’t remain in office long enough to vote in Obama’s next radical.
If you fight a street fighter using point karate rules, you'll get your head handed to you every time.

Why the Republicans feel the need to be slaughtered at every opportunity is “beyond my pay grade.”
Somehow there is honor in dismal failure?!
The Republicans violate every other conservative principle there is, but when it comes to dealing with the most hateful people on earth, they feel we must “play pretty”. Let me re-phrase my earlier comment. Beats the crap out of me why!

Soto' has a disdain and lack of respect for the Constitution
olsmithie Thursday, May 28th at 5:44PM EDT (link)She shares that trait with the AG, who has stated he didn’t recognize certain SC rulings.
That seems to be the major factor in picking a nominee in this administration, they must be willing to disregard the Constitution.
She ruled in 04 that a state could violate the 2nd amendment, and over half of her rulings appealed to the SC were overturned.
She has a record of screaming at lawyers who present arguments she doesn’t agree with. This one is a real piece of work.
Yes she is a great jurist! I guess personal preferences trump the Constitution.
If my remaining Republican Senator lets this go unchallenged I will dog him as long as he holds the seat.
There is no excuse to let a poor judge, with a racial prejudice go to the court unchallenged. Time for the Rpeublicans in the Senate to show some backbone! The countries future is at stake.

Jay Nordlinger makes a very interesting observation about "Hispanic"
olsmithie Thursday, May 28th at 11:28PM EDT (link)“An interesting word, and concept, “Hispanic.” I have many Cuban-American friends, in South Florida and elsewhere. They rarely call themselves Hispanic, and they, in turn, are rarely called Hispanic. Why? Well, it’s kind of a political term, isn’t it? It relates to the grievance culture, to affirmative action, to apartness. “Hispanic” is not so much E pluribus unum as “diversity” and “multiculturalism.” “Hispanic” is for those who don’t want to melt into the pot.”

The Death of Our Constitution and Democracy
avgamerican Thursday, May 28th at 11:14PM EDT (link)They saw the Jeremiah Wright video. They heard him degrade his grandparents in defense of Wright. Americans elected a monsterous ideologue. A liberal McCarthy on steroids. The media protects him and they will protect this female in a black robe the same way. The Bill of Rights is only a matter of opinion to these nuts. There are no more checks and balances in this government save 3 maybe 4 Supreme Court Judges. Liberal tyranny marches on and our country’s existence hangs in the balance. I believe the time has come for another publication of another book, “Common Sense.”
