Judge Clay Land: Great American Hero

Clay Land is a Federal Judge in the Middle District of Georgia, Columbus Division.

He is a Bush appointee and a solid guy. When I was a lawyer we has some interaction.

Today, he threw out Connie Rhodes’s lawsuit. That lawsuit is the one filed claiming Rhodes cannot be deployed to Iraq because Barack Obama is “not constitutionally eligible to act as Commander in Chief of the United States armed forces.”

According to Judge Land, “After conducting a hearing on Plaintiff’s motion, the Court finds that Plaintiff’s claims are frivolous. Accordingly, her application for a temporary restraining order (Doc. 3) is denied, and her Complaint is dismissed in its entirety. Furthermore, Plaintiff’s counsel is hereby notified that the filing of any future actions in this Court, which are similarly frivolous, shall subject counsel to sanctions.”

Also, Judge Land notes, “Plaintiff’s counsel is a self-proclaimed leader in what has
become known as ‘the birther movement.’”

I love that he called it the Birther movement and I love that he said he’d impose sanctions if the lawyer even attempts to bring this back up in his court.

Clay Land is a great American hero.

    Not really, but his birth certificate says that he is, as reported by the Honolulu Times back when he was born, so the point is moot.

    As to the other Qs, I have no idea, but none of those should be considered in a legal argument, as Obama is perfectly within his rights to commit to all of the actions that you mentioned, even if he is hiding something (which he undoubtedly is).

    He must be either Kenyan or Indonesian. Not sure what we can do about it since the courts are in tank for him. Can’t trust them any more than the “official” 9/12 march count when we know it at least 1.7 million like Beck said, proven by the university count.

    saying it was only “tens of thousands” when we know it’s been proven by university count that it was at least 1.7 million, they can lie about his nationality and religion.

    you’re drifting into the realm of conspiracy theory. Hey, I like Glenn Beck too, but he’s not the most accurate of observers 100% of the time — you need to take him with a grain of salt. As I understand it, there is no statutory guidance for enforcement of the constitutional requirement of being a “natural born citizen” for presidential eligibility, and President Obama has met all the traditional requirements of being vetted by the media. Perhaps that will change in the future (I believe at least one Congressman has proposed requiring more detailed proof of citizenship), but for now, Judge Land ruled appropriately, refusing to substitute his ideology for that of the legislature. That said, I’d probably stop short of calling him a “great American hero”; doesn’t leave alot of room for Washington, Lincoln and the like.

    Beck is not a birther and hasn’t supported the birthers. No reason to drag him into this.

Like I said, I like Beck, I watch him every day, and I’ve never heard Beck say anything in support of birthers (or the march count, for that matter) — but I do think Beck occasionally goes over the line rhetorically.

    Once it got to the point where the Birthers were indicating that Hawaii *Republican Governor Laura Lingle had to be in on the conspiracy because she wouldn’t allow the “real” birth certificate to be shown, I completely walked away.

    Besides, the best comment I’ve heard about the Birthers is “Success doesn’t get you President McCain, it gets you President Biden or even President Pelosi”.

    I’m not really sure who the Birthers want to work down to in the order of Succession: It goes Biden, Pelosi, Byrd, Hillary, Geithner, Gates, Holder…

    or source for this “university count”; I haven’t seen it? I have seen the Metro numbers released for that weekend, which if I recall correctly would point to a crowd size of 400-500K. I have no no problem believing as many as 700K, maybe even 1M, but a 1.7M number would seem wildly inflated.

    Come back when you’ve done so, and be prepared to tell us where it says the election of the Vice President is connected to the election of the President. Also, read the Constitutional provisions for succession, and related portions of the US Code.

    I’d personally like it if we elected Palin into the House, maybe an Alaskan rep can take one for the team and resign. Then she could be elected majority leader and brought in as the new, rightful President.

    But I’d support almost any Republican over the Faker-in-Chief.

    Seems like a reasonable decision by Judge Land. It’s virtually certain that Obama was born in Hawaii. Nonetheless, President Obama should still release a copy of the birth certificate printed in 1961, to clear the air.

    Obama is the President because he won the vote in the Electoral College. Period. Every thing he’s done as President is legit because he the guy that got the most Electoral votes and then took the oath of office. If SCOTUS declares him illegible to be President, the order isn’t retroactive and doesn’t undo anything he’s done as President. All that would happen is that Obama would cease to be President and we’d follow the 25th amendment… so Biden gets promoted.

    And the odds that SCOTUS would even agree to hear the case is remote as finding breathable oxygen in space and that’s not even considering the complete lack of evidence the Brithers have. They are a complete embarrassment to themselves and I wish they’d just shut up.

    So, your lunatic thoery has several steps:

    1. Obama would get thrown out. Doubtful, seeing as how he was, you know, born in Hawaii and all. Not to mention the fact that the state of Hawaii has confirmed – twice – that his original BC states that fact. Also, not to mention that the copy of his BC that has been online for over a year, is the same copy any Hawaii resident would get when requesting a BC, because all BCs have been computerized.

    - But reality doesn’t matter – moving on!

    2. Biden would then get impeached, although he has committed 0 impeachable offenses. Good luck there.

    3. Then Alaska congressman Young (there is only 1 Alaska rep, but its ok, keep following along) would decide to resign. lol..yea ok, Young should think about resigning as we speak considering how tainted he is.

    4. Palin would then have to win election a state wide election for his seat. This, is by far, the most reality based contention that you have made.

    5. Then, this freshman congresswoman would become majority leader, even though the Democrats have the majority and the majority leader in the house (and the Senate for that matter) are not in the line of succession. So, scratch that, she would need to become Speaker of the House, and obviously the Democrats with their huge majority in the House would not only elect a Republican to be Speaker, would not only elect a Freshman congresswoman, would not only elect a Republican, but would also elect Palin; a figure despised by the left.
    - Oh, I made a mistake, you want to wait til the Republicans take back the house. Ok, yes, it is logical, of course, that the Republican leadership in the house, members who have been jockeying for their positions and have that Speakership in the back of their minds would allow freshman congresswoman Palin to leap frog them all…of course…its almost as likely as the prior situation happening.

    - Again reality doesnt matter -

    6. Finally, she is appointed the “rightful” president. Unfortunately, because your timeline puts her getting elected after Biden is impeached, the Speaker of the House at the time would actually be President and Palin would still be a freshman congresswoman.

    I’m glad I explained that all to you. I hope the words were not too big for you to understand. Now, go read the Constitution; its easy to find. Try Google.

    It’s quite likely that Obama was born in Hawaii. But no legitimate proof has been provided. All most of us “birthers” ask is that he present the official long form. That document is what would be required for so many other things today, such obtaining a passport.

    And why has Obama spent $1M to keep from providing this information? That’s the other part that bothers so many of us. What is he hiding that he’s willing to spend such a huge sum?

    I’m sure someone will offer the opinion that no matter how much evidence is provided, some won’t believe it. That’s not true for the majority of us “birthers”.

    I did the analysis of the still frame taken from the building overlooking PA Ave and 14th st NW. It is easy, from the capital building to that point can easily hold 60-70k. I haven’t even counted the side streets yet.

    the question is whether he is a natural born citizen. Look at naturalborncitizen blog for some information. It appears that one requires to have 2 citizen parents to be a natural born citizen which, of course, he doesn’t.

    but the birth certificate that Obama placed online is prima facie evidence in ANY court proceeding. And as far as the State of Hawaii is concerned, Obama was born there, because that’s what it sez on his certificate. You might not like it, but that’s ALL Obama needs. Seriously. That’s game, set, and match.

    But beyond that, Snopes has posted a great deal more proof, including a quote from the Director of the Hawaii Department of Health that he’s personally verified the long form and that Obama was born in Hawaii. Of course, this isn’t good enough for you… why??? I don’t know… maybe you need some of that free socialized medicine or something.

    The absolute obsession with “all things birther” is really not helpful; with all of the attacks to individual liberty that are being proposed by the administration and congress, anti-birther columns seem to come up as much as any other topic. It’s unhealthy. The birthers are a side show, keep your eyes on the real threats.

    Despite my comments on this thread I don’t consider myself a birther. I just want some simple answers to simple questions that every one of us here could provide about ourselves.

    I know that’s a minority position, at least for those who post comments, but it isn’t as crazy as it sounds. And I think a lot of other people have similar questions about the enigma-in-chief but start/prolong infighting by mentioning them.

    Provide my birth certificate, that is. Amongst my multiple moves during and right after college, it was lost. So all I have is something called a “Certificate of Live Birth” from the state of Oregon, since they don’t give out duplicate birth certificates.

    Fortunately for me, the vast conspiracy put in motion to ensure illegal-immigrant Obama could be elected President without a *real* birth certificate has been in place since at least 1995, when I began using the CoLB to get my replacement Social Security card (lost that too), drivers license, etc. So I’ve been able to vote and do all sorts of great citizen-only things since then, thanks to the conspiracy making sure the CoLB and similar documents were acceptable.

    So that now brings to two the number of things I have in common with our President (the other involves dating women from Punahou, the high school he went to).

    Obama’s dream in 2012 is that the Republican Nominee for President at least partially buys in to the Birther beliefs.

    The only major likely candidate that I can imagine doing that is Palin. I just can’t see any of the other likely candidates doing so, especially Romney.

    I just happen to think the more of the 2012 Campaign that talks about whether Obama is legally able to be president, the *worse* it is for the Republican Party.

    This of course assumes that the Birthers can’t find anything more useful than they have so far.
