Rape and Ken Buck’s Record

The left never ceases to amaze me in their willingness to use people to tar and feather their opposition through half-truths and lies. In much the same way the NAACP used the murder of James Byrd to attack George Bush with a series of lies, the left is doing the same with a rape victim in Colorado against Ken Buck.

The Colorado Springs Gazette covers this pretty extensively and shows just how disgusting it is.

The case stems from an alleged date rape and Buck’s decision to not prosecute the case. Buck, in explaining why to the victim, said that the jury would more likely than not let the guy off because of evidence the defense had. He sent the case to another District Attorney to review and that District Attorney agreed with Buck.

As the Colorado Springs Gazette explains:

Date rape convictions are especially unlikely. Typical cases consist of “he said” v. “she said” and not much more. The defendant has the advantage of a presumption of innocence; the victim is burdened with providing proof. Throw alcohol into the equation, and conviction becomes even more far-fetched. Add a hint of seduction by the victim, such as partial nudity before going to bed with a defendant, and conviction becomes almost impossible. Even jurors who want to convict cannot do so lawfully without proof beyond reasonable doubt.

That’s what Buck faced when he explained to the victim why he could not pursue conviction. He explained with compassion that a jury would not convict because of information the defense would use. He said a jury might interpret her complaint as “buyer’s remorse,” a statement misrepresented by opponents to make it sound as if Buck questioned her motives. Buck advised her of other legal remedies but warned that they may lead to hurtful defense attacks. To be certain he was making the right call, Buck asked the office of then-Boulder District Attorney Mary Lacy, arguably the state’s most aggressive sex crimes prosecutor at the time, to review the case. Lacy’s prosecutors concurred with Buck.

Never mind that Ken Buck has an impressive career of locking up rapists and murders. In fact, some of the victims have come forward to defend Ken Buck. But that doesn’t matter to the left in Colorado. They are doing what they can to distort Buck’s record and smear him.

Ken needs to be able to fight back folks. Give what you can.

    Thank you for addressing this subject. I find this extremely true, especially in the case of election politics.
    It has been extremely difficult to find quality candidates to run for office when they know that their entire family is at risk of left wing smear tactics.
    These prospective candidates know that the allegations heaped upon them by the democratic party do not have to be true to be effective in destroying both their professional credibility and their family. Even their children are no longer exempt.

    This is disgusting. This is akin to what they are doing to Rick Scott. Scott was never charged, never convicted, nothing, yet he is treated like a criminal by the Democrats. I am an attorney and know what they can do for you as I ran for re-election to the State Legislature in my state only to be attacked in much the same was by very liberal Republicans. I understand now what happened. We now have a socialist in the State Legislature as a Republican because of these tactics. Let’s beat the heck out of these Democrats. I am very upset. I hope both of these men are going to hit this right on the head. Their races have the money to do so, I did not. God bless both of them. I will be praying for them. Prayer can do more than anything else, and then we need to act upon those prayers.

    Stay the course, we are in the process of changing the way America has become. We have fielded good candidates in Delaware and as you know, they are being heavily attacked as they attempt to discuss the issues.
    You are correct, these people really needed money to turn the tide.

    Things could be worse – you could be in South Carolina, an essentially one-party state, where those who want power (Democrats, really) are thrown into the same party with those who want to prevent the abuse of power (ordinary Republicans).

    What would help? Overturning the Supreme Court case of NY v. Sullivan would allow public figures to sue for slander and libel. Just the threat of their being able to do so, would help deter those people who have assets from engaging in lies and smears and would also make running for office something decent people might be willing to subject their families to.

    Just a thought from a survivor….

    They keep going back to the same old tactics because they work. We need to come back immediately after the stupid attack is made and turn it on them. We are just more upright and can’t believe they said that because we know the story, but others don’t. Explain and then attack them -hate it, but it works.

    I have to take issue with Terry H’s “dumb voter” assessment.

    This is the identical argument that Obama and his Marxist abettors in Congress are using for explaining the electorate at large rejecting his major policies, unprecedented government expansion and massive deficit spending.

    The voters are wising up to this cabal and their shameless antics. November 2 will confirm that.

    I’m living in Colorado now and can tell you voters are being absolutely inundated with lying or misleading television ads attacking Ken Buck. I’d guesstimate the number of ads against Ken Buck ( I don’t say “for Bennett” because Michael Bennett appears to be running an almost entirely negative campaign – have maybe once seen an ad that actually talks positively about him) outnumber the pro-Buck ads at least 10-1 and probably more like 20-1. And – on the rare occassions I have seen a pro-Buck ad it has ALWAYS been followed by one attacking him.

    Most of the ads are payed for by the Democratic Campaign Committee – Bennett has outraised Buck by only about half a million dollars but Buck is getting buried in terms of television presence.

    Anyway – just wanting to underline Eric’s point about attacks on Ken Buck – and let folks know Democrats have fully invested in this race.
