But yes, on most issues Kennedy has been with us, esp on religious issues, but there are some rumblings that since Alito has been the vote to replace O’Connor on those “Lemon” establishment cases, that Kennedy might “evolve” again. Keep a close eye on him.

As I count, it’s a 5-4 decision (Scalia, White, Rehnquist, and Thomas dissenting from the decision not to overrule Roe v. Wade).

Kennedy joined the wrong side here; the dissent is clearly better reasoned than the majority opinion.

But Kennedy has been a friend more often than a foe to conservatives according to my tally. He got it exactly right, for example, in Citizens United.
