Will Kagan leak the SCOTUS vote to the WH? ( but of course) Will the WH show that they’re about to lose? ( probably)

The Justices may today begin their deliberations on the fate of Obamacare. Though it often takes them months to write the legal opinions, usually they move rapidly to vote on cases they have heard….often within days of oral arguments.

From today’s Washington Post:

“In a town where secrets are hard to keep, the Supreme Court is a striking outlier. The justices and their clerks know the outcome of cases almost immediately, but it’s rare for rulings to become known before the justices announce them.”

“It’s only a small number of people who know, and they just dont’ leak.”

“I mean, you’re sworn to secrecy.”

So we now come to the question of Madame Justice Elena Kagan, who by any reasonable standard should have recused herself from the case. The former Solicitor General, who was instrumental in attempting to formulate the administration’s  ( inept) defense of Obamacare ( and one could only imagine her, while watching the current ( as of now) SC,  Donald Verrilli give a truly inept performance) thinking…”boy, am I glad I’m NOT the one having to try and defend this puppy.”) is a political and ideological creature first and foremost, a hard core leftie.

Her question ( “isn’t it OK if we just let the feds give the states boatloads of money to insure poor people?”) demonstrates everything that is wrong with, and about, this woman.

But it’s worth wondering if, as soon as the vote is taken..Kagan contacts someone at the WH…maybe Holder, to tell him the bad news…it’s going down, and if it’s in fact by a 6-3 vote, that’s really, really bad news for Obama.

I have no doubt that Kagan will violate the traditions of the Court, and give the administration a heads-up. But the real question is how long before the upcoming defeat becomes common knowledge within the administration and how will they attempt to spin it.

Indeed, one can almost predict that by next week, simply by watching the behavior and comments of key Dems, we will be accurately able to call the Court’s decision.

The one to watch, especially…Chuckie Schumer…

    The Supreme Court is a very small club and its members are very jealous of their traditions.

    Leaking a decision would be really bad form and would likely earn her a cold shoulder from at least 7 of the other justices.

    Just my opinion.

      Perhaps one of her clerks has a roomie in the Obama administration… the court may not leak *much*, but the old saying that two can keep a secret if one is dead applies.

      I’m content to watch and wait.

    As of the time I write this; 4:30 est, you can be assured that the Obamanation already knows where the judges stand. With the unqualifed SJC Kagen in the loop, the administration absolutely knows. You will be able to decern this over the next few days based on comments and actions from the Administration. If Kagen had any credibility at all, she would have recused herself to begin with. And, should her vote come down in favor of the mandate, as with any other justice, they should, in my opinion, be impeached. I do not see how any other conclusion can be made other than the mandate fundamentally flys in the face of the constituion. To rule otherwise is not doing the job in which they were appointed. JustMHO.

    That’s a serious charge you make. You better have something to back it up besides the possibility of it happening. Anything’s possible.

      just staying one step ahead of the Chicago mobsters we have in the White House. Too many times we underestimate how evil the left has become and because of that we are caught off guard. What’s irresponsible is Kagan refusing to recuse herself. To think she would not tip off Obama to the final vote count is attributing integrity to someone who has already proven she has none.

        Judicial integrity clearly required Justice Kagan recuse herself. As you aptly said, there is much evil in the world that we must constantly be onguard for.

    Roberts should tell each of the four liberals in private that he’s asked a different person to write the majority opinion, then when the leak occurs, VOILA!!! assuming it includes a “rumor” of which justice will write the majority opinion.

    Then when he lays the hammer on the leaker, the Dems and their press lackeys can scream that he should be impeached for lying to 3 of the 4 liberal justices.

    would be a game changer. Gone would be the meme that Republican appointees are to blame. (Of course it’s never partisan when the left votes as a block.)

    Still, I’ll take a 5-4 win. But 6-3 to quash Obamacare would be wonderful, and would not shock me.

        Ginsburg was very interested in whether the mandate was being treated as a tax (as in social security or medicare). Of course with the taxing power, congress can take money for just about anything. But it sounded to me like she doesn’t think it is a tax, and so it wouldn’t surprise me if she gave it the thumbs down.

          After seeing that it’s a losing cause, could she now recuse and abstain from participating in the decision? She could then save some integrity, on the face of it.

            Should have recused herself–Strike one.

            Seemed pretty clearly to be trying to prop up the Admin case during questioning–Strike two.

            Strike three would be a leak traced back to her. It’s supposedly never happened, but…

            If she truly is as amoral as described above by WCP and 770, anything is possible and maybe even likely. But we only know she has poor judgement. Pretty unfortunate for us since she’s on the SC.

            We don’t really know she’s corrupt just because she was picked by a corrupt President. Harry Truman was thought to be a hack politician when he was picked to be VP, because of his close association with the Pendergast machine. To give some respect to FDR, he must have seen something in Truman that others missed. Or, he thought he’d live forever.

    Has there been a leak? If I knew I was winning I’d stay quiet as a mouse, but then I’m not Barack Obama.

    it just doesn’t happen. Well…once more than 30 yrs ago.

    We are just going to have to wait until June, and no amount of speculation is going to change the outcome.
