Chuckie Schumer signals that he knows that SCOTUS will vote to overturn Obamacare

Friday afternoon, I posted a diary ( the link to which  appears at the end of this one) wondering if Kagan would break with centuries of tradition, and leak to the WH the result of the justices’ vote on the Obamacare debate, before it is announced in JUne.

I felt sure that she would do so. I also felt that other key Dems would of course  soon learn of the outcome. I believe that by their behavior, body language, and comments, we could soon devine what the decision will be.

I also predicted that Chuckie Schumer would the the Dem most likely to give it away.

Would that I could instead pick the winning LOTTO numbers, but I was spot on in picking Schumer as the one most likely to give it away.

Any doubts, just watch his appearance on Meet The Press today. When asked about the pendign Obamacare decision, Schumer appeared tired, beaten..just going through the motions of complaining about the “evil” Republicans, mouthing ad nauseum the same old tired leftie canards. Anyone who knows Schumer, even remotely, just by his plethora of appearances in front of a camera, any camera, could easily tell that his heart wasn’t in it, because there’s no point in beating the proverbial dead horse.

Kagan’s spilled the beans. She’s  informed the  WH of the vote. And I suspect that Chief Justice Roberts is going to make life really, REALLY miserable for the Dems. He full well knows that even if he is on the SC for decades to come, his success of hiscourt, his legacy, will be determined by this decision.

And he doesn’t want another 5-4, a la Bush v. Gore.

I suspect that Roberts will somehow manage to persuade one of the assume leftie 4…most likely Breyer, to make it a 6-3 decision.

And Chuckie Schumer’s life is about to get a whole lot worse. GOP control of the WH, the House, AND the Senate, and all Schumer can look forward to next year is a battle with Dick Durbin in the Senate Dem caucus over who will be the next minority leader.

Couldn’t happen to a nicer guy…..

    until you wrote that diary, it never occurred to me that one of the lefty Supremes would leak the decision to Obama (I am just too trusting to think of things like that) but I immediately agreed with you that that is exactly what would happen. The left has become little more than Chigago-style thugs who stop at nothing to force their agenda anywhere they have a chance. Furthermore, Kagan proved she has no integrity when she refused to recuse herself from the case. What’s the biggie in breaking the secrecy pledge and letting Obama know the outcome? From one crook to another, it’s just no biggie.

    Or just bad form – loss of respect? How big of a deal is this secrecy pledge? Just how much clout does Roberts have regarding the other justices anyway?

    I’m pretty sure that would be a serious breach of ethics that the Chief Justice would not tolerate. He could launch an investigation and recommend disbarment and/or impeachment if she were found guilty. I think Kagan likes her job too much to possibly lose it.

      it would only be a breach of history, tradition, and class, not anything up to the level of any form of discipline.

      Not too mention, how do you prove it.

      who as Solicitor General had to have been involved with Obama Care, & has not recused herself, would take it one step further is not beyond the pale. Acolytes of This Administration do not have a decent public record of truth telling , or much of anything honorable.

      To any who might dispute this, please post some positives . Love to see ‘em.

    There’s no need for a leaker. We can all read the tea leaves. Only question is whether it will be 6-3 or 5-4.

    Schumer’s despondency does not prove there was a leak.

    Don’t count your SCOTUS decisions before they are written. The vote is not binding until the opinions are written and the decision issued.

    The Obama administration will either try to subvert or intimidate the Supreme Court and individual justices.

    The WH….as with EVERY…and I mean every other major decision has gotten out in front of something and CHANGED it to make it appear as something else, i.e., the First Amendment vs Catholic Church into Rush and Contraception.

    The Obama Administration has NEVER not allowed a decision or a statement to stand where they have been at fault…or if you will, lose.

    Do I think that Kagen would leak…sure I do. She should have recused herself because she worked on the bill when it was being formed. Her e-mails show a bias…however, did she do it…NO. If this administration won’t adhere to our Constitution…what makes us think that one of his minions would play by the rules???????

    because everything’s so polarized now.

    I didn’t mean to, but I shot down the hopes of a guy I know the other day. He was real happy about the way these arguments were going. I told him I am tempering my expectations. Why?

    We live in a narcissistic culture. Going way back to Socrates, thinkers have realized that those in government reflect those in the society. My concern is that Kennedy (who will, in all likelihood, be the deciding vote) will wake up/woke up with a narcissistic streak and want to ‘make history’ by making a skewed, unconstitutional decision.

    I sure hope you’re right, gawken, but I’m not going to get my hopes up.

    She gets to play the long game, so no need to leak. Besides, Roberts would admonish her for doing so; and Breyer and Ginsburg would go along with Roberts in the admonition.

    Why would Kagan befoul her own bed?

      she is already drawing the lines and creating a possible ‘new normal’ in acceptable judicial review.
      After all, If A Supreme can do it……., and then we have Precedent.
      That can be expanded, and then it grows,from the top, on down.

      Maybe not befouling, but hardly routine.
