Senator Paul Stands for Freedom

Jefferson Smith and Rand Paul's Filibuster

Last week the nation watched as Sen. Rand Paul, in an epic move to protect the freedoms of millions across the nation, during a filibuster on the Senate floor lasting over thirteen hours.

This filibuster, which was driven by Paul’s determination to preserve American’s freedom, reminded many of the fictional character Jefferson Smith, forever made memorable in the 1939 movie Mr. Smith Goes to Washington starring James Stewart and Jean Arther.

Smith entered the political arena suddenly after the sudden death of a U.S. Senator from the state of Montana.  Smith, a student of history and leader of the Boy Rangers a boy-scout type group, arrives in Washington with utopian ideas of honorable men serving in the legislature, but is surprised at the vice and corruption.  After drafting a bill for a summer boys camp, Smith unwittingly heads straight into a collision with his state’s political machine.  This leads to endless hearings which attack Smith as a man who has an underlying agenda,  what happens becomes a beautiful tale of a man willing to sacrifice all to stand for what is right, no matter the consequences.

Taking the Senate floor Smith speaks for hours on end knowing that if he gives up the floor for anything but a question he will be losing the floor and his cause…The best part of the tale is that Smith wins and good conquers over evil.

Similarly Rand Paul took a stand to stop the vote which would confirm John Brennan as Director of the Central Intelligence Agency.

As Paul, said at the beginning of what would become a thirteen hour talking filibuster,

“I rise today to begin to filibuster John Brennan’s nomination for the CIA. I will speak until I can no longer speak. I will speak as long as it takes takes, until the alarm is sounded from coast to coast that our constitution is important, that your rights to trial by jury are precious, that no American should be killed by a drone on American soil without first being charged with a crime without first being found to be guilty by a court. That Americans could be killed in a cafe in San Francisco or in a restaurant in Houston or at their home in Bowling Green, Kentucky, is an abomination. It is something that should not and cannot be tolerated in our country. I don’t rise to oppose John Brennan’s nomination simply for the person. I rise today for the principle.”

Sen. Paul took a strong stand to defend our rights as guaranteed by the fifth amendment, which reads:

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

What is the purpose of having drones in our nation which may or may not be used against our citizens?  This is the question that drove Sen. Rand to take such a drastic measure– this is something that concerns every citizen of the United States.  We need to know that we will be safe and will not be in danger of losing life, liberty and property without due process.

The outpouring support which was brought to Paul’s attention would later overwhelm him and though he did not receive as prompt a response as had been hoped, he believes a stir was made and hopes the rights of citizens will be protected.

The outpouring of support for my filibuster has been overwhelming and heartening. My office has fielded thousands of calls. Millions have followed this debate on TV, Twitter and Facebook. On Thursday, the White House produced another letter explaining its position on drone strikes. But the administration took too long, and parsed too many words and phrases, to instill confidence in its willingness or ability to protect our liberty.

I hope my efforts help spur a national debate about the limits of executive power and the scope of every American’s natural right to be free. “Due process” is not just a phrase that can be ignored at the whim of the president; it is a right that belongs to every citizen in this great nation.

Senator Ted Cruz of Texas, may have been one of the first to liken Sen. Rand Paul to the character of Sen. Smith from Mr. Smith Goes to Washington.  He was certainly right.  Our freedoms will always be important and it is worthwhile to fight for them.

    What do you say we keep beating the drum for Rand Paul? Great diary about a great man. It is getting harder for people to ignore him as well as his message.

    Rand Paul stands for insanity & paranoia…

    Of all the issues to do a ‘Mr Smith Goes to Washington’ on, he picked one that is so out there, it can only drag the party down….

    He might as well have done a fillibuster demanding Obama present him with a Zombie Apocalypse Survival Plan or what-have you…..

      Again Rand Paul filibustered because Eric Holder answered in a round about way in the affirmative that govt. had the right to use deadly force against an american without trial or due cause based solely on suspicion of terrorism even if said American did not pose and imminent threat
      Rand Paul never said Obama or any administration in the near future would do this, it instead had to do with whether or not they could
      You might think the Constitution is inconvenient at times that however does not give you the right to toss it out whenever you want
      Nixonian Republicans are dying off fast you sir are legally classified as an “endangered species”

        The Constitution is a bit inconvenient at times to those in Washington, but in times like this we see what the Constitution is really here for and we are further shown the necessity of balance of power and checks and balances.

          This is not a constitutional issue. It’s a ‘Paul is a lunatic just like Daddy’ issue.

          The chance that any US President will ever use lethal military force (drone delivered or otherwise) on a US citizen on US soil in ANY case other than open civil war…. Is about as high as zombie or vampire attacks happening anywhere other than a movie screen…. This isn’t the 30s, riot-control isn’t accomplished with bayonets anymore….

          Rand could have picked any real, serious issue to filibuster over – funding O-care, the deficit, the debt-limit…

          He picked a basement-bunker, tinfoil-hat-crazy issue instead…

          Which indicates that he is just as batshit-crazy as his Dad (See Elder Paul’s ‘Survival Report’ from the 90s for examples)

            I’m sure people thought no President would ever suspend Habeas Corpus or herd American Citizens into Intern Camps or that 26 states would forcibly sterilize thousands of Americans, those aren’t conspiracies or “tinfoil-hat-crazy” these are well documented historical events, most people wouldn’t have imagined the commerce clause being used to justify Obamacare either, you give the Federal Government an inch and they take a mile, sure tyranny can be benevolent and serve the vast majority well, but there will always be an oppressed group of people.

            Habeus Corpus: Legitimate Constitutional power – so it’s kind of odd that people might not expect it to be used, especially in the historical context (half the country in open, armed rebellion)… Yes, Lincoln jumped the gun as it’s a Congressional power, but Congress swiftly corrected that…

            FDR & the Japanese internment: Not even close to equivalent to what Paul chose as his ‘hill to die on’….

            Commerce clause: Once Wickard was handed down, what do you expect? Not exactly shocking, given the precedent prior to last June’s Court decision…

            say it what it was, it was American Internment camp, those people were denied their constitutional rights to due process when they were imprisoned due to their ethnicity, some people died in squalid conditions, also I notice you didn’t address my other points, your belief that the Government is inherently benevolent and would never abuse any of the power it gains is incredibly naive and not at all consistent with Historical facts. Are you Lindsey Graham?

            I believe that the powers the government is actively abusing are the ones worthy of attention… The overspending… The takeover of health-care… You know, stuff that is happening right now…

            Not the pie-in-the-sky tinfoil-fringe crap the Pauls have been ranting about since the 90s…

            It’s a question of priorities, and it is very telling in regards to the question of ‘Is Rand just a nicer-spoken clone of Daddy’…

        The Constitution isn’t an issue here.

        The fact that Rand actually considers this a realistic enough scenario to (a) ask (or have another Senator ask the question for him), and (b) then fillibuster over it IS the issue.

        It shows that he has the same paranoid-delusional beliefs as his dad, which is proving those of us who said the apple fell right next to that rotten & diseased tree correct.

        The GOP had a chance to quash the RELOV3UTION once and for all (back when Rand was just a candidate, more resources should have been spent to keep him from winning the primary), but we let this weasel become the heir to the Paulbot throne instead….

      Haha. Well, that’s your opinion and you’re entitled to it, but this is a legitimate issue and something that the Left and Right can come together on.

      In New Mexico we are passing legislation to restrict drones. Bi-partisan legislation.

        There is nothing that the left & right can ‘come together’ on…

        Restricting law-enforcement use of UAVs (which are, with the exception of 2 specific models, all unarmed) is an idiotic move, that just raises the cost of government by requiring an actual manned aircraft to fly the same tasking – be it traffic patrol or overwatch for a car-chase….
