		<description><![CDATA[but having worked as a non-unionized lifeguard, I&#039;d say this is a reg that will cause more harm than good to it&#039;s intended beneficiaries before you even get to the question of harm to everybody else.

We had a paraplegic (who ironically became one because of a stupid stunt he pulled on the premises when the pool was closed) who routinely came to the pool with his care takers for exercise. No special equipment, just roll the chair up to the side of the pool and the caretakers lifted him into the pool. It was one of the best ways for him to get exercise. Even so, him being at the pool unattended would have been an invitation to disaster. So the caretakers really need to be on site anyway and there shouldn&#039;t be a legal burden on the pool.]]></description>

		<description><![CDATA[We live and breathe ADA regulations continually in our business - civil engineering site design.  You would be shocked at the amount of expense that businesses have to pay to &quot;accomodate&quot; some very ridiculous things.  We have even had numerous cases where state regulations conflict with federal rules and it takes months to get an answer as to who &quot;rules&quot;.  Outdoor locations (like the pools) seem to have the most restrictive problems. ADA regulators have shut down several really nicely developed walking trails along creeks in our town simply because there is no reasonable way to accomodate getting someone in a wheelchair down to the beginning of the trail.  Or there is one 10 foot section of the trail that is impossible to maneuver.  So the answer is - the 1 in 500 in a wheelchair can&#039;t use it, so nobody does.  Why is that a reasonable answer?  The government is spending billions of dollars &quot;updating&quot; old historical sites throughout the country to make them &quot;ADA friendly&quot;.  Some just won&#039;t work and they are being forced to shut them down. We heard that there is talk about shutting down parts of Yellowstone and the Grand Canyon due to access issues. Budget was always a priority, and every year there would be a long debate over whether or not to continue operating the city pool, which cost the city a roughly 40,000 budget deficit annually to keep open when the city was running about a 400k deficit.   It always managed to squeak by despite the fact that it could not be afforded, because it provided one of the few publicly available reliefs from the oppressive Central Valley summer heat.

That debate has now ended.  Thank, you Mr. Obama, for simplifying the operation of city government for us.

This is a classic example of the stultifying result when the left is allowed to determine equality of outcome.  Now, instead of just a few not having access to the summer heat relief....... nobody will.]]></description>

If someone is so disabled that they can&#039;t get into the water without a lift, then many pools would have to be filled in because they would be too deep for those people to safely be in.  It also wouldn&#039;t surprise me if those lifts could be a danger to children as well.

I can see how they forced hotels to give up diving boards, that&#039;s an accident waiting to happen, because many hotel pools aren&#039;t deep enough for a diving board to be used safely.
