How can we be even reasonably sure that someone who bases their entire identity around a sexual act will not base judgements around that same act? I have 'gay' marriage cases in mind especially, like Vaughn Walker.

@ social conservatives: Every aspect of the economy which you participate in is affected and administered by sinners. Every one of your customers, employers, and employees is a sinner. Every corporation that you admire is staffed by sinners. Regarding homosexuality, anywhere from 2-5% of the population has homosexual inclinations; around 4-8% of homosexuals and heterosexuals have had a same-sex sexual encounter. Homosexuals are statistically high-income earners and are over-represented in such fields as fashion and finance. Chances are that some product that you are buying and using had significant input from practicing homosexuals, and that your money is enriching a homosexual in some way. Bottom line: homosexuality has nothing to do with a person's business ethics or the quality of their goods and services in a free market; same goes for their ability to judge. Get over yourselves.

@ gay rights activists and assorted touchy-feelies: thousands of people get law degrees every year; plenty of those people have the drive and general schmuckiness to succeed in the political arena as either appointed or elected officials. People are denied appointed position for any number of "unfair" reasons ranging from personal background to politically-incorrect statements, reasons which have nothing to do with their competence as appointees. Public image matters -- if it makes you feel any better, plenty of Southerners with strong regional accents are denied public jobs for similar reasons all over the place. The fact of the matter is, Republicans operating at that level don't give a flip about your sexual orientation; they just realize that some idiots do and that said idiots vote. It's not a conspiracy against the public, it's marketing. One schmuck getting denied a job in favor of another schmuck for imaging reasons happens all the time, and will continue to happen in perpetuity. Don't worry, we're litigious enough as a society that this guy will hardly be wanting for employment.

Yes, regarding judgment before the law, you are correct. James speaks directly toward showing favoritism and the comprehensive nature of the law. James is not speaking to the issue of homosexuality - although it is covered in the law - nor to its implications. To take you argument to its logical conclusion, because we are all sinners then we cannot condemn sin at all and cannot deny the bench to any sinner. If an axe murder will objectively uphold the law then why should he be denied a place on the bench.

To understand homosexuality and its societal impact, you have to turn to Paul and Romans 1:18-31.

It was Jesus's brother James who said "For the person who keeps all of the laws except one is as guilty as a person who has broken all of God's laws." That being said, can you name for me any judge out there who is not a sinner? Haven't all sinned and fallen short of the glory of God? Adulterers and liars are sinners just like homosexuals. The wages of sin are death, regardless of the sin ... they are all equal. If memory serves, Jesus rebuked the Pharisees for acting as though they were better and more righteous than others, because all of us are unclean.

Griffin makes a good point above. If the Judge would ignore the law (which very well could be the case and is worth exploring) then he should be rejected, if he upholds the law objectively however he should be seated.

Why is opposition to the appointment of a homosexual to the bench wrong? Ideology is important. So are first principles and the view of current law.
