Sen. Coburn Forces Reading of 767-Page Amendment – Sen. Baucus Admits Senators Don’t Understand the Bill

UPDATE: In response to the Republican effort to force a reading of the Sanders’ single-payer system amendment, Senator Sanders took to the floor and withdrew his amendment.

As you would expect, Jim DeMint immediately supported the effort, and by several accounts now, it seems that Senator Coburn was encouraged to carry out this strategy by Republican leadership – who are saying they are committed to stopping the bill. Now, the Senate is back to processing amendments – business as usual, after about a 3 hour delay. The question is, what will GOP leadership do next?

A short time ago, Senator Tom Coburn (R-OK) objected to the the unanimous consent request that the “reading of the amendment be dispensed with” when Senator Bernie Sanders’ (admitted Socialist – VT) single-payer amendment (SA#2837), totalling 767 pages, was called up. According to one calculation, this could take 38 hours to read. It is notable that there are two co-sponsors: Sherrod Brown and Roland Burris.

Now, THIS is how you fight the kind of assault on freedom this healthcare monstrocity represents. Leave no tool unused – force the Democrats to face up to an American people who overwhelmingly do NOT want this bill.

BUT, it’s gets even better.

Right before he did that, Senator Coburn asked unanimous consent for an amendment that would, in effect, certify that all Senators have read and understand the bill.

Senator Max Baucus (D-MT) objected. The specific excange, notable in its absurdity, can be seen here. The specific text follows, and you can see a general summary of today’s floor proceedings here.

MR. COBURN: MR. PRESIDENT, I HAVE ANOTHER UNANIMOUS CONSENT REQUEST. FOLLOWING CONSENT REQUEST WOULD BE ASSOCIATED WITH A COBURN AMENDMENT THAT WOULD CERTIFY THAT EVERY MEMBER OF THE SENATE HAS READ THE BILL AND UNDERSTANDS IT BEFORE THEY VOTE ON THE BILL.

ONLY TWO SETS OF PEOPLE, SENATOR REID AND HIS STAFF AND C.B.O. KNOW WHAT’S GOING TO BE IN THE BILL. I SUSPECT SOMEBODY AT THE WHITE HOUSE MIGHT. BUT WE OUGHT TO — WE OUGHT TO TAKE AND EMBRACE THIS IDEA OF TRANSPARENCY AND RESPONSIBILITY THAT THE AMERICAN PEOPLE CAN EXPECT EVERY ONE OF US TO HAVE READ THIS BILL PLUS THE AMENDED BILL AND — AND CERTIFY THAT WE HAVE AN UNDERSTANDING FOR WHAT WE’RE DOING TO HEALTH CARE IN AMERICA WITH THIS BILL. I CERTAINLY AGREE WITH THE BASIC UNDERLYING IMPORT THAT WE SHOULD KNOW WHAT WE’RE VOTING ON HERE. I MUST SAY TO MY GOOD FRIEND THAT PRESUMES A CERTAIN LEVEL OF — OF PERCEPTION ON MY PART AND UNDERSTANDING IN DELVING INTO THE MINDS OF THE SENATOR, THAT NOT ONLY DO THEY READ, BUT TAKE THE TIME TO UNDERSTAND? WHAT DOES UNDERSTAND MEAN? UNDERSTAND THE FIRST, SECOND LEVELS OF QUESTIONS?

I THINK IT IS IMPOSSIBLE TO CERTIFY THAT ANY SENATOR FULLY UNDERSTOOD. THEY HEY READ, BUT NOT FULLY UNDERSTAND FOR A VARIETY OF REASONS.

      It is about time as I’ve been demanding we stop the practice of NOT-OBJECTING to calls for “dispensing of the Reading of the Bill” and force these Bills to be Read into the Record AS THE BOZOS AREN’T READING THEM AND KNOWING WHAT IS IN THEM OTHERWISE!!! Plus, of course, it is the best tactic at derailing this garbage left. But, again, it is MCLAME that really has too many McCainiac followers and goes on and on with this “cooperation” BS (since he’s a Progressive himself, just a slower drip drip drip one). This “Honorable Senators agreement” BS so they won’t pull the tactic of “Reading” on us — well, guess what — they should!! WE should be demanding the Reading of OUR BILLS also into the Senate Record!!!! Maybe then they’ll start designing reasonable Bills that don’t purposefully drag on for 2,000 pages in order to hide so many things!

      If the Democrats want to pull the Speed Reader thing again, I wish they would, as it demonstrates how ridiculous they are!

    Either he can certify HIMSELF or NOT. Of course, most Senators won’t want to go on record stating that they knew what was in the bill. They think that being able to blame Reid is safe; that acknowledging total ignorance is a safe bet. Don’t they know that “ignorance of law is no excuse.”

      Senator Coburn is making them take responsibility for their vote so they can’t go pleading ignorance. ( which, in itself, is enough reason to vote them out of office) Baucus is intentionally pretending to misunderstand and treated the matter as a joke – I don’t think that’s likely to resonate with voters.

    The Democrats just bailed on expanding Medicare down to age 55 and his amendment is to expand it to cover everyone. If he wants to waste time, Coburn seems happy to help him do so.

    The Senators are ensconced in Washington. All the Dems and Lieberman are under a lot of peer pressure. They need some seperation.

    They need a weekend off to create some seperation from Obama and Reid. If they can this weekend off or if they can get to Christmas, a week or two at home will really hinder their momentum.

      Senator Coburn is right. The American people expect ( or at least should expect) that Congress reads and understands every bill they vote on. Every amendment of every bill should be read aloud – and discussed – in the House and Senate chamber before it is voted on. Obviously it will slow down the process but we’ve seen that Congress can waste months trying to pass Obamacare without getting much of anything done and the country survives anyway.

      The exchange between Coburn and Baucus is both hilarious and sickening.
      I don’t know how even Democrats can stomach the latter:

      “I think it is impossible to certify that any Senator fully understood.” and this is something we’re supposed to be ok with? Congress remaking 1/6 of the economy when they aren’t even willing to claim they understand what they voted on.

      Tom Coburn is brilliant here. It’s nice to occassionally feel that some member of Congress is genuinely representing you!

    I was beginning to question my affinity for Coburn and DeMint, as they have been shockingly absent from the important procedural side of this battle. I’m guessing that Coburn got the go ahead from the GOP leadership on this objection, which means that they are finally ready to play hard ball on this bill. They must also think that things have shifted away from them in the last two days significantly enough to warrant delaying tactics.

    This is it, folks. This is what we’ve been preparing for. Time to fight.

    The next step after reading the bill is to invoke quorum calls. The GOPs should demand that a majority of the Senate is constantly on the floor during the debate on this bill. One, quorum calls take up enormous amounts of time, largely because Senators don’t show up for them. Two, having 51 Senators on the floor prevents key Senators from participating in the “tinkering process” in Reid’s office.

      It only takes 1 Republican on the floor to demand a quorum. That means that 50 Democrats would have to come to the floor to meet the constitutional requirement. 50 out of 60 Democrats is a big blow to the negotiation process. If the GOP played this smart, 39 of them could stay off the floor (except for votes), but require 50 Democrats be present at all times. That would be smart tactics.

      I do (Grassroots Michigan discussion on the topic)…. You should call them and let them know how it is IMPOSSIBLE for us to be represented here in Michigan (or your State) and that you want/need them to stand up for YOUR VALUES as well as the values of Conservatives within their own State. This emboldens them and strengthens their position, giving them the increased power of representing the entire Nation as well!

    Rush had a portion of the Reading (I’ve got CSPAN on now and watching the reading) and it states: A CSHO may limit enrollment to avoid overtaxing of the CSHO resources!!!! And, of course, other portions go on to belie the whole BS line of what Democrats claim any/all of the HC takeover is for/about. Still allows limits, rationing, qualifications, etc….

    Though I am a native NY’er I have lived in Oklahoma for over 45 years and call it home. I have raised my family here & now my grand children are all grown and I have recently retired to take life a little easier. As my handle states 77redcounties, that is how OK. voted in the last election, not 1 blue county. I am proud to say senator Coburn is from this great state. Politics are a little kinder here, a lot less confusion, and a lot of good people here. The east coast and the left coast should look at the heartland and learn a thing or two about honesty and morals.

    One blow after the other on and on…Care police, fraud catchers, quality standards panels, appointed positions for death panels…

    My theory (a tactic which Erick does not agree with) is that the GOP was trying to move this along and try to get a vote on their amendments (hoping a deal breaker would be included), and if not get it to the cloture vote before Reid could cobble together 60 votes on something.

    With Leiberman now on board for voting on “something”, I think the GOP thinks that Reid has 60 votes now. That means their only hope is to slow it down and hope for someone to change their mind.

    They can probably force this to take until after Christmas for cloture. But we have to hope that someone on the Dem side has to change his mind about drinking the kool aid.

    As I said in a tweet to BS and Jeff E last night. This has always been an exercise in what the Dems can get 60 people to agree on. Thinking that the GOP can “kill the bill” is foolish. They’ve never had any way of killing this. The best they could ever do is to make the Dem self inflicted damage as great as possible, and hope that there is no legislative language that the enitre Dem caucus can agree on. More time has always been to Reid’s advantage for getting his caucus to 100% agree.

        I was using time in the abstract, not factoring in time Senators have to spend in their districts away from the pressure of the White House and Reid’s staff.

        My point is that if time in DC were infinite, it is to the GOP advantage to get this to a final vote quickly, while to Reid’s advantage to take as much time as he needs to get 60 clocks chiming at the same time (to steal a phrase from Ben Franklin).

        However, as you correctly note, time isn’t infinite, which doesn’t help Reid. He needs this thing passed before Christmas, just like he needed it passed before the August recess. Once they face the voters, things change. And Reid can’t afford change.

        My gut feeling is that timing has been crucial. The GOP needed to try and hurry in the beginning of the month. But once Reid seemed to find a way to buy enough time to get his caucus together (mostly by tabeling the bill to take on the omnibus), then the GOP needed to shift to a stall tactic to try and get to Christmas without passage.

        Now did the GOP time it right? I don’t know, they would say yes. Others say they should have started the stalling immediately. In the end, it really doesn’t matter. If Reid can get all 60 to agree to drink the kool aid and commit suicide, despite everyone, including the voters, telling them what an incredibily asinine thing that is to do, then the GOP can’t stop them.

        What ever happened to Senators representing their states, and not their party anyway?

          If the Repubs stuck with what Coburn did on every amendment…even their own forcing every single word of every amendment…as well as every single word of the final bill being read….I don’t see how they get out before Christmas…and let’s not forget…reid still hasn’t produced the bill they are trying to amend…I think someone on our side should be standing up and pointing out that we currently have the cart before the horse because we are busy passing amendments to a bill no none has even seen and demand Reid trot it forth to be read on the floor.

          there are other stalling tactics others have discussed as well that have nothing to do with this bill…they need to force quorums on every order of business in the senate from adjourning every day to calling the Senate into session every morning…there shouldn’t be a single thing allowed to happen whether it be revising and extending remarks to turning the lights on in the morning by unanimous consent request…make the Dems vote on every single item and function of the US Senate

    Apparently, the Dems planned to file cloture on the Defense bill today, so that it could be passed by Friday when the current continuing resolution runs out. Thanks to Bernie’s amendment, they won’t be able to do that, unless Coburn grants consent or the amendment — destined never to get more than 10 votes — is withdrawn.

    In the TPM world, this means Coburn hates the troops.

    This is so great, I just sent the following email to Senator Coburn:

    Dr. Coburn,

    I just read on RedState.com about your brilliant move in forcing the Senate to read the Sander’s Amendment. I just wanted to say bravo! This is a brilliant move and I wish more of your GOP colleagues would follow suit. Don’t play nice with the Democrats, make them follow every procedural rule to the letter. It should be the goal of all GOP senators to delay the vote on the health care bill as long as possible. It is obvious that the longer this drags out the less chance it has of passing as Democratic Senators are pressured by their constituents. Let the Democrats tear themselves apart over the abortion and single payer issues, the GOP should (for the time being anyway) embrace being the party of NO!

        In order to win election in CT, Lieberman would probably be smart to switch parties, as running as an Independent (again) in a three-way race would be dicey in a Hard Blue state like CT.

        The other option would be for the GOP to pledge *not* to run someone against him in 2012, so Lieberman can stay Indie, thus leaving it as an Indie-v-Dem race. But I suspect the GOP would only agree to that, if Lieberman pledges to caucus with them or something…

    He’s giving up and railing against the GOP. He says the only way to eliminate the “hundreds of billions of dollars of waste and profiteering” is to eliminate all coverage except through “Medicare for all”.

    Yes, most people believe the best way to streamline anything is to let the government run it.

      Medicare and Medicaid for first 3,000.00 coverage per person a year, ctastrophic coverage over that from Private Insurance, no restrictions on where they can sell or what they can included in the benefit. But gotta kill the medicare. Use medicare payments to pay for catostrophic coverage for seniors.

    Senator Sanders I must be mistaken about your abhorrence to bureaucracy or did I listen to 3 hours of your amendment that would create an even bigger one. The government cannot handle this don’t tell me your centralized approach would be better.

      Near the begining of his remarks he says “I never expected it to pass!” So while screaming at the opposition about delaying, he offers an amendment that is 767 pages that he never expected to pass? How is that not a delay? How many hours went into crafting a 767 page amendment, which any amendment of that length would completely change the bill, that not only changes the current healthcare system, but completely scrap it and start over. Not to mention the economic implosion that it would cause, I men think about it, UHC is out of business, Blue Cross….out of business, this isn’t just insane in the normal way, this is diagnosable psychosis…..wait is that covered on the public option???

    Question for RedState Parliamentarians:

    I would have loved to put Senate Democrats on the record as to a vote on Sanders’ amendment. Is it possible to ask for a non-binding vote (or even a resolution) on Sanders’ amendment, with any official vote coming only if and when his amendment is read? Senator Coburn could even ask that this motion pass by unanimous consent.

    I liked McConnell talking about a precedent of caning senators. I would whole heartedly support caning of the elected elite.
