It’s Not a Filibuster You Freaking Idiots

Dennis Miller once joked about those who would mispronounce certain words on the Senate floor, “now color me reactionary, but I don’t think you should vote on this sh*t unless you know how to pronounce it.” Well, I think we should amend it to say that you shouldn’t report, comment or vote on anything you aren’t smart enough to understand.

As I noted in a previous post, and as is increasingly well known to those who actually are capable of comprehension, Senator Jim Bunning – for the simple reason he wishes it to be paid for – is objecting to a repeated unanimous consent request by Senate Democrats to call up and pass a bill that would temporarily extend unemployment benefits, transportation funding, medicare reimbursement, COBRA subsidies and other expenditures to the tune of another $10 billion or so. Again, Democrats are requesting that each U.S. Senator agree – that is, effectively vote “yes” – to said extension without full consideration or debate on the Senate floor.

Yet, news account after news account of his continued objection to this unanimous consent request report his actions as a filibuster. Politico, Roll Call, Fox News, CNN, and the list goes on and on. And the accusation of filibustering is even worse among Senators and Congressmen, as exemplified by the DCCC Chair, Chris Van Hollen and Senator Kirsten Gillibrand. But it simply is not the case that what Mr. Bunning is doing is a filibuster under the rules, as anyone with a rudimentary understanding of the U.S. Senate fully comprehends.

Enter the ex-Senator Vice President. Joe Biden must have forgotten to plagiarize his thoughts this time around, because he demonstrated that 26 years in the Senate left him entirely ignorant of Senate rules and procedures. He said, “[r]ight now a single Republican senator is standing up in the chamber I worked in for a long, long time, and he is filibustering the extension of a number of things we had in the recovery act to begin with…” That is completely false.

A filibuster is one of two things. One, an actual filibuster where a Senator gets control of the Senate floor and will yield only for a question while continuing to speak, thereby delaying consideration of a measure. Picture Mr. Smith goes to Washington (if you haven’t seen it, do). Two, a “filibuster” under Rule 22 of the Standing Rules of the Senate whereby debate is continuous unless “cloture” is filed to shut off debate on a measure under consideration and the vote is 3/5ths or more of the Senate.

Senate Democrats did not call this bill up to give it floor time. If they had thought it important enough, they could have. Instead, they simply asked for a “UC,” or unanimous consent to pass it. Senator Bunning simply does not wish to give his consent – i.e. he does not want to vote for it. A few days ago, I attempted to explain how the unanimous consent process works when I said the following:

This is how Senators think. You see, the way the Senate works is that the powers-that-be package a whole host of big spending or nefarious policy into a bill that is wrapped in a bow of something like “unemployment insurance” or has some title that no one could possibly object to, and then you ask unanimous consent to call it up and pass it. No debate. No discussion. Just waltz on down to the Senate floor and ask consent – and when a Senator says, “hmmm… I dunno, perhaps we should have some debate about spending another 10 or 20 billion dollars every 30 days, and perhaps at least think about a way to pay for this stuff,” he is excoriated for “hating” people and left out to dry by friend and foe alike because no one has the damn nerve to stand up and say, “you know what, you’re right.” Instead, business-as-usual in the Senate is to talk about “my friend” from wherever, and to let federal spending balloon out of control while you laugh in the cloakroom or run to catch your flight to another junket somewhere.

The truth is that while Senators must be judicious in demanding full, extended debate for every single measure, so should Senators not attempt to jam expensive, complex or otherwise controversial legislation quickly through the Senate via the process of asking for unanimous consent. Unfortunately, this has become commonplace – the regular way of things. And, the result of doing so is almost to invite objection.

Senator Bunning, like virtually every Congressional Republican does not have totally clean hands on spending. But he raises a very simple question here… How are we going to pay for this? It’s a good question, and he not only is within his rights to say he will not vote for it under the false pressure of a unanimous consent request – he is actually correct to do so, and more Senators of each Party should do the same.

Simply put, with respect to a unanimous consent request, “I object,” does not equal a filbuster. Period.

    The term fibuster here is strictly used for rhetoric and to inflame, so its obvious why the dems are using it, but why aren’t the republicans standing behind Jim on this? He’s left out their hanging to dry with little or no help from the rest of R’s. Every one of them should have the phrase PAY-GO written on the palm of the left hand and supporting Jim. By not supporting Jim, they are really supporting the dems buy now pay later mentality.

    They don’t look very confident in their own abilities to get the word out to the people. I think Dems who call themselves “fiscally responsible” shout be targeted, and made to eat their words if they don’t at least sheepishly ask one question;
    “Well, un, yeah, I’d like to know where the money is going to come from for all this extra stuff that isn’t actually directly related to unempolyment benefits.”
    Of course, the question begs to be asked by the GOP as well. We should pound that out there.

      If his fellow congressmen aren’t going to have his back, we can certainly lend a hand by calling our representatives and asking them about fiscal responsibility.

    Why don’t the Dums just call the bill up and give it regular old floor time debate. What else is in there that they don’t want shown the light of day? If there’s nothing to be afraid of, then it certainly will survive a REAL filibuster.

    Yes it was incredibly disapointing that FoxNews did not get it.

    Let us look at the schedule last week. Harry Reid wasted the entire day. Thursday on the “healthcare bill” show. Then on Friday, oh by the way let us spend this money by unanimous consent.

    And nobody remembers how Senator Menendez singlehandedly objected to the DeMint rule for transperancy on earmark sponsorship two years ago April.

    Even on the supposedly Conservative Fox News last night they were calling unemployment benfits the “third rail” and that nobody in their right mind would take a stand against extending unemployment benefits, especially in this tough economy.

    Really? Why not? Despite the fact that numerous studies show that extending benefits actually prolong unemployment(what a surprise)? Despite the fact that this little paltry $10B will extend the benefit to 99 weeks, twice as much as in Canada? Despite the fact that unemployed people are several factors more likely to actually look for a job when their benefits are about to expire?

    I just wish one time some people with courage would stand up to some of this folk social science that drives our policy into a sinkhole.

      You are not alone in your thinking…. keep posting…. people need to hear it. I am with you I have worked 3 jobs at once to make ends I clip the coupons and plant the seeds to save a dime. America we must stop the bleeding… Crash already so we can reboot. get on with it already.

    This packet of irresponsible crap will be brought to the floor and debated on, or it will rot on the shelf. Period.

      Bunning caved last night and now our grandchildren are even deeper in debt. A child born today now arrives owing the gummint $44,000! By the time that child is in 5th grade, the total will be more than $88,000! This is NO WAY to run a country…except into the GROUND!!! Vote them ALL out!

    By calling this action (which is easy to demonize) a fillibuster, the effort is to paint the fillibuster as an obstructionist and malicious tools that gets in the way of productive activity.

    Thus rather than expose the practice of unaminous conent to kick cans down the road, the media and the Democratic party are Alinsky tactics to freeze the fillibuster as a target for elimination,

    Of course, they better be careful what they wish for, but then again, they plan to never relinquish their majority. As has been evident since Obama and the new Congress took office – they’re looking to establish one-party rule.

    Even if the Republicans make inroads in 2010, if the Democrats pass ObamaCare, Cap and Trade, and EFCA, they will have cemented a Federal government impervious to conservative governance.

    For four days, he has been on a one-man campaign to cut off unemployment benefits, kick the unemployed off of health insurance, cut Medicare payments to doctors, deny satellite TV to rural Americans, shut down federal flood insurance and highway projects, and furlough thousands of federal workers.

    Democrats can hardly believe the gift Bunning has given them by single-handedly shutting down these popular programs.

    I wholeheartedly agree with Sen Bunning here on principle, but sadly, his timing could not have been worse. By objecting to this bill in the middle of the health care debate, he is allowing the MSM and dems to repaint the arguement, and for the first time perhaps get some traction with the American people. I understand, as most of you do, what is going on, but when the MSM gives the impression that the republicans are freezing the Senate over unemployment benefits, the many unemployed Americans get angry. This gives traction to the stupid

    It seems if Enough people stand in support of Bunning’s idea, the msg. would be clear: Stop The Spending. Unemployment benefits are a Joke, a huge entitlement supporting people for too many months when they should be retraining and adapting, not leaning on largesse. There is no ‘right’ time to wait for. Bunning is right, right now. We can contact all senators and back him up with public opinion.

    So… this senator is being attacked becasue he is standing up for fiscal responsibility? By fellow GOP members? I think the wrong person is planning to retire from the Senate! What on earth is wrong for refusing to support a bill that no one has any idea how they will pay for? To support this bill would be like giving in when your teenagers come whining becasue they don’t have a car, and all their friends do. Would you buy a car for your kids (or even yourself) if you didn’t know how you were going to pay for it? What is wrong with America? How much longer can this culture of entitlement continue?

    OK, I’m sorry for all those folks who lost their jobs out there – and for those of you who voted for Obama, maybe you should connect the dots… but used to be, when a person lost their job, they found two (or more) lesser jobs so they could make ends meet. Yeah, bagging groceries is a pretty big step down from what you may be used to, but it sends an important lesson to those around you. Like about personal responsibility. And honor. And pride (the good kind, not the bad kind). Many of these people have been on unemployment for over a year! An 8 week program, becoming a new lifestyle of entitlement. That’s bad enough, but the government does not have the money to pay for this. The government has to borrow money from China, or print more money. The government is broke!

    And who pays for THAT? Me. And you. And your children. Probably your grandchildren. Is that fair? I do the right thing, I work hard, and I have to pay for the people who think they need a year or more of unemployment benefits? Someone needs to stand up and stop the insanity. Stop the permenant welfare state. Stop the entitlements. Stop the pork barrel spending. The country needs to grow up, to take personal responsibility. I would be thrilled to death if congress didn’t spend one more dime this year! So thank you, Senator Bunning, for daring to take a stand against run away spending. For daring to make a point because it is the right point, and it needs to be made. And shame on your colleagues who are calling you out for this!

    Seems like what he is doing is making exactly the point that needs to be made — Congress is out of control on spending and needs to identify sources of funds before just tossing these things into the hopper.

    If that’s causing a meltdown, good for Bunning.

    This is the definition of “filibuster” provided on the Senate website.

    filibuster – Informal term for any attempt to block or delay Senate action on a bill or other matter by debating it at length, by offering numerous procedural motions, or by any other delaying or obstructive actions.

    Now that’s a pretty wide open definition, especially the phrase or by any other delaying or obstructive actions.

    Do we have to divine Bunning’s intent in order to determine whether he was engaged in a filibuster?

      Senate rules. He stated in one of his replies to Harry Reid that he wanted the Senate to be accountable for its actions, and to actually vote the proposal up or down… (while arguing himself that the money should be taken out of unspent funds already budgeted).

      I don’t see that as a filibuster, if you take him at his word.

    I agree completely that we should find a way to pay for this but right now the only way to get this passed is with the unanimous consent vote. Correct me if I am wrong (and I am likely wrong as I have not read extensively on it) but since the Dems passed the Pay Go legislation they can’t pass bills that will increase the debt under the normal procedural process. The unanimous consent allows them to circumvent the new policy and pass a bill, like this one, that will raise the debt and not pay for it. This bill could not go to a vote since it is not paid for, if someone wants to change that it would be great but as it is now unanimous consent is the only way to pass it. So, yes, be angry that they are raising the debt even further, but Reid can’t just put it to a vote without it being completely rewritten.
