I’m not accusing Insight of anything, just pointing out that his reasoning is like the Dem’s who hoped for a recession last summer to help defeat the Republicans. They got their wish, but it has been devastating for the country.

An acquittal of KSM could have extremely bad, long-lasting effects on the US. It isn’t like OJ getting an acquittal by a jury of racists. A lot more is at stake than one man’s freedom.

As a thought experiment, his words are fine. But surely, nobody here thinks it would be good if it came true.

KSM kidnapped Daniel Pearl, ignored pleas from his pregnant wife to let him go, forced him to make a propaganda video, and then violently held him down and sawed off his head. I’ve got the video on my computer but I don’t think redstate will let me post it.

The only situation that would be better than the death penalty would be if some other prisoner got him while he’s in jail and there isn’t a trial. I see your point about a conviction validating the use of civilian courts but I think most people already know the use of civilian courts is a pure political play from Obama.

In 2006 Obama said KSM should have a full military trial. Now that he is President, he is showing himself to be the unrealistic, fact-denying, “can’t we all just get along” liberal that we knew he was.

I guess it’s not really his fault though. After all, Holder made the decision and interfering would be politicizing the justice department and Obama would never put politics first……except for the 30 campaign rallies and fund-raising events while not having made a decision on what he wants to do in Afghanistan.

I think it extraordinarily unlikely the cases will ever see a jury. You can’t put the toothpaste back in the tube. An irrevocable decision is made when you decide to deal with something or someone under the laws of war rather than the civilian criminal law. To obtain a conviction of any of those being brought to the US, the US Attorney will have to start over completely. At most that learned by intelligence sources and through his confessions and other statements will be the basis for a complaint on which they can compile all new evidence on which to base charges, secure an indictement on those charges, and get a conviction ONLY on the charges and evidence generated independently from the Military and CIA’s evidence.

Comrades Obama and Holder aren’t going to do that because they and their fellow travellers at the ACLU don’t want a trial of KSM et al. nearly so much as they want a trial of President Bush, the CIA, and the Military. Consequently, they’ll serve up the evidence obtained in a manner that would not be acceptable in the criminal courts so that the defense can make a big show of having all that evidence being suppressed.

Now I’m aware that Comrade Obama, and probably Holder too, have affirmative action law degrees, but they must have learned something in law school. I would have expected my most junior jouneyman employee, most of whom were lawyers, to first recognize a process problem and then determine whether and how to cure it. And, if you can’t cure it, you let the person go. It’s bad enough to have to let a bad employee of the hook because of process issues, it is treason to let a mass murderer off the hook because you’d rather make a political statement about your predecessor.

Michigan fields one of the largest standing army’s in the world every year.
