Another Attempt at Union Bailout Bill by Year’s End?

While there has been little mention of the job destroying and hallucinogenically-named Employee Free Choice Act in the press as of late, this morning’s Pittsburgh Tribune-Review is reporting that there may be another attempt at getting the company-killing legislation passed before year’s end.

With congressional Democrats facing losses in November, labor strategists view the remaining months of this year as the best chance they’ll have to have their priorities enacted.

“I think it’s the best chance we’ve got, and I think you’re going to see that happen,” said state AFL-CIO President Bill George, who will step down at the end of May.

The Employee Free Choice Act, stricter regulations on financial firms and maintaining the Democrats’ majorities in the House and Senate top labor’s to-do list this election year, union leaders said. About 1,000 representatives of 43 unions will attend the state AFL-CIO’s 39th Constitutional Convention at the David L. Lawrence Convention Center, Downtown, starting today.

While it seems unlikely that the White House will want to engage in the rancorous fight EFCA will surely invoke (especially with a Supreme Court Justice to be confirmed soon), we cannot dismiss this as idle chatter either.

It Won't Survive a Filibuster...

…And I don’t see how it can be attached to a Budget or reconciliation bill.

So I think this is whistling past the graveyard from the Union goons, unless the Obama Admin. has some regulatory way to bring about EFCA a la the EPA and Cap ‘n’ Tax.

those decisions would be temporary, and can be repealed in 2013.

A bill passed probably is permanent.

They know we are onto that trick, but the Dems and labor are getting desperate. Any bill of a big size, that they put some ridiculous 8-hour availability on before voting, I bet it’ll be there.

survive a filibuster. But the rest of the bill (arbitration and really draconian penalties against businesses which oppose unions in their workplace) very well might.

If the goonions are willing to compromise, they may get a bill that the NLRB can interpret to their favor.

No Republican Senator Will Support Even Those Provisions Now That Specter's Gone

I don’t see the Dems getting *any* GOP support even for a stripped down bill in the current political environment – in short, there’s no political ‘upside’ for the GOP to compromise at this point (esp. in a ‘down’ economy).

I don’t see any Card Check provisions getting through the current Senate…

As bad as card-check is, EFCA's arbitration proviso is the job killer. nt.

what arbitration did for their sports. It was a disaster. Look how many strikes and lockouts these sports had since the 1970s.

I don’t know if the NHL or NBA ever had arbitration.

Snowe, Voinovich, and Murkowski were willing to go for a bill without card check (that is arbitration plus much stiffer penalties for “illegal” union prevention). Murkowski has been endorsed by labor unions in Alaska, where labor is actually quite strong (22% of the workforce) and endorses Republicans regularly, they always endorsed Don Young and Ted Stevens as well until 2008.

Granted, this was *before* the Dims shoved health care down the throat of the Senate using reconciliation. So you may be right today.

Reportedly, Tom Harkin ans Spectre were “close” to a compromise with some reluctant Dems last September…Spectre shot his mouth off (without checking with anyone else) at the AFL-CIO convention.

Then, it got lost in the health care shuffle before Scott Brown drove a stake through its heart…for now.

If they bring it up before November, it may just be to see who’s for it (on the Dem side) and who’s not.
