The Face of Tyranny.

Calling Elena Kagan a 'judicial activist' is to put it mildly.

It was both revealing and reviling.  Watching this video exchange [posted on Drudge] between President Obama’s Supreme Court nominee Elena Kagan and Sen. Coburn indicates two things:

  1. She believes that government power is omnipotent
  2. She believes the government has the right to rule its citizens in every facet of their lives.

    While Elena Kagan would not answer the question directly, she actually did when she said (after trying to laugh off the question):

    …and I think the courts would be wrong to strike down laws that they think are senseless–just because they’re senseless…

    Note that she did not state that she felt telling people what they can eat would be unconstitutional.  Why? Because she thinks telling people what to eat is constitutional.

    Besides the fact that the government is already trying to tell its citizens what to eat, Kagan’s remarks show the true face of a Statist.  In other words: You, your life, and that of all citizens belong to the State, according to Elena Kagan’s philosophy.

    If you stop and think about it a moment, Elena Kagan’s belief in the power of the government to dictate the lives of its citizens under the Consitution’s Commerce Clause is endless.

    • Can the government dictate health care? Sure.
    • Can the government dictate what you eat? Absolutely. That salt you put on your grease laden french fries is statistically proven (by the government’s health care statisticians) to cause heart disease which costs the government-run health care system money.
    • Can the government tell you what job to have? Why not? After all, productive citizens make for a productive society.
    • Can the government tell you which union to join? Fughedaboudit!
    • Can the government tell you where to live? Why, that’s just a reallocation of the State’s resources.
    • Can the government tell you which TV to buy? Um…Hello, California!
    • Can the government tell you how many kids you can have? Oh h*ll yes! After all, those little urchins cost the government money, don’t they?  What with government-run health care, schools, school lunches and all.
    • Can the government tell you whether or not you may live or die? Oh, Shut up! A government would never do that…would it?

    If you have not seen the face of tyranny before, you are seeing it now.

    Tyranny is any political system (whether absolute monarchy or fascism or communism) that does not recognize individual rights (which necessarily include property rights.

    Now, that you know what it means, what will you do about it?

    Remember. November.  Get up.  Get out.  Go vote.

      She admitted she was a progressive. Why no follow-up, like, “What does identifying yourself as a “progressive” mean to you?”

      “Does being a progressive mean that you, personally, favor socialism over capitalism?”

      Does being a progressive mean that you, personally, favor central government planning over the free market?”

      “Did the ‘more leftist left’ you pined for after the 1994 election in your article in the Daily Princetonian ever arrive for you and, if not, do you still desire its arrival?”

      “And, what, exactly, did you mean by the term ‘a more leftist left’ and why would ‘a more leftist left’ be beneficial to the American people?”

      The Republican senators would be less accommodating if they feared losing their next bid for re-election in their respective Republican primary, and they won’t believe they have to fear that as long they don’t see the “conservative threat level” increase significantly. The best gauge for measuring that “conservative threat level” is the percentage of vacant precinct committeemen slots in the senators’ respective state GOP party ranks. With the average percentage of filled slots at 50 per cent, with no significant increase, they figure their seats are safe and there’s no reason to stick out their necks and risk being called a bad name by Keith Overbite at MSLSD. Oh, the horror!

      So, get to your local GOP committee yesterday and find out how to become a precinct committeeman. Increase the conservative threat level by showing up for the real ball game of politics.

      was a brilliant point for Coburn to focus on. And I’m delighted that he pointed out that our Founders would have rolled in their graves to see how it’s been abused. I did not see the coverage in entirety, just the clip. So I’m not sure if he actually ended up using the words “abuse” or “reinterpretation” or “misinterpretation,” but all of those apply to the way we’ve been mangling the clause–particularly since FDR’s administration.

      Until that thing is challenged in a meaningful way and restored to its PROPER interpretation–that commerce between the states should be REGULAR–the federal government will continue to have a stranglehold on our lives…or the ability to leverage the threat of that, anyway.

      As for why Republicans are so conciliatory to her, I suppose it’s the same old story. No one wants to be seen as the big meanie. It’s “bad PR.” Geez Louise, I’ll volunteer. All this tippy-toeing does nothing but annoy me. Bottom line: She doesn’t have the credentials and she sure ain’t unbiased.

        The socialization of that portion of our Constitution is a particular favorite topic of mine. It’s misunderstanding, misuse and mis-application has been a primary vehicle for the deconstruction of our founding fabric.

        I will have to find that clip, I have not seen that.
