Gettysburg wants to kick “God” out of town, threatens historic Civil War Chapel

In another stunning lack of conscience on the part of bureaucrats the City of Gettysburg has issued an order for a replica of an historic chapel to be vacated with the intention of it being torn down. The City has given no good reason to the organization who spearheaded and reconstructed the chapel which stands as a reminder to the service it gave to soldiers during the Civil War: namely food, medical care, fellowship and God.

From the beginning of the Civil War in 1861 5,000 volunteers of the United States Christian Commission (USCC), 1860′s currency valuation, distributed over $6 million worth of goods and supplies to those on the battlefield, in hospitals and in prisons. There was not just one chapel but hundreds built around the battlefield area to minister to these soldiers and distribute Bibles and the spiritual assistance of God.

In 2004 a gentleman by the name of John Wega refounded the USCC and at his own expense built an exact replica, as far as Civil War documents could dictate, of one of the chapels in the heart of the city of Gettysburg. The chapel has held services every Sunday from April until the end of November and it is a visitor center as well, open 24/7. Below is a picture of the interior of the rebuilt 480 sq. ft. 40′ x 12′ chapel which was built on a vacant lot with permission, at the time, of the city of Gettysburg and in compliance of all the required building codes. It can hold up to 80 people, packed in.

Now out of the blue this past Wednesday, November 17 Chaplain Wega and his group received a “cease and desist” letter from the City of Gettysburg Code Enforcing Officer stating the necessary permits weren’t applied for, and ordering the property to be vacated with the intention of demolishing it. Here is a copy of the letter:

This letter came one day before the 147th anniversary of the Gettysburg Address.

I had the pleasure of speaking with Chaplain John Wega this day along with one of the attorneys from Liberty Institute, Hiram Sasser, who is representing him in his cause to fight what I consider to be an another outrageous attempt of government interference and grabbing at private citizens’ lauded efforts to instill not only history but a tribute to our Brave Soldiers who fought for freedom in this country. Ironically this “order” comes several days before the final service in the chapel for the year, this Sunday November 21, which will be Remembrance Day for the soldiers who lost their lives in those few terrible days on the Gettysburg battlefield. Last July the Adams County Chamber of Commerce gave the Chapel a Beautification Award.

Apparently the City of Gettysburg is trying to kick God out of their town.

In 2009 Chaplain Wega did replace his original canvas roof with a metal roof to ward off the inclement weather and added on to the deck. Attorney Sasser claims the chapel should be exempt from the need to have permits reissued under the federal Religious Land Use and Institutionalized Persons Act (RLUIPA) of 2000. Attorney Sasser and Chaplain Wega hope the situation can be resolved amicably without a need for court involvement, however the DC law firm of Wilmer Hale has also been retained in this matter. Wilmer Hale is representing Chaplain Wega pro bono and Liberty Institute relies on the support of generous donors in their representation of those who are under threat of their liberties being removed from an over-ambitious government or entity.

Chaplain Wega also stated to me the Boroughs Historical Architectural Review Board is also on the side of the City of Gettysburg however Board member Peggy McGee, who works across the street from the chapel is a “regular” in the chapel on her lunch hour. Go figure that one out. And a resident bought a home across from the chapel with the express purpose of being nearby so he could be a frequent visitor.

Attorney Sasser is confident based on existing federal and Pennsylvania law “The Little Chapel That Can” will prevail, and that “God” will not be chased out of Gettysburg.

    This should be more than alarming to the entire nation, but in today’s climate, most Americans will simply say ‘it figures’ and ‘whatever’.

    When you showed that one of the board members attends the chapel on a regular basis and then said “go figure that one out“, it didn’t take more than one second to do so.

    I’ve some questions and I’ll list them in a format other than queries.

    Somebody must be looking to get that property for expansion or other use besides enforcing code spec and/or tax revenue for G’burgh, or even forcing religion out due to bias.

    Documented owner(s) of the property where the chapel sits.

    Documented owner(s) of all surrounding property lots.

    Physicality on those adjoining properties – residential, commercial, retail, etc.

    Easement distances mandated – if any (it’s pretty tightly packed in town) and other items and requirements of owners.

    Tax status of the properties and owners.

    All adjoining property zoning vs. actuality in use.

    Political affiliation of all documented owners.

    Political involvement in G’burgh of documented property owners and immediate family members and documented business associates.

    Recent or newly transacted ownership changes of adjoining properties, listing seller and buyer.

    If a non-affiliated company or organization seeks the chapel property, investments or participation of documented current property owners and immediate family members in those companies or organizations seeking the land.

        I am so sorry that I don’t have time to look up and document some answers for you both. All of the below is based on memory.

        1. I consider Gettysburg a liberal town. I believe that in 2008 it contained the only precinct in Adams County to go for Obama; however, that precinct may have been the one that includes Gettysburg College.

        2. I believe the town leadership about a year or two ago made a hugely stupid move. They had hung some form of advertisement banner below the American flag on the flagpole in the town square. When veterans groups pointed out the breach in protocol, the town removed Old Glory instead of the banner. Bzzzt. Wrong answer, numbskulls.

        3. Pertaining to the issue at hand. Adams county is in the final stages of property reassessments. It has been very contentious. As I understand it, one of the issues of the reassessment is that undeveloped land parcels appear to have been assessed as if they were developed to the same degree as neighboring plots. I don’t know if that is the correct way to do things or not, but it was the source of quite a bit of uproar. If the town gave unofficial sanction to build a tax-exempt chapel on a vacant lot six years ago, there would be a large difference between the taxable value based on computer records and the taxable value based on the observed status of the land. Perhaps the county is leaning on the borough.

    I lived in Gettysburg for several years, and, in my experience, it was always the National Park Service that was at the center of these ‘authenticity’ and land use issues. This chapel, if I am remembering correctly, sits off of the battlefield, well inside the borough itself, which must be why the municipality is getting involved.

    Gettysburg is an extremely conservative town with small town values. I would assume that the voters there elect conservatives (maybe I am assuming too much), I doubt this is meant as a secular attack on religion. I think the borough would have to be pushed by someone to actually provide any citation, let alone a cease and desist letter. My two guesses are either someone adjacent to that land wants to use it or some historian (probably locally based) thinks the church is not authentic enough and is therefore unsightly.

    One of the attorneys from Liberty Institute, Hiram Sasser whom I spoke with, was actually in Gettysburg at the time of my conversation with him. They are trying to sort this out and figure out what or who is behind this. Yes, you are correct. The chapel is NOT on the battlefield. However, according to info and records I have received Chaplain Wega, if you read the letter from Wilmer Hale in DC I link to, complied originally with all the necessary building codes.

    I’ll be getting updates on this. The only good news is at least the borough issued the “cease and desist” order at the end of the season when services are held so there are a couple of months to hopefully sort this out. However this also prevents visitors and others in the town from visiting and worshiping during this time.

      actually own the land itself?

      You wrote he built it with permission, but didn’t explicitly state who owns the land. I presume he does, and assume thing would be proceeding differently if that were not the case.

      Has there recently been a shake-up at the compliance board? Not being a zoning official, I would have presumed he needed a permit to replace the roof if I had not read the article. Zoning boards tend to not take those sorts of things lightly.* If the board has changed and has a new zero-tolerance head, that could explain the sudden change in attitude. It would also mean he’ll tend to dig in rather than accept the arguments from Chaplain Wega’s attorneys.

      *I was once a member of a 501(c)3 that benefited greatly when someone did something similar with a building that lost a back wall due to deterioration. The owner did a great job constructing a concrete block wall at the back of the building (tougher mortar than normal). Did an even better job putting in a second level for the photography studio he was building (support boards were two inches wider than normal, plus 12 inches on center instead of the standard 16, double layer of plywood rotated 90 degrees for the floor itself, 1/2 rather than 1/4 for each layer). But never applied for a permit to make the changes, all of which would likely have been approved if he had. He too was denied an occupancy permit and eventually sold it to us for considerably less than market value. I do understand his preferred subject matter wouldn’t pass muster for RS but that wouldn’t have mattered to the zoning board or frankly, the neighborhood.

    The smaller and more localized outrages left unchallenged lead to ever more of the same. Government at all levels begin to think they can do as they wish.

    At least now, they are being called out, and recently many were voted out.

    I am leaving the site because I realized once again I have no friends here. They have have many chances to stand up for me and have not. Yet, I Have always stood up for those I thought were being attacked unfairly. Anyway, don’t feel sorry for me, I am glad I came to realize this, the truth will set you free.

    Keep your focus on Gettysburg. I have spent a lot of time there. I have probably spent more time in Gettysburg than anyone else here unless a local lives there. One thing I might advise is to contact the national park service. This might sound odd from a libertarian conservative, but the National Park people there are the best when it comes to park preservation and history.

    Something is afoot in the town of Gettyysburg. Not only do you have this issue but you have the issue of the so called Gettysburg Preservation Society lobbying for casino games there. They want to trash more of the hallowed ground for the almighty dollar.

    Here Gettysburg College shows itself to be what it claims not to be.

    If I have any friends left here, you will know that it is apropos to leave on a Gettysburg diary. To the diarist, I saw don’t give up, and I repeat your best efforts would be to lobby the National Park Service. The people of Gettysburg are ok but the the National Park guys are the best when it comes to preserving the site.

    As for the Doc, I am taking an extended leave of absence. I am tired of the internecine fights here, I have more serious things to do. I say God Bless to you all, and I hope we conservatives finally come together. But I will no longer be a part of the tit for tat, the reality is a man has to take care of his own regardless of who is in power.         and I am glad my last post here for a long time will be to a new member. I have been here almost 5 years fighting the same fights you want to engage in. I want conservatives to come together for a common goal. I will be honest with you, I am tired. I am tired of the games, I am tired of the bickering. I am very glad the Republicans has the victory the had. I did everything in my power to help, even shuttling a very sick relative from the hospital to the polls, and she would not take no for an answer.

        I am leaving because I am tired. People I have chatted/debated with here for years act as if they have never met me. I am compelled to explain every idea, to document every comment even though I have written reams on the subjects. I am just burned out, when it comes down to it, that is all it is about.

        I will gladly pass the baton to you sir. We always need fresh blood, we always need someone to pick up the colors and drive forward. I greatly appreciate your comments, my old friends here have pretty much disappeared for whatever reasons. I don’t care about how long someone ;has been here, I care about those who say they will stand by you.

      Hey, Poker Buddy, just read some of the posts from today late. Not sure you’ll read this (but I’m sure others will and I really don’t care about that).
      I understand completely about taking a leave, I come by often to read posts by Vassar and LIO and a few others and rarely reply lately myself. Some of the comments I read are completely grotesque in their intent, much fighting and alot of insults by a handful who for some reason go unnoticed. Besides all that junk, Redstate is still a great site for info from some really incredible folks.

      Thank you for your nice comments to me awhile back. I enjoyed reading many of your comments and agreed with you 99.9% of the time. You’re one of the good ones, I hope you come around these parts again. In the mean time, I hope everything works out well for you.
