[UPDATE]: Apparently, the post in question has been updated. “In context,” the author claims, it is clear that he was writing his post for post-inauguration. “In context,” of course, the 111th Congress will be sworn in pre-inauguration. There is no amount of context that will change the basic fact that January 6th occurs before January 20th. The battle over provisional seating is going to occur on Tuesday, as the Coleman, Franken, and Burris camps know (has Burris been allotted a “camp”? Someone ought to get to the bottom of that mystery). If the provisional seats aren’t given at that time, both seats are going to be decided by State certifications *after* all the court battles are through. That’s reality (as opposed to “Reality”).
There are at least two amusing things about this post written by a Jonathan Zasloff over at Mark Kleiman’s place. The first is how eager the “Reality-Based Community” suddenly is to embrace the nuclear option. Despite the complete lack of any textual support for the notion that Art. I, Sec. 5 of the Constitution is not susceptible to filibuster, but Art. 2, Sec. 2 is, they’ve suddenly decided that both propositions are facially obvious to anyone who has really been paying attention like they have. These are the rules you fought so hard to keep, RBC; hope you enjoy them.
The second and more amusing tidbit is that the entire premise of this “Reality-Based” post is that Joe Biden will be President of the Senate when all this goes down, and thus will be able to make the procedural rulings in question. Of course, in reality (the kind without capital letters or scare quotes), the 20th Amendment states that the terms of Senators shall end on January 3rd. Because that happens to be a Saturday (today), it has been legislatively decided that the 111th Congress will be sworn in on January 6th. You know who’s going to be the President of the Senate on January the 6th? I don’t want to give away the unpleasant surprise for the “Reality-Based Community,” but I will offer a hint: it won’t be Joe Biden.
Other than that, though, it’s a swell plan, and I hope Joe Biden gives it a try.

According to Powerline, Franken’s lead increased to 225 votes today when additional “wrongfully” excluded absentee ballots were counted. Since Coleman was going to be able to challenge only 130 votes, he has lost the race.

There are outstanding legal challenges on both. Of course I’ve been expecting Franken to “win” from the start when Coleman was 775 ahead, but it is not over at this point.

Let’s face it, she didn’t know what it meant. That might be hard to swallow, and it might hurt to hear the other side jeer at the numbskull the GOP picked for VP, but them’s the facts. The Veep does NOT have the ability to “really get in there with the senators and make a lot of good policy changes.” They preside, and only in the event of a tie do they vote, and they do have a role in parliamentary procedures.
I remember an episode of The Factor (or Hannity or something) a few years back during the Roberts confirmation. Jay Sekulow was a guest, with Dick Cheney, and he was encouraging Cheney to push for the “nuclear” option.(or with Bush, should it be called the “nucular” option?) Cheney seemed aware of the ability to use it if needed, and it was all over talk radio and conservative blogs. Trying to cry foul over something Biden could do seems exceedingly hypocritical and tendentious.
Now, unless I’m wrong, and I’m happy to be shown as much, the issue is in fact different. Powell v McCormack does indeed provide the support for Biden wanting to point out that this is something that is a simple majority vote (so I don’t know what all the talk of “nuclear” option is getting people so riled up.) Isn’t this a question about whether the article in question is indeed in fact a matter of simple majority, and that it has been ruled upon? I could be wrong.
Either way, I mean, come on, it was abundandtly, abundantly clear to anyone who isn’t below Gump-level intelligence that the RBC dude was talking about post-Inauguration Senate parliamentary procedure. I mean, trying to score a cheap “gotcha” out of the fact that Dick Cheney will preside over the Senate for another few weeks just dulls the otherwise sharper edge of your wit, Leon.
The Dems provide much more interesting fodder than this, wouldn’t you think?
