-by Scott Rohter, July 2012

“When a tax is really not a tax, but is still considered to be constitutional”

When is a tax really not a tax? And when does something that is really not a tax, but rather a penalty for failing to buy insurance become a tax instead? Are you about as confused as I am? Well apparently it is whenever the Chief Justice of the United States Supreme Court decides that it is, because he is the only man in the whole country that has the power to actually change the definition of words, and give them new meaning! He is the only person in the whole country who has the capacity to redefine the English language to suit his whims. Now with the Court’s permission you can do just about anything you want in America that is un-constitutional. All you have to do is get the Chief Justice’s permission to change the definition of what is, is!

Wait a minute! Bill Clinton tried to do that, and he failed miserably with disastrous results. But he was just a little bit ahead of his time. Now it is perfectly acceptable according to John Roberts to redefine the meaning of anything. A penalty, a tax, a fine, a punishment, the definition of is, they are actually interchangeable terms now. Whenever this George W. Bush appointee to the United States Supreme Court says that a penalty for not purchasing insurance is really a tax instead, then I guess that it is, depending on just what the definition of is, is. That is in spite of what the President of the United States says, and what the Congress says. That’s the end of story!

In a close five to four decision, twenty six States and approximately 150 million people who listened the President of the United States and to their elected representatives in Congress, and who took them at their word and believed what we were told, that the penalty in the Affordable Care Act for failing to purchase insurance was really just what they said it was, a penalty, we were told to our bewilderment Thursday to basically go fly a kite! The penalty really wasn’t a penalty after all. It was a tax all along! April Fool’s Day! Oh, but this is June. It was all very nice and legal of course. They wouldn’t want us to violate the law or the Constitution I’m sure. Only they can do that!…

The Gift of George W. Bush that Just Keeps on Giving!

By Scott Rohter, July 2012

We knew as conservatives that there was going to be a lot of time between the filing of the first legal challenge to Obama Care, and the time when all of the separate court cases would be consolidated into on, and that one case that would eventually be heard by the United States Supreme Court. We knew that there would be plenty of time to get to one of the more moderate members of the Court and persuade them to change their mind and vote along with the liberals to uphold the Affordable Care Act. We knew all along that the defenders of Obama Care only needed to peel off one of the more moderate Justices, and the Affordable Care Act would be upheld by the slimmest of margins, 5 to 4 by the highest court in the land. We always thought that the vote we had to worry about, the one that might flip was Anthony Kennedy’s vote, that he was the weakest link in the conservative chain, the most likely member of the Court to switch sides. No one ever believed for a minute that John Roberts could be had, or bought off at any price!

The supporters of the President’s Health Care Bill had four definite yes votes right from the start to uphold the new law. That was certain. The two Obama appointees to the Court, Elena Kagan and Sonia Sotomayor were a given! The other two liberals on the Court, Ginsburg and Breyer were equally as sure to vote to uphold the sweeping new law since Justice Ginsburg was appointed by Bill Clinton in 1993 and Justice Stephen Breyer was nominated by Bill Clinton in 1994.

President Bill Clinton tried to pass Universal Health Care Legislation during his first term in office. It was euphemistically referred to as “Hillary Care” after the current Secretary of State. It was Hillary Clinton’s job as the First Lady, to try to finagle her husband’s Health Care legislation through Congress, but fortunately for us she was unsuccessful then. The progressives knew that all they needed to do this time under President Obama was to get one of the more moderate members of the Supreme Court to vote with the four liberals to uphold the law and thy would win.

We always thought the one Justice most likely to change sides and join with the liberals was Justice Kennedy…

Arizona Wins Partial Victory in 5 to 3 Split Decision

Analysis by Scott Rohter, June 2012

Governor Jan Brewer of Arizona called the recent Supreme Court decision on Arizona’s tough illegal immigration law SB 1070, “a victory for all Americans.” The central part of the law was upheld in an 8 to 0 decision Tuesday. Justice Elena Kagan recused herself from all votes regarding the Arizona law. The reason she gave for recusing herself was that she had been the Solicitor General when the Federal Government first sued Arizona over this matter. All of the other Liberal Justices on the Court voted with the conservative members to uphold the most important aspect of the Arizona law, however the victory was neither unqualified nor complete. There is still much more work that needs to be done. There were three other parts of the Arizona law that the Court ruled on and decided against Arizona on.

In a 5 to 3 split decision with only Justices Scalia, Thomas, and Alito dissenting, certain other aspects of the get tough on illegal immigration Arizona law were rejected including the part that allowed for warrantless arrests when there is reason to believe that a person illegally in the country has committed a crime or misdemeanor. That was Section 6 of the Arizona law. Chief Justice John Roberts joined Justices Kennedy, Breyer, Ginsburg, and Sotomayor to reject that part of the Arizona law.

Another aspect of the law that was rejected by the same 5 to 3 decision with the same Justices aligning themselves on the same sides of the issue again was found in Section 5 of the Arizona law. This section made it a separate State crime for illegal aliens to work, or to apply for work, or solicit to do work while in Arizona. Again Chief Justice Roberts joined the liberal Justices of the Court: Kennedy, Ginsburg, Breyer, and Sotomayor to strike down that part of the Arizona law. They said that it interfered with Congressional jurisdiction which was delegated by the Constitution to Congress, and specifically to the Immigration Reform and Control Act of 1986 which did not make it a crime for illegal aliens to work in the country. Again Justices Scalia, Thomas, and Alito were dissenting.

Finally in a 6 to 2 split decision the Supreme Court ruled to strike down Section 3 of the Arizona law, which made it a separate crime..

What’s Next for the Middle East and Egypt?

Should the U.S. Try Using Leverage On Egypt’s Military

By Scott Rohter, June 2012

Writing for my local newspaper’s editorial board a seasoned reporter wrote that the United States holds some kind of leverage over Egypt’s ruling military, and that we should not fail to use it. The editorial is the official position of the only newspaper in my city. The Op-Ed was written after the recent elections in Egypt, and the ruling military’s response to those free and fair elections. The Newspaper couldn’t be further from the truth! Nor could the particular response that its editorial board advocates America should take to events happening in Egypt right now, be more wrong, or more detrimental to peace in the Middle East! Let me explain…

The reporter stated that the United States should exert its leverage by threatening the Egyptian military with the loss of American foreign aid if they didn’t back off and allow the Muslim Brotherhood to take over the entire country. The Muslim Brotherhood is a terrorist organization. They won the Egyptian parliamentary elections, and their most radical Islamist candidate won the most recent presidential election. That is why the Egyptian military stepped in to intervene, in order to prevent a complete takeover of their country by extremists.

It was by initially threatening to cut off financial assistance to Mubarak’s regime over a year ago, that we undercut the government of Hosni Mubarak in the first place, and allowed the so called Egyptian revolution to occur. That is how we allowed the Islamist Revolution, or the so called “Arab Spring” to spread from Tunisia to Egypt! That is how Barack Obama enabled the Islamist Muslim Brotherhood to gain a foothold in Egyptian politics! Now the liberal newspaper in my city thinks that the United States should just allow the Muslim Brotherhood to go from a gaining a strong foothold to having a complete stranglehold!

Wisconsin Governor Scott Walker Wins Big

A New Republican Star is Born

by Scott Rohter, June 2012

In my last article I speculated about who pulled the plug on the TEA Party. I thought that the TEA Party might be running out of juice because we wound up with Mitt Romney as our Republican nominee instead of a solid conservative in 2012. But maybe nobody pulled the plug. Maybe we haven’t lost our mojo, after witnessing the enormity of Scott Walker’s victory in Wisconsin. But I can tell you this…They won’t stop trying to pull the plug on the TEA Party!

All night long yesterday I listened intently to reports on the radio from ABC, the BBC, FOX News, and NPR about the recall election going on in Wisconsin. I went back and forth between wondering and worrying. When it was clear that Governor Walker was actually going to win the election, that’s when I noticed the Liberal’s spin machine kick into high gear. That’s when their denial began to set in too. Mainstream media reporters began saying things like, “Embattled Governor Scott Walker survives an historic recall election.” The mainstream media reported that Governor Walker was actually the first and only Governor to ever survive such a recall election. This observation seemed to legitimize their efforts to recall him, and the arrogance of the organizers of this recall election, when in reality Governor Walker did nothing at all to deserve a recall election. The Left just didn’t like the way he was governing. They didn’t like his policies, but that is not a reason to call for a recall election. However, stating that he was the only Governor to ever survive such a recall election seemed to justify their efforts all the same.

Furthermore reporters in the mainstream media said that, “The very polarizing Governor Walker somehow managed to retain his Wisconsin Governorship.” Somehow, I asked myself? They mentioned nothing at all about the huge cost of conducting this unnecessary exercise in democracy, and how it wasted vast sums of the taxpayer’s money. Instead they pointed out that, “Democrats say they will have to invest even more assets now in Wisconsin in order for their Party to prevail again in November, but the failure of the Wisconsin Recall Election is no reflection either on President Obama’s popularity or on his chances of winning in November… “Yea, right. I have some swampland for sale in Florida. Would you like to buy it?”

Never did I once hear a mainstream news media source realistically admit, or even allude to the huge size and scope of Scott Walker’s victory. Only once after listening for more than five hours did I ever hear a single word mentioned, or a single dissenting voice even hint at the huge scope of the defeat for the organizers of this recall election. “It wasn’t even close,” one reporter from NPR said later. Governor Walker won by an even bigger margin than he did two years ago… It was 54% to 46%. “Two years ago his margin of victory was smaller than that,” they said…

Who Pulled the Plug on the Conservative Revival ?

An Analysis by Scott Rohter, June 2012

Republicans never had a better chance to put a solid conservative onto the ballot and into the White House than we did in this year’s Republican Primary Elections. We had all of the pent up energy from the TEA Party Movement that has been building for the last three and a half years. There were also the thousands of local 912 groups that have sprung up all across America since the election of Barack Obama in 2008. Not since the peanut farmer from Plains Georgia, Jimmy Carter, has there been such a firestorm of discontent raging in America. And not since the Presidential campaign of Ronald Reagan has there been such a level of excitement and enthusiasm re-invigorating the Republican Party … and all for what? Mitt Romney?

In spite of all of the good intentions, in spite of all the best laid plans of mice and men, the best that the TEA Party Movement could produce was a rather limp fisted moderate by the name of Mitt Romney. When the oath of office is finally administered to him on January 2, 2013 and I can assure you that it will be, he will repeat after Chief Justice John Roberts the following thirty-seven fateful words, “I Willard Romney do solemnly swear that I will faithfully execute the Office of President of the United States, and will to the best of my ability, preserve, protect, and defend the Constitution of the United States.” He should probably add four more little words to his oath, but he probably won’t. Those words are “so help me God”. He is going to need God’s help if he is ever going to fix what is wrong with our country.

How did the TEA Party Movement become so badly derailed? How did we get so far off the track? Just as four rotten years of Jimmy Carter produced the resurgence that led to Ronald Reagan, I would have guessed that these last four abominable years of Barack Obama would have resulted in something far better than Willard Romney. So why didn’t it? Who pulled the plug on the Conservative revival in America? Who threw the switch that shunted the TEA Party Train onto another track? How did conservatives ever allow ourselves to get so sidetracked?

In the early days of the TEA Party Movement there was just pure, raw, unbridled energy in opposition to President Obama’s progressive agenda. At some of these initial rallies there were organizers and organizations whose job it was to try to harness all of that energy and enthusiasm, and try to focus it in a particular direction. The trouble was, that it was a direction of their own choosing, not necessarily ours. These national groups received a lot of their funding and their direction, not from the typical discontented members of the TEA Party, but from a different group of disenchanted opponents of President Obama’s agenda.

These national organizations quietly and efficiently went about gathering hundreds of thousands of signatures and eventually millions of signatures, and they provided the logistical and technical help to the growing TEA Party Movement, along with recognized leaders who would soon be doing more than just infiltrating and providing support to the Movement. They would soon be directing the charge. This transition was seamless and it went almost unnoticed. The trouble with this was that the goals of these national organizations were not always the same as those of the average disgruntled TEA Party goers. The direction that they were taking us was not always in sync with where we wanted to go. The agenda and the direction of the TEA Party Movement were no longer being set at the grass roots level, by a majority of disenfranchised patriots. The operational planning of the agenda moved from the streets to the executive boardrooms, and it became perfectly obvious that it was being directed from above by a rather limited subset of very wealthy individuals. It is doubtful that the energetic masses of alienated conservative voters who attended the TEA Party rallies and these exceptionally wealthy individuals that are behind the national organizations would agree about very many things, including the focus of the whole movement, and about specific Republican candidates in particular. That soon became painfully obvious.

Michele Bachmann was the original TEA Party candidate and the obvious and deserving choice. However it was soon clear that one national organization preferred Hermann Cain, and another preferred Ron Paul. Soon Newt Gingrich and Rick Perry threw their hats into the ring too, and they had a different group of supporters and followers who were all claiming that their guy was the real TEA Party candidate. And finally there was Rick Santorum, who was never really the TEA Party candidate of first choice, but who only became so after all of the other so called conservative candidates had either shot themselves in the foot, or spent their entire political wads battling one another and cancelling each other out. That’s what actually happened…

-by Scott Rohter, August 2011

Remember a few years ago when many prominent Democrats in the media made a big deal about referring to their Party as the Democratic Party? They insisted on correcting anyone who called them the Democrat Party! Big Deal you say! It’s just two little letters. It’s such a small point! But maybe it isn’t. Have you noticed how radically different the Democratic Party is today, than it used to be? The Democratic Party of today is not the same Democratic Party of your fathers. This focus on their name represented more than just symbolism and semantics. It represents a complete makeover! There aren’t any more Democrats left like John Kennedy, John Connally, Zel Miller, or even Joe Lieberman. Democrats like Kennedy and Connally don’t exist anymore! Zel Miller retired, and Joe Lieberman became an independent. Even Ronald Regan said that he used to be a Democrat, but he didn’t leave the Democratic Party, the Democratic Party left him! Yep, they keep moving farther to the left, and they just don’t make good Democrats like they used to! All we have left are the Barney Frank’s of the world, the Nancy Pelosi’s of the world, and the Harry Reid’s of the world! And that’s not to mention the worst apple of the whole bunch, Barack Hussein Obama!

The change in the Democratic Party, then and now, is so comprehensive and so drastic that it definitely required a new marketing plan! Thus, the focus on branding and name recognition, and attention to little details to go along with their new Socialist identity, and their renewed commitment to their agenda! And their goals are so drastically different than the goals of their predecessors, the Democrats of old, that it is no longer acceptable to refer to their Party as the Democrat Party!

Patriotism is actively discouraged by the Democratic Party of today! The concept of the world as a ‘global village’ is what is really important! They celebrate authors like Noam Chomsky, a self-professed Socialist, Alvin Toffler, a ‘New-Worlder’ and Fareed Zakaria, someone who would like to shred the US Constitution! Our Constitution is too provincial, and old fashioned for them! They say it is completely inadequate for the times we live in. According to them it needs to be updated and modernized to fit today’s world!

National sovereignty is an obsolete idea too. It must be replaced with a sense of belonging to the world, the ‘New World!’ It must be relinquished to a world governing body like the United Nations they claim, in order to advance the cause of world peace. (By the way, you don’t get world peace by surrendering your national sovereignty, you get tyranny instead! You get peace by being considerate of your neighbors, and that goes for countries too!)

“The Federal Debt Ceiling is an anachronism”, our former Secretary of the Treasury Robert Rubin said. “It should be eliminated! It keeps getting in the way!” Well I guess we know where he stands on that issue, don’t we? By the way, he is now the President of the Council on Foreign Relations, which is one of the leading advocates of the so called ‘New World Order.’ “The right of the people to keep and bear arms,” which is guaranteed by the Second Amendment is completely unnecessary! We don’t need to defend ourselves anymore. The US Government will protect us and see to that! There is no aspect of our modern lives that the US Government doesn’t have the right to intervene in and regulate! There is no part of our private lives that is immune from the Federal Government any more! This is the brave new world that is envisioned by the Democratic Party of today! It is the world that they are actively working for, and eagerly hoping to attain, and it is a world view that we have to take very seriously

“When the moon hits your eye like a big pizza pie that’s amore”

For over a hundred years the French people have had a big love affair, not with the moon, nor with pizza, but rather with big government, i.e. Socialism. Last week they renewed their love affair once again by electing a member of the French Socialist Party to be the next President of France. He will replace outgoing French President Nicholas Sarkozy, who by the end of his first term in office had already squandered most of the popular good will that he received five years ago when the French people literally handed him the keys to the Palace. Darn it! I was just starting to get used to the pronounciation of his name! He squandered all of that good will on a legacy of controversial initiatives, followed by a regime of strict austerity measures that many Europeans, not just the French didn’t like! And his equally tough approach to French unions didn’t earn him many friends on the Left either, nor win him the enduring affection of most of France’s blue collar workers.

The last time this happened in France was about thirty years ago when the French people elected another French Socialist by the name of Francois Mitterrand to be their President. But whether the French head of State is actually a card carrying member of the Socialist Party or not, every French leader since the days of Charles De Gaulle has been a Leftist to one degree or another, except for Sean and Marie Le Penn!

This time Francois’ last name happens to be Hollande, instead of Mitterrand. Francois Hollande. I guess I’ll just have to get used to his name. The new French Socialist President’s name is Francois Hollande, and he promises to restore France to its former heydays of greatness by doing away with the Troikas’s recently negotiated European austerity measures, and just taxing the hell out of the rich. Where have I heard that idea before? Oh yes, I know. That’s Barack Obama’s plan to cut the deficit right here in America. Just two Socialist peas in a pod: Barack Obama and his Socialist comrade from across the pond, Francois Hollande. And that goes for their respective Parties too, the French Socialist Party and its evil twin sister, the Democratic Party in our own country.

At least the French have the nerve to call something what it really is: Socialism! Francois Hollande’s plan is to tax the hell out of the rich is a Socialist plan. That’s how he intends to try to balance the French budget, restore the value of the Euro, provide for all of the French social programs that his sycophants clamor for, and restore the French economy to financial soundness again, yata, yata, yata, all on the backs of the rich. Well good luck Francois, but I don’t think that’s ever going to happen. Rob from the rich and give to the poor is not a sound economic policy, nor is it a prescription for national greatness. It sounds more to me like a recipe for overall mediocrity and total national disaster!

Reince Priebus – Wisconsin Shenanigans

Scott Rohter , May 2012

The word was when Reince Priebus was first being touted for a position as the National GOP Chairman in January 2011, that he was a good strong conservative from Madison Wisconsin. Hummm… I thought. “A strong conservative voice from Madison Wisconsin.” Is that even possible?.. While I thought it was a bit unlikely that such a thing could actually be coming from a place like Madison, the home of the University of Wisconsin, nevertheless I stifled my skepticism and tried to keep an open mind. A lot of things are possible you know… especially in the land of Vince Lombardi ! And so after six unsuccessful attempts to elect a Party Chairman, a deadlocked group of Republican delegates to their Party’s Central Committee elected Reinhold Priebus, attorney and a former Wisconsin State Party Chair, to lead the National Republican Party on January 14, 2011 in an unprecedented seventh ballot.

My first inkling that something wasn’t quite right though,… that his performance didn’t quite match up to all of the rhetoric, was when my calls to the RNC did not get returned, not by him or by anyone else. My next observation was when Mitt Romney got caught red-handed trying to steal the Iowa State caucuses away from Rick Santorum. Then nearly the same thing happened again, I think it was either in Maine or New Hampshire. My initial pause for thought over Reince Priebus was now causing me to slow down a little bit and take notice.

Once more in Ohio there were serious violations of the official Republican Party rules governing Primaries with respect to the apportioning of delegates. This was cited by the Santorum campaign. All of these things were going on under the watchful eye of the National Republican Party Chairman, Reince Priebus! When Texas wanted to go to a winner take all Primary last month, (and it was perfectly legal for them to do so) the RNC found some way to stop them. There was that too. Then all of a sudden and for no apparent reason, Rick Santorum suspended his Presidential campaign, when he was really doing quite well against The Establishment’s favorite candidate Mitt Romney,.. and with comparatively little resources.

Now under Reince Priebus’ watch there is blatant and open candidate favoritism going on during the remainder of the GOP Primary (against the rules) while there are still two candidates left in the race, which by the way is not over yet, not at least until Mitt Romney racks up the magic number of delegates… (I think the official number is 1144). Maybe the Republican Party does not think that Ron Paul is actually a real candidate in this race? I know they wish that he wasn’t! But he is! So now my original pause for thought has turned into an abrupt, screeching halt!

Only Pandering, Insincerity, and Political Expediency Do I See

By Scott Rohter, May 2012

Two months ago nearly all of the Republican candidates in the Primary were literally “one-upping” each other to sound tougher on illegal immigration… A border fence, NO amnesty for illegals, NO pathway to citizenship, mandatory use of E-Verify, and tougher sanctions against employers who hire illegals! All of these options were being touted by the candidates. About the only candidate who stood out like a sore thumb was Texas Governor Rick Perry with his soft styled illegal immigration policy of granting in-state college tuition benefits to illegal aliens in Texas. But even that little discontinuity was too much for most Republican voters across the country to bear!

Governor Perry’s position that it wasn’t possible to build a fence along our southern border sounded the death knell to any aspirations that he might have had to become our nation’s 45th President. It was a non-starter to most conservatives who want to regain control of our country’s future. And his soft-style Texas illegal immigration policy was the main reason that the TEA Party conservatives never really warmed up to him.

But as the campaign went on, more than just the tone of the rhetoric changed! Newt Gingrich started the shift in position with his soft on illegal immigration answers at the Florida Presidential debates and just prior to the Florida Primary.
