BREAKING: Follow up to Dr. Gosnell and the State of Pennsylvania

I’ve been waiting to see how this particular case would progress, and today it was announced that the lawlessness of state agencies involved in the Gosnell case will be held accountable for failing to abide by the law.

For those who may be unfamiliar with the case of Dr. Gosnell, he is a physician residing in the state of Pennsylvania who has been operating an abortion clinic (of sorts) during the past 30 years. He has raked in millions of dollars in payments during that time performing illegal and late-term abortions.

The following provides an accurate yet grisly description of the methods used by Dr. Gosnell and the conditions in his clinic:

“There were bags and bottles holding aborted fetuses were scattered throughout the building,” said Philadelphia District Attorney Seth Williams. “There were jars, lining shelves, with severed feet that he kept for no medical purpose.”

Gosnell has been named in at least 10 malpractice suits, but Williams said state regulators ignored complaints about his clinic and that the office hadn’t been inspected since 1993.

Patients endured barbaric procedures at the hands of the twisted doctor, officials charged.

Gosnell “induced labor, forced the live birth of viable babies in the sixth, seventh, eighth month of pregnancy and then killed those babies by cutting into the back of the neck with scissors and severing their spinal cord,” Williams said.

The current status of Dr. Gosnell’s clinic was discovered entirely by accident during an investigation by local police as part of an illegal prescription drug probe. They found a warren of filthy rooms wreaking of cat urine and feces, bloodstained walls and bloody blankets, women “walking around like zombies” and fetal parts in bottles and stored in plastic bags placed in the freezer.

On January 14, 2011, Dr. Gosnell was charged with the murders of seven children and one woman. The one woman he is charged with murdering was 41-year-old Karnamaya Mongar who died at Dr. Gosnell’s clinic after receiving an overdose of anesthetics. The anesthetician was a 15-year-old operating with no license.

Employees of both the Department of Health and the Department of Justice were aware of the situation within this clinic. Dr. Gosnell was licensed as a family practitioner who was not a qualified OB/GYN. He has been named in at least 10 malpractice suits, but state regulators ignored complaints about his clinic and the office hadn’t been inspected since 1993.

I had little doubts with all the evidence against him that Dr. Gosnell would be charged for these crimes. This man had preyed primarily on poor people of race, and his hideous, despicable actions speak for themselves. But I’ve wondered what the response on the part of the state legal system in PA would be toward these state agencies. This is an example of lawlessness within our government of agencies that should be enforcing the laws that protect the general public from individuals such as this doctor. They failed to do so and in this failure, did they become complicit in those deaths?

Today, it was announced that these two agencies are being investigated for enforce the laws of the state.

Testifying before a Senate joint committee meeting, Williams laid out a case of a massive “system failure” by the Departments of State and Health which he said ignored years of complaints and allowed the abortion clinic run by a doctor now charged with murder to operate for unchecked for almost two decades.

Williams and his top deputies told a joint Senate hearing that had any state official followed up on a single piece of the voluminous amount of evidence suggesting wrongdoing, or set foot in the filthy clinic, it would have immediately been shut down. …

The officials at the State Department of Health have now become “dismissive” of the allegations against Gosnell to which they are now associated. They have also pursued obtaining outside legal representatives for their defense at the present cost of $116,000 to the taxpayers of Pennsylvania.

Under the state law in Pennsylvania, clinics such as Dr. Gosnell’s are not considered to be an outpatient facility. They do not have to abide by the laws governing outpatient facilities, which is a contributory factor to why this particular physician was able to hide under the guise of providing a “valuable service to the community” for as a long as he did.

In their efforts to “control the narrative”, those who support abortion will say that this is why abortion should be made legal and free to all who choose it, supported by government funding. When we normally would hear from the left how government has a responsibility to protect us from “greedy capitalists”, we hear justification of this man’s actions.

The reality is there we do have laws that were established for the purpose of protecting the public from the hideous actions of these kinds of “physicians”, but when those entrusted to enforce the law fail to do so, it perpetuates the kind of environment that allows these types of situations to take place again and again and again.

And there is no “agenda” that can be justified by this. None.

    This is true of all levels of govt = federal, state, county, township, city, town.
    These performance audits are the only way to prevent/stop the kind of “falling through the cracks” or fraud that can occur in any type of organization.
    No one wants to pay for this. However, since all govts are funded by public tax $$ – citizen audit groups shoud be allowed/encouraged.

    Wasn’t the argument for unfettered abortion access that we didn’t want our daughters forced to back alley abortionists with unsterile condidtions?

      than I’ve got at the moment. There’s been way too much glossing things over from the top down and trying to make feces smell like roses for me to have confidence that our judiciary will have the resolve to do what is right…especially if they face the DHHS leviathan.

      We’ll see how it goes. I’m glad to see it at least reach this point. And I hope the DA in Philly will stand his ground.

    when I first read about this mad mans slaughter house. Since then I refuse to call him “Dr.” he is Executioner Gosnell. For those that would defend him for whatever reason I simply ask one question; “What possible reason could anyone have for keeping parts from an dead child?” That should end the discussion of whether this was a legitimate “medical practice” right there. This “man”, and I use that term in is loosest possible sense, is a MURDERER, not a Physician.

    Another thing that is significant is the fact that he had been the subject of 10 malpractice complaints. Most people seem to take this point as just a matter of course, but this is a HUGE number of complaints against one physician, most Doc’s will probably be name in one or two in a full medical career, and may only be mention as part of a group, but to have 10 direct malpractice suits against him is very significant and should have been a warning sign that someone should have looked further.

    I also wonder why no one is questioning the state medical board in Pa.? I don’t know for sure but usually the State Medical Board would be the one to investigate complaints, especially against a physician with 10 malpractice suits against him. I have know of physicians who were stripped of their rights to practice for far less than the things this man is accused. Why wasn’t he investigated by them. While they are sweeping the front porch, so to speak, they may need to pay special attention to the corners.

    Also the State Board of Nursing for Pa. should be heavily involved if he did have any actual “Licensed Nurses” working in his slaughter house.

    *I use the term “Licensed Nurses” here because as a nurse I believe there are 2 kinds of Nurses, those that went to school and passed the test and those of use who are really Nurses with a capitol “N” regardless of Licensing.*

    Realistically I think this is just probably a maneuver by the “powers that be” in Pa to look like they are doing something about this horrible situation, I would hope it is more but I think in the end this will be one of those; “fire some folks that aren’t really responsible and make it look like we did something”, responses.

    The following quote from your post I think could use revision.

    Instead of lawlessness I see it as Liberalism in our government. Though as I sit and think about it the two terms are pretty close to the same thing, I guess.

    I read about this story two weeks ago. I have been a nurse for 15 years and I can’t think of anything I would rather do with my life, but when I read things like this I am just Livid. This person is guilty of so much more than 17 murders, think of the 15 year old who was putting people to sleep for him, what will the rest of his life be like?

    This person has given the entire medical profession a black eye and has been for some time.

    Think of the police that had to walk into a room with baby parts in jars and a freezer full of baby parts, what must their dreams be like for the past few weeks.

    Think of the mothers that went to this person for what I fully believed at the time was the right reasons, who will spend the rest of their lives wondering if this man lied to them and then killed their child with scissors. In 15 years of nursing I have never encountered a patient who had an abortion that did not regret it later, at least of those that spoke with me about the subject.

    Oh, Gosnell is guilty of so much more, but this comment is already far to long.

    I pray for the souls of the accused, since the punishment that is given here is nothing compared to the punishment to come. I pray for this mans victims, may they find peace here on earth until they rest in the hands of God. I pray for the unborn who were viciously murdered by this man, who I know rest in the hands of God. Lastly I pray for those mothers who are considering having an abortion, if you don’t want to love your child there are families out there that will, give them the chance.

    Okay, so this could add to your misery at the moment, and I’m sorry for that, but he induced labor, births occurred, and THEN he severed their spinal columns.

    I work in a health care-related field, and we getting a lot of emphasis thrown at us regarding what the law truly is. I find it next to impossible to believe that Medical Board in PA was unaware of this. They claim that this “physician” slipped through the “cracks in the system”. If that is true, their system is too complacent. Period.

    My daughter is studying nursing, Mike. In her clinicals she hears day in and day out about documentation and “prudent behavior” for nursing, but the school isn’t seeing this as an opportunity to teach nurses the law. So, I’m sending her what I can, particularly when situations such as this come up, so she can see the extremes of what can happen when the laws are violated.

    But it infuriates me to no end that the state employees apparently think of themselves as being above the law with no need to enforce the law. That isn’t acceptable.

    At this point, given some of the comments Mr. Williams has made, I see him as being determined to follow through with this into the court system. I support his decision to do so and hope others will follow his example.

    Need to be distributed far and wide. Millions of average a-political Americans have no idea this is going on. No idea of the lenghts the far left pro-aborts in the government and the media will go to promote and protect the abortion industry,

    I’ve got to share this bit of info with you. I know you have a project of your own going on…and now it seems that I may have mine.

    I mentioned in the comment above that my daughter is studying nursing. They’ve been provided with very brief legal seminars through the school, but nothing in depth.

    She isn’t a-political, jerry, but she has a lot of demands on her time and doesn’t get much opportunity to review what’s going on right now. So I’ve been sending her info on this.

    She went to the department head at the school and asked why they weren’t getting more education regarding the legal implications of nursing in health care. For a licensed nurse, to even remotely be involved in the kind of activity that occurred in the Gosnell case would be a direct violation of the law and could cost the nurse the license at the least and criminal charges, depending on what the court rules.

    The department head was open-minded enough to at least hear her out, but asked how it could be presented in a practical way for educational purposes.

    My daughter called me, and I suggested that maybe they could do a “mock trial”. She contacted the department head and the school is considering it.

    So…I’ve got to get some more info together to send down her way. But if they are willing to try to take this approach, a lot of good could come of it in the long run.

    and a “mock trial” is an excellant venue. Obviously these butcheries need crooked medical professionals willing to refer people to them to survive.

    Scaring the begesus out of those professionals so they dont even consider it is a great idea.
