Six Years Ago Today…


Daniel Pearl was kidnapped, later to be brutally beheaded by his captors with the video proudly posted on the Internet for the world to see.

The terrorists who committed this act, were they to be captured today under the Obama Administration’s policies, would be brought to the mainland United States for trial in civilian courts, be granted the rights of habeas corpus and the right to remain silent, could not be subjected to any coercive interrogation practices, and would have the right to see all evidence against them, as well as cross examine their accusers.

Rest in peace, Daniel.

If I remember correctly, the men who beheaded this man were cowards, who wore masks and concealed their identity. So you’re saying that if we caught the men we *thought* were the perpetrators, they shouldn’t be allowed a fair trial in the court of law? What if we were wrong? What if we had the wrong guys? They should be subjected to torture anyways? Locked up for two years with no trial, and then given a mocked up, BS tribunal?

I don’t know guys, what’s the issue here?

These guys made a video of themselves cutting the head off of a man and played it on the internet, if we were able to get a positive id on them and found their location, I would personally board a C-130 with my -10 and jump in in the middle of the night and take my silenced 9 mm to the back of each of their heads and gently pull the trigger…and I would have not one doubt about it being the right thing to do…no jury, no evidence, no witnesses…just the calming crack of my gun and a yellow glow surrounded by a brief moment of pink mist….then I would walk away while eating a bologna sandwich.

That is how I feel about this and I hope it makes you have bad dreams at night.

How about anybody who can be associated with a terrorist group - aQ, Hamas, Hezbollah for starters - should be considered to be an “enemy of the United States” and should be killed outright by any means possible. Oh, and to clarify, that would include those people who provide “aid and comfort” in terms of money and assistance.

Do you have any idea how many trials were conducted before the end of the war?

I had not realized about the anniversary and its being 6 yrs. ago.

Here’s hoping that 20 years from now the Obama administration is forgotten about except as a novelty Presidency and that no long-term consequences remain from his dunderheaded policies.

This is at the heart of the matter. Suppose some of those prisoners are set free on a technicality or some other reason. Are they then free to stay in the US? Obama may be getting in over his head here. Of course that’s nothing new.

That's kind of fallacious argument

I am not sure thats the best argument. If these were common criminals and we thought they beheaded someone i.e. gang members, they would be afforded Habeus rights. If they were soldiers and they were captured on the battlefield, they would *possibly* be subject to coercive measures not including torture (i.e. waterboarding if you assume its not torture), but most would be chocked if we did that soldiers in a conventional war.

However, just because they are neither criminals nor soldiers but somewhere in between, does not necessarily mean that the shouldn’t be afforded rights we afford to either.

They may be ‘enemy combatants’ but thats not discussed in the intitial posting. What should be referenced in this is that under the One’s legal theories, there is no such thing as enemy combatants, there are either criminals are soldiers and they are afforded those rights respectively. The real argument is whether or not such categorizations are legitimate under our laws and constitution.
