Hey, turns out that the wiretapping thing’s constitutional after all!

Just in time, too. Wow. We neocons are *good* at this.

(Via Hot Air) You know, I was going to come up with all sorts of snark directed towards the people who are swearing at this NYT headline (“Intelligence Court Rules Wiretapping Power Legal“) – but then I remembered that, really, there’s no sport to it when it comes to this bunch.

    The opinion did not directly rule on the legality of the once-secret operation authorized by President Bush between October 2001 and early 2007, which allowed the National Security Agency to eavesdrop on the international communications of Americans suspected of ties to terrorists.

    I don’t think anyone is disputing that its legal NOW… i mean we did pass that law during the election after all.

    I’m thinking the NSA has been ‘listening’ to overseas calls for a very long time…..before 2001.

    You might want to read the ruling yourself, instead of relying on an interpretation from the New York Times.

    It pretty much lays waste to any future plans to hold the Bush Administration liable for any perceived Fourth Amendment violations arising from the implementation of the NSA’s Terrorist Surveillance Program.

    It’s called the inherent constitutional authority of the Executive, and in only the second public release in the Court’s thirty-year history, it’s been validated by the FISA Court, again.

    For these reasons, we hold that a foreign intelligence exception to the Fourth Amendment’s warrant requirement exists when surveillance is conducted to obtain foreign intelligence for national security purposes and is directed against foreign powers or agents of foreign powers reasonably believed to be located outside the United States.
