Good morning, Senators Collins, Snowe, and Specter.

Jim Geraghty is quite blunt about the consequences of Sen. Kennedy’s being absent for today’s vote, and Sen. Gregg’s return to the Senate: “Guess what, Sens. Snowe, Specter, and Collins? You are providing the decisive votes.

And Senator Reid is worried about this. He’s trying to scare up another GOP Senator to give cover to these three - something that even his own people are admitting to be a low probability scenario. Roll Call (no link, sorry) is also reporting that he’s trying to pair Kennedy’s yes vote to a Republican’s no (this requires the approval of the Republican in question, by the way) in order to make it a 61/38 vote on a technicality. Just in case this isn’t clear by now: this is contraindicated for any Republican Senator.

Contraindicated.

So. Going to be a fun vote today, huh? Pelosi and Reid have been hiding knives under their smiles at each other throughout it all, and particularly yesterday: Reid is still scrambling for the support he needs to make sure that his caucus can cash the checks that his ego wrote; Pelosi’s inability to control the CBC has likely made Sen Gregg inaccessible to any deal (not to mention, embarrassing the President at the worst possible moment); the Democratic Congressional mood is so ugly that the White House had to send in Rahm Emanuel to keep everything on track; and, in the piece de resistance to this unholy mess of legislation, when they finally got copies of the debt bill that nobody’s read and nobody has time to, the first copies went to K Street lobbying firms.  No.  Really.  Democratic staffers were forced to admit to press people today that they didn’t have details about things that lobbyists had already told the press.  There’s something… pure about that.

Don’t get me wrong: betting that it’ll pass is still the safe bet.  But it’s going to be one heck of an ugly win, and it’s not one that’s going to enhance the reputation of Democratic legislators.  Or of the three Senators that chose to stand by them.

I read the HR-1 bill and as a Government Contractor I do not see how 50% of this money can be spent by FY11. Yes, the money will be allocated, but expenditure rates will never top 58% of this total by CY10. None-the-less, the faster the disaster the quicker the we can get it undone. Programs, contracts and unobligated funds can still be withdrawn (I think) after the 2010 midterm elections with a 94 or 08 type uprising. Anyway, better start getting my proposals ready for the competitive contracts except FFP contracts blow. FFP + performance incentive is better.

I thought everyone was saying yesterday that only a simple majority of the Senate vote was needed to pass this thing once it came out of conference. I thought the 60 vote was for cloture on the Senate version of the bill, and was necessary to overcome a potential filibuster. What’s going on with this? (Forgive me, I’m a Canuck and am still learning about the American method of legislative sausage making.)

I believe cloture was established for the bill that was in the Senate before the joint conference to merge and compromise the two different versions HR-1 and the Senate version. Now it has to come up to the Senate again for another vote and I believe if the Republicans can establish a complete caucus they can fillibuster indefinitly; however, do not count on it. Lastly, I am American and I do not even know what is going on in this country anymore. Things like this used to take time, our founders wanted it that way. Now everything moves lightening fast based on some urgent and compelling need.

the bill will be subject to a “point of order”. So, while there is no filibustering a conference bill, there is still the need for 60 votes to Wave the point of order, specifically because, this a Deficit Spending Bill.

It surprises me that other conservative sites haven’t spotlighted this point to keep everyone aware that we are but 2 Senate votes from stopping Porkulus (actually 1 if Kennedy can’t vote).

Reminder to self…always, always question the context! I had unwittingly accepted that it only would take 50 senate votes to pass. Even if other conservative sites aren’t doing it.

A POINT OF ORDER is made during floor proceedings to assert that the rules of procedure are being violated.

A point of order halts proceedings while the presiding officer rules on whether or not it is valid.

In the Senate, the chair’s ruling may be appealed by any Senator. The Senate votes on the appeal and the chair has been frequently overturned.

In the House tradition, appeals are also possible, but rarely entered and almost never succeed.

which seems to me would play out as

  • A POINT OF ORDER is made during floor proceedings

      → A Republican raises a "Point of Order"

  • A point of order halts proceedings while the presiding officer
      rules on whether or not it is valid.
      → Biden rules no

  • In the Senate, the chair’s ruling may be appealed by any Senator.
      → A Republican would appeal

  • The Senate votes on the appeal
      → The vote to overturn Biden comes no where near the 60 affirmative votes necessary.

from the Senate bill already passed. I believe that means another chance to filibuster, meaning Democrats must get 60 votes again.

Gregg’s presence or absence is irrelevant. The number of “NO” votes doesn’t matter in a cloture vote: there must be 60 votes to shut off debate and schedule the final vote. Without Kennedy, the defecting Republicans are key. They must be enticed to vote FOR the package - if they even abstain it is as good as a “NO” vote.

As a Christian, I believe in redemption. Snowe, Collins, and Specter have the chance; it is up to them to take it.

America is slowly beginning to sober up and wonder, “We elected WHO, again?”

Giving it another 48-72 to fester out in the open before the final vote is probably the best case scenario for us. It could be that they allow it to the floor and then all vote against it, so that there isn’t a single GOP vote in either chamber.

Gang of 3 - something to think about before you vote...

Sen. Specter - you have had health conditions that required medical treatment or you would not be here with us today (unless there was a miracle - which I believe in) and in this porkulus bill there is a portion of this bill that requires a federal “overseer” to watch and approve medical treatment ordered by a person’s doctor - what if this unethical (in my opinion as a Registered Nurse) were in place when you needed treatment? Would you have gotten the treatment you needed? And as I remember you had to have more required medical treatment again after that episode? Would the federal “overseer” approve that treatment? If any of that would have stopped your treatment Senator would you be with us today? I am not trying to be mean but bring you back down to earth with the rest of us - back to reality - please Sen. Specter think of this before you vote.

To all three of you Senators in the Gang of 3 - do you think ACORN will get out the vote for you when reelection comes up? I don’t know possibly if you vote like a democrat maybe they would but I doubt it. Why is ACORN being funded? Remember those pesky little federal investigations into VOTER FRAUD by this sham of a group!!!

Last but not least Senators please consider this - what you worked on to get taken out is now rumored to have been put back in. In a sane world I would ask you to read the bill and consider your vote being you were USED by Obama/Pelosi/Reid but there is a big problem - not many people are going to be able to look at the bill before they vote - I hear about 4% of all of Congress will have that opportunity - so take chance, be a fool, send your Country down a path of hardship so that you can have $$$ sent to your two states and help with your personal political power but please remember this too - this will backfire on you and already have as far as the democrats and you will be challenged when reelection comes up if you choose the selfish route and not the route that is best for the Country. I hope someone gets our comments to you. I hope you consider this and remember why you wanted to go to D.C. in the first place and why you chose to be a Republican - obviously you have forgotten why you went and forgotten that you are Republicans even if in name only. I pray you stop this and let people see what Pelosi and Reid have added to this mess.

Is the full exposure of their motives. If they vote against the bill, we get the argument that the Dems double-crossed even the “Republican Moderates” who voted for cloture and Specter, Snowe, and Collins get cited for being stupid but not necessarily treacherous.

if they vote in favor of it, find some way to get rid of them, primary specter and figure out how to get rid of the Maine sisters. They are just undermining our message.

How can anyone be surprised when an ideology that regards wealth as a cardinal sin cannot produce it?

You would think he would keep in mind the fact that he would not be alive, according to the rationing of medical treatment to come as a result of the beginnings of Socialized Healthcare in this bill. Haven’t we read that the elderly will suffer the most. Specter is not a spring chicken. The other day, someone on this site used the quote “all for me, but none for thee.” I suspect that Congressional members will not be a part of the “rationing” that the rest of us little people will be subjected to. Even though he has earmarked $6 million for the National Institutes of Health (why?), he is seeming to be oblivious to what is in the rest of the bill. Wasn’t thre some language lately about cutting back on developing new drugs and treatments?

Does the GOP have the ability to force a reading of this bill by the Clerk? It seems like that should be discussed as a legitimate option at this point. 1400 pages of reading would give people time to examine the bill, if nothing else.
