Gov Deval Patrick (D, MA) just gave the GOP three more House seats.

And I’m blaming the Governor for this one because I find it inconceivable that he would have let his subordinates set policy in such a nakedly partisan fashion without him first signing off on it.  Apparently the Democratic party just doesn’t care how many ‘moderate’ Democrats have to have their careers sacrificed to the leadership’s ambitions.   I don’t know where we’ll use this development – yet – but if you think that we’re not going to use this (win or lose):

The U.S. Senate ultimately will schedule the swearing-in of Kirk’s successor, but not until the state certifies the election.

Today, a spokesman for Secretary of the Commonwealth William Galvin, who is overseeing the election but did not respond to a call seeking comment, said certification of the Jan. 19 election by the Governor’s Council would take a while.

“Because it’s a federal election,” spokesman Brian McNiff said. “We’d have to wait 10 days for absentee and military ballots to come in.”

Another source told the Herald that Galvin’s office has said the election won’t be certified until Feb. 20 – well after the president’s address.

Since the U.S. Senate doesn’t meet again in formal session until Jan. 20, Bay State voters will have made their decision before a vote on health-care reform could be held. But Kirk and Galvin’s office said today a victorious Brown would be left in limbo.

In contrast, Rep. Niki Tsongas (D-Lowell) was sworn in at the U.S. House of Representatives on Oct. 18, 2007, just two days after winning a special election to replace Martin Meehan. In that case, Tsongas made it to Capitol Hill in time to override a presidential veto of the expansion of the State Children’s Health Insurance Program.

…to hammer home the point that Democrats Lie, think again.  The ads write themselves, and even should Coakley win the speed with which she’ll be installed will still let us run those ads.  And she would be installed speedily: her party’s leadership doesn’t just lie.  It assumes that the electorate is dumb, too.

It’s not, by the way.

    In 2004 when Teddy thought Kerry might become presidrnt he convinced the state legislature to strip then Gov. Romney of the power to appoint Kerry’s replacement.
    When he died the state legislature quickly changed the law back almost overnight to allow Deval Patrick to appoinnt Kennedy’s replacement.
    Pretty bleepin’ sleazy and the hypocrisy was off the scale.
    I can definitely see some questionable shenanigans being perpetrated.

    Deval Patrick actually arm twisted the state legislature to not allow a successful petition drive to put gay marriage on the ballot in 2007 by convincing (bribing) state legislatures not to give it fifty votes out of nearly 200.
    That has never happened before.
    He doesn’t give a rat’s ass about the will of the voters as this may be his only term as Governor.
    State run health care in Mass. is going bankrupt btw.

    But Kirk of Coakley, I dont think they’ll rush to install anyone. They are one and the same.

    But great campaing fodder for now. This works in Brown’s favor.

    A man who can put the final stake in the health care opposition might have a pretty big chit to redeem by some powerful friends.
    They would promise him anything. Not that he would need to be bought off as he is a big supporter of state run health care already but he would definitely have a favor to cash in later.

    Under my non-legal interpretation of the new Mass. law, there will be no MA senator beginning the day after the Special Election until a new Senator is sworn in. Even if the Democrats maintain the seat, it seems by their own admission they would not have their “60th vote” sworn in until February 20th.

    Of course, by the time they realize this tomorrow they’ll reverse course again.

    SECTION 1. Section 140 of chapter 54 – (f) … upon a vacancy … the governor shall make a temporary appointment to fill the vacancy; provided, however, that the person so appointed shall serve until the election … to fill the vacancy …

    I believe the original special appointment was itself unconstitutional and wish the Republican Party — either the state or National party, would have fought this more.

    Okay. I assume in 2007 the Congresswoman was certified because she won by a big enough margin that there weren’t enough votes outstanding.

    Assuming Brown wins if the margin is by thousands that is big enough to override the number of the military ballots and Brown should be certified immediately.

    If I’m running as a Democrat for the US Senate I won’t want that commercial running just before election showing the games that Democrats want to play to retain their control of the Senate. Easy way to convince still undecided voters to show up and vote Republican.

    Not to mention there has to be some Democrats who believe in fair play and rules. After all that is what Franken was using to steal the election in Minnesota.

    3) It was debated in both chambers.
    4) It passed in both chambers.
    5) It was signed into law.
    6) Patrick named Kirk.

    The above steps (I may have missed a few) were completed in less than four weeks.

    Massachusetts law provides that the Governor may certify the results of this special election seven days after the election. That officials are now allegedly conspiring to wait for weeks after the special election appears illegal:

    The governor shall issue certificates of election to such persons as appear to be chosen to the offices of senator in congress, representative in congress, clerk of the courts, register of probate, sheriff and district attorney, which shall be countersigned and transmitted by the state secretary. No certification shall be made or summons or certificate issued under this section until after five o?clock in the afternoon of the fifteenth day following a state election, or, in case a state-wide or district-wide recount is held in accordance with section one hundred and thirty-five, until the tabulation and determination under the preceding section have been revised in accordance with the results of such recount; provided, however, that such certification may be made or summons or certificate issued on or after the seventh day following a special state election, unless a candidate who received votes at that election files with the state secretary, not later than five o?clock in the afternoon of the sixth day following the election, a written statement of intention to seek a recount or otherwise to contest the election.

    You are correct. I took the ellipse quoted from the Green Papers. I also wondered what was between the ellipses, so found the original law in it’s entirety (which I linked to), and read the bill. However, I didn’t see anything of substance that was lacking. It was very early in the morning (EST), but I still missed it. Thanks again, as this certainly changes my analysis.

    Ted Kennedy dies as number 1

    From Kennedy’s death to Kirk’s swearing in was one day under a month, and that included the Labor Day holiday.

    Patrick and company are saying it will take one day more than a month (with no holidays) from election day just to get to certification if Brown wins. If Coakley wins, no doubt they’ll find a way to move things along more smoothly.

    The below November 12th (Thursday) article states that Owens was sworn in on November 6th (Friday), 3 calendar days after the special election, and that winner in the California election was sworn in on November 5th, only 2 days after the special election.

    I knew something was going on and nothing good when suddenly I got responses from emails I sent to John Kerry months ago. Kerry never responds, he’s known as a do nothing senator.

    I never agreed with Ted K on a single thing, but must give him credit for having a staff that responds. I would call his office and even when I called to disagree with him I woud get a letter either in the maill or email, sometimes both, telling me why Ted felt the way he did. I called once just to tell the staff that I appreciate it that he does respond. Staff member told me that Ted appreciates us even when we don’t agree.

    Tuesday, Jan. 19th: MA Special Election

    Friday, Jan 29th: 10 day deadline for military & absentee ballots passes:

    ?Because it?s a federal election,? spokesman Brian McNiff said. ?We?d have to wait 10 days for absentee and military ballots to come in.?

    Saturday and Sunday, 30 and 31 January: No military or absentee votes are counted. (Dems run election process in Mass—’nuff said).

    Monday, 1 February: Dem-run election apparatus begins detailed, time-consuming forensic analysis on military/absentee ballots to assure their “authenticity,” for the People’s sake and out of respect for the memory of Ted Kennedy.

    At the same time, Tea Party members—who’ve seen this scam coming from a mile away—mass in MA and “convince” the Mass Dems to quit stalling and count the votes. (Because they’re Tea Partiers, they thought ahead and secured permits for public demonstrations outside the appropriate local offices throughout MA).

    Tuesday, 2 February: MA localities grudgingly report their military/absentee vote totals. GOV Patrick looks for other ways to stall the process. DNC helpfully files lawsuit after lawsuit after lawsuit. Tea Party converges on Boston.

    Wednesday, 3 February: Mass Dem Party leaders corner Governor Patrick and tell him that they’re not willing to risk a revivial of the GOP statewide., simply so Governor Patrick can collect a “solid” with President Obama that he can translate into an ambassadorship or lucrative position at Fannie/Freddie (once the Mass voters blow him out of office in 2010.) Patrick relents and certifies Brown as Senator.

    A crew of Tea Partiers throw newly-elected Senator Brown into a minivan, trade shifts for driving, and drive him down I95 to Washington.

    Thursday, 4 February: The minivan arrives, and GOP staffers hustle Brown into the Senate chamber.

    So, Senator McConnell, can you stall until Thursday morning, 4 February?

    He will still be there for the upcoming agenda. This congress and administration has more devastation to our country on the agenda – mass voter registration, immigration reform, etc…. even if Scott does not make it in time for the Health Care vote, he will be there to insure against the next nightmare they throw at our Constitution and the American People.

    Off the top of my head, I’d expect those tactics to be:

    1) Challenges of all types to the ballots.
    2) Drawn-out procedures at the local levels, to delay cerrtification at the local levels.
    3) Demand recounts, wherever they can get away with it.

    Things that I HOPE the MA and national GOPs are in the process of doing RIGHT NOW:

    1. Securing permits for public demonstrations in the MA communities most likely to mess with the ballots or the ballot certification procedure. The Tea Partiers and others will need a place to legally gather when the time comes. In some places, it takes a while to get these permits; we need them in hand on 20 January. Surely we already know which communities are most likely to slowball the process—-where are the Dems the strongest in MA? If we haven’t filed for permits already, get cracking on Monday.

    2. Identify the legal tacks the Dems can use to slow the process down, and PUBLICLY prepare a legal response. Make it clear that GOP lawyers are ready to attack. Perhaps that might make the Dems think twice about filing lawsuit after frivolous lawsuit.

    3. Study the Minnesota Senate election from 2008. A classic example of how smart political tacticians (Franken’s team) worked the system to their advantage. Does anyone think the Mass Dems will miss any trick they can pull, if a recount or ballot certification do become central to the election’s outcome? Shame on us if we’re not ready.

    At present are the largest ever federal tax increases and entitlement under debate in the U.S. Senate with a partisan majority rule at risk. 417 Mass. 406 In the first place, art. 7 speaks essentially to a right of the people to institute and change government?

    Of part of the fist art.23, No subsidy, charge, tax, impost, or duties, ought to be established, fixed, laid, or levied, under any pretext whatsoever, without the consent of the people or their representatives in the legislature. Thus the consent of the people must be upheld, that all the inhabitants of this commonwealth, having such qualifications, have an equal right to elect representatives, of the fist art. 9, thus consent of the people as paramount and no other.

    Brown’s folks have *got* to be willing to bring out the brass knuckles and realize in their guts that the people that they’re dealing with have no morals and no scruples.

    Coleman’s team made all the right legal moves but lost this whole thing in the arena of public opinion because they were too busy playing by the Marquis of Queensbury rules with nicey-nice press conferences and press releases instead of calling out SOS Mark Ritchie and his ACORNuts for the thieves that were and are. As a result, this entire bastardization of the electoral process can’t even be used as a campaign issue against Ritchie this fall.

    It would be good to get the opinions of people more in tune with legalese, but as I understand the gobbledegook of the overblown and bloated FEC regulations (roughly 30 times longer than the U.S. Constitution), it’s ok for an employee of a federal contractor to donate. The prohibition is against companies and individuals who themselves hold government contracts.

    Democrats have admitted to a scheme to ram through the Healthcare Rationing vote before Scott Brown can be sworn in as Senator, should he defeat his Democrat opponent on January 19th.

    Paul Kirk, currently serving as interim Senator in Massachusetts, has declared that Brown, if he should be elected, will be delayed from any voting in Washington for as long as possible. Masssachusett?s Soros-funded Secretary of State, the corrupt William Galvin, has promised to do everything he can to stall the certification of Republican Brown ?so that Democrats can pass the healthcare bill?.

    Governor Deval Patrick, Senator Kirk, and Secretary Galvin fully intend to steal the will of the people and jam this Healthcare Rationing bill through the Senate, election be damned, no matter what the people of Massachusetts want.

    Martha Coakley remains on vacation regarding all this, not bothering to comment on any of it. ?Why should I?,? we imagine her asking, ?I?ve already won this. It?s the Kennedy Seat. I get it next. Caroline Kennedy said so. Vicki Kennedy said so. Other Kennedys said so. It?s mine, and I?m going to vote the way Harry Reid tells me, and I think it?s good Deval and Paul and William intend to do everything they can to prevent Scott Brown from ever voting in the Senate. I think this is all funny. I must, or I would be out there condemning it. Remind me why I?m back from vacation talking to you again??.

    It?s going to backfire on Democrats in a very big way.

    It?s the kind of thing that, if this happened in Illinois, we?d actually take to the streets and riot over, screaming and yelling and demanding the government be dissolved and new elections be held for Governor and Secretary of State.

    But what do you think would happen if some Americans began to rise up and heed Thomas Jefferson’s admonition “Whensoever the General Government assumes undelegated powers, its acts are unauthoritative, void, and of no force.” and decided to disobey unconstitutional congressional edicts?

    I have been asking Cornyn over and over to be ready to legally battle this in Mass. But I am not convinced that he and Hutchison both are not such RINO’s that they are not more of a help to dems than a hinderance.

    Hutchison runs ads in Texas that she if fighting for health care and that is why you should feel sorry for her and vote for her in the primary for Gov. I have not heard ONE WORD from her about how Texas will fight healthcare. On the other hand Gov. Perry and Texas Attorny General Greg Abbott are on it.

    We have told Cornyn to STOP backing RINO’s for office and start working for conservative candidates. We again warned him this morning that they should not be caught with their pants down on this election. Kirk’s term will be over on the 19th. Any vote after that will be ILLEGAL and they should be ready to stand and fight!

    Whatever it takes to pass healthcare. Following last Nov 09′s NY-23 election, Pelosi had Owens-D sworn in immediately to vote on the house healthcare reform (HCR) bill with full knowledge that NY State had not yet certified the results. No problem for Pelosi….she simply needed his vote, so laws and constitution be damned.

    A large reason that certification had not occurred was that Owens-D, fearing Hoffman-R would win and get to the Hill to vote against HCR, had premptively contested the results to slow the potential certification of Hoffman until after the vote. This was known by Pelosi (probably had her fingers all over it) at time of the rushed swearing in. Clearly laws are only a one way street for Dems, to either wield or ignore, to force their agenda on the People.

    The problem comes if you are the one who holds the contract directly with the federal government, because then you’re receivng money directly from the US govt. Employees of contractors get their pay from the contractor, not the federal government.

    ?This is a stunning admission by Paul Kirk and the Beacon Hill political machine today. Paul Kirk appears to be suggesting that he, Deval Patrick, and Harry Reid intend to stall the election certification until the health care bill is rammed through Congress, even if that means defying the will of the people of Massachusetts. As we?ve already seen from the backroom deals and kickbacks cut by the Democrats in Washington, they intend to do anything and everything to pass their controversial health care plan. But threatening to ignore the results of a free election and steal this Senate vote from the people of Massachusetts takes their schemes to whole new level. Martha Coakley should immediately disavow this threat from one of her campaign?s leading supporters.?

    What else would you expect from a party that routinely runs roughshod over the rules to benefit itself?
    If Brown wins, and the Dems pull this stunt, it will mark the 3rd time in a little over 5 years they’ve screwed around with the rules to benefit themselves.
    They do it because they CAN. There’s no threat of losing their offices–not in this state. And there’s no threat the local media will call them on it–not in this state.

    Not the actions of a confident bunch.

    I think this is also part of that strategy. The union guys who object to the Cadillac tax might just stay home without hope on blocking this HCR. It still is a threat, but it also has the intention of supressing Brown supporters inside and outside of MA.

    That seems to be the problem, here I am doing what I can but where is the support. Every Republican in congress should have been doing something about this. You know the other side would have. Even now, they should be at least crying foul over one illegal member and vote but no.
