Why is Gov. Paterson (D, NY) flirting with impeachment?

Article I, Section 2, US Constitution :

When vacancies happen in the Representation from any State, the Executive Authority thereof shall issue Writs of Election to fill such Vacancies.

Henrietta, NY — Multiple Democratic sources now confirm that party chairs decided Monday night that Matthew Zeller is their candidate should a special election to replace Rep. Eric Massa take place.

As Jim Geraghty notes , there should be no ‘should’ here; the US Constitution is not ambiguous about the subject.  There is a vacancy in NY-2329 [Oops!] its citizenry have the Constitutional right to representation with all due speed; complaints may be directed to the former office holder. Subject closed.

I assumed that this report was simply an April Fool’s joke, but surely the governor is not seriously considering ignoring his mandated duty under the law?

Even if he is a Democrat?

    He’s never felt the Constitutions of the USA or New York state, nor the laws of either, applied to him personally.

    After all, he’s a “double minority” being both black AND disabled since he is blind. Well, “legally blind,” anyway – he can see just poorly enough to collect a check for it.

    Perhaps, if it suits their needs. Otherwise we are dealing with “living constitutions”, or crisis, or emergencies, whatever will offer cover for their depraved power lusts.
    And at first I thought Bill Clinton was the only psychopath.

    And guyaverage it is 29. Patterson called/approved/graciously allowed the voters of dists 20 & 23 to have special elections when they needed them but to fill Massa’s seat—nooooo. And it has nothing to do with money. Its because the republicans had a decent shot of getting this. Its not fair!. He cheats! Put it in a special election diary yesterday and was hoping someone would bring it to the forefront to see how stupid this is.

    Here in Massachusetts, all we heard last summer after Kennedy died was “the people need full representation as soon as possible.”
    So the Dems changed the rules. Ended up biting them in the a**, of course.

    Looks like the NY Dems want to play games too.

    I am a New Yorker and this state is pretty broke and while I hate the mail ballots in ( if voters can’t get themselves to voting boxes on election day I don’t think they should vote) I wouldn’t condone it. Hawaii is doing same thing for their special election

    New York doesn’t have its primary till Sep so I assume that would be too far away and sorta pointless when election is 2 months later ( i hate the late primaries like that too to be honest)
