Illegal Immigrant Charged For Raping Teen Girl Was Previously Caught, Released Under Obama Admin

An illegal immigrant has been charged with raping a 14-year-old Maryland high school student.

18-year-old Henry Sanchez Milian was detained by Immigration and Customs Enforcement (ICE) agents at a border crossing in August 2015 near McAllen, Texas, and was released by the Obama administration.

Milian’s lawyer argues that he crossed the border into the United States because he was was fleeing gang violence in his home country of Guatemala, according to WUSA-TV.

WUSA also indicates:

He was detained at a refugee resettlement center for 12 days because he was a minor. Sanchez Milian was released and given notice to appear in immigration court, but a date wasn’t set because he wasn’t a priority case. Priority court dates are given to illegal immigrants with criminal records or have a gang affiliation.

 

The Obama administration famously championed the “catch and release” policy, meaning that immigrants fleeing drug wars in Mexico and Central America could apply for refugee status as soon as they were detained at the border.

Following their detention, the immigrant would normally be given a court date to have their refugee request heard before a Judge.

Conversely, the Obama administration allowed the immigrant to released instead of detaining them until their court date. As a result, illegal immigrants would travel to various parts of the U.S. where they had friends or family.

The Trump administration is seeking to end this program.

This dreadful case didn’t receive much national attention until it was revealed that Sanchez Millian had an “alien removal case” pending against him.

Jose Montano, 17, was also arrested by investigators in connection to the rape allegations. However, because Montano is a minor, ICE has not released any information on him to the public.

Sanchez Milian and Montano, who are both in 9th grade at Rockville High School in Rockville, Maryland, are accused of raping a 14-year-old girl in a school bathroom after she refused to have sex with them.

Sanchez Milian’s lawyer argues the sexual encounter was “consensual,” therefore rape did not occur.

Authorities have charged the both illegal immigrants with first-degree rape and two counts of first-degree sexual offense. They are also charging Montano as an adult.
