The AP is reporting that the State of Montana is preparing to take on the Federal Government over states rights.
“In a bill passed by the Legislature earlier this month, the state is asserting that guns manufactured in Montana and sold in Montana to people who intend to keep their weapons in Montana are exempt from federal gun registration, background check and dealer-licensing rules because no state lines are crossed.”
and
“It’s a gun bill, but it’s another way of demonstrating the sovereignty of the state of Montana,” said Democratic Gov. Brian Schweitzer, who signed the bill.
Note the article quoted Democratic Governor Schweitzer, obviously not cut from the same cloth as the Obama wing of the party. My personal tendency was to think the “new Socialist Democrats” had replaced pretty much all the Blue dogs. It appears that I must re-evaluate my position.
The federal government has twisted the Commerce Clause to regulate practically anything you can name, so it will be interesting to follow this through the courts.
A candidate to notify the BATF of his intentions to manufacture rifles in Montana for Montana citizens is being sought.
Upon the expected receipt of BATF’s notice that he can’t do that, the court battle will begin. Manufacture of the rifles will not be necessary to start the court battle.
Supporters state that the Made in Montana stamp on the product makes it different from the 2005 California Federal marijuana case, since California marijuana looks pretty much like Oregon marijuana and so forth. The look alike argument seems pretty silly since all firearms manufactured in the last 40+ years will have a serial number.
The author of the bill sums it up best:
“Firearms are inextricably linked to the history and culture of Montana, and I’d like to support that,” said Montana state Rep. Joel Boniek, the bill’s sponsor. “But I want to point out that the issue here is not about firearms. It’s about state rights.”
In an age of the massive Federal power grab, this will be an interesting story to follow….

As for the whole REAL ID thing, The feds finally stopped pestering us about it when Schweitzer told them to shove the whole thing where the sun don’t shine. Don’t be fooled though, there are plenty of liberals here. They just confine themselves to two major communes: Missoula and Whitefish. The rest of the fourth largest state in the union is populated by cowboys welders and nuke silos. And you are right, Schweitzer is not a run of the mill Dem, even if our two senators are. The man supports abortion and same sex marriage, and he has done a lot to bring “green” energy sources like biofuels and wind energy to our state; but he has a passion for freedom and liberty and for that we love him.

Unless something wierd happens or it becomes some National cause celebre, it will pass. Red states really should be taking all sorts of things like this on. Let the Fed enforce the State borders. If the product is manufactured in a state for use in that state, it is none of the Fed’s business unless it is taken to another state that cares. Only then is it a federal issue. Does this sound a little like Fugitive Slave Act arguments to those of you who know some history? I’m feeling the need to poke pointy sticks at the US Government!

Although, technically, a case can be made that the commerce clause does not provide the federal government any authority in your scenario as well. At least with regard to anything having to do with gun registration, licensing, etc. The Federalist papers indicate, and Madison spoke of, “commerce” referring to nothing more that “trade.” It was included to keep the states from throwing up crazy tariffs against one another and inhibiting trade amongst the states. The commerce clause was supposed to setup a framework in which the states would freely trade with each other. Ironically, its effect has been just the opposite by stifling businesses and killing our manufacturing infrastructure.

But don’t be fooled by Schweitzer. He signed it because he had to.
The man hates guns as much as any Democrat does.
He has privately boasted of fixing elections and privately whispered his hatred of having to put on a “show” of supporting the Second Amendment. In particular, he comments that he dressed up like a “yokel” and posed with a gun while on horseback, because he had to, to get elected.
He’s a socialist, and was just as wrapped up in the New Party as Obama was, as Jon Tester was, and as Max Baucus was. He’ll turn on the Second Amendment first chance he gets. I should say “is,” because they never really went anywhere. They just infiltrated, like lice.
