The Unconstitutionality Of Card Check

Richard Epstein does the compelling analysis. From a political standpoint, card check legislation is so egregiously bad and unpopular that any opponent would be tempted to welcome a political fight over it, in the hopes that in the process of defeating card check legislation, opponents could also inflict some serious political wounds upon those who support such legislation. To be sure, there is the danger that card check legislation might somehow pass, but at this stage, it is doubtful (to say the least). In order to get the Republican Party off its back politically, an invigorating fight over card check legislation–and the victory that would hopefully follow–may well be just what the doctor ordered.

I thought that Epstein did a fine job, too. I posted a link to his piece on my The Union Label Blog.

Apparently Hilda Solis, the Secretary-designate, is a big EFCA supporter.

Let’s make sure she has the opportunity to place herself on record, for the public to hear and read, by explaining why she supports EFCA…and why Americans should support it, too.

It would be a good thing

Except, of course, it would require the Republicans in the Senate to have a spine, and for Senator McCain to not lead his cohorts over to the opposition. Does anyone really think that to get the next McCain-[Random Liberal Democrat] bill passed he wouldn’t give up just about anything that’s not earmark related? Card check? No problem. Scary looking weapons ban and huge ammo tax? Sure.
