Revisiting a smart card based guest worker program.

A workable guest work program would profit America.

Main principle anyone qualified can come to the country to work.

To Qualify

You must submit DNA, prints, and Photo identification. You must pass a “Pee Test” for drugs and common communicable diseases. Your data is submitted through national and international criminal databases and to qualify you must not have a criminal record or be a fugitive from justice. This data, and all your information goes into a database open to the public (with need to know limitations) and if you pass you are issued a guest worker smart card that replaces ALL other forms of ID. You have 90 days to prove you are gainfully employed.

To Remain.

You can stay as long as your are gainfully employed, free of criminal or health issues and prove it every 90 days. A company (i.e. Quest Diagnostics) will administer a DNA based ID test, perform blood and drug testing. The guest worker will submit all income, employer data, and housing data. The income will be verified against department of tax records and the cost of housing will be analyzed against verified income to determine a ration for the subject value “gainfully employed”. Those that meet the requirements will have there smart card updated for another 90 days. The fee for this is borne by the guest worker, or their employer.

Conditions of termination and compensation to the citizens.

There is no reason to demand that people become citizens. Many people who come here to work, and earn wages they cannot match in their native country may not want to stay. And they shouldn’t be forced to stay. Therefor no preference is given to guest workers and like anyone they are required to go through the full process of immigration. While a guest worker they are not entitled to benefits intended for citizens. This includes food stamps, welfare, housing assistance, government disability insurance and they do not accumulate credit towards Social Security. Remember they can stay only as long as they are gainfully employed. They do however have to pay all local, state and federal taxes towards these things and anything else. Congress can choose to reduce or eliminate the standard exemption as an additional fee for the right to work here.

The guest worker can purchase insurance against job loss, disability and health issues the same as anyone. However they still must prove gainful employment, and remain free of health issues and criminal activity, otherwise there right to stay is rescinded.

Enforcement.
It is a felony to remain in the country on an expired guest workers card, Since anyone can get a card except criminals and the dangerously ill, this is fair. Since anyone can stay if they are a worker gainfully employed, this is fair. Since Citizen of past generations built the country that provides so many opportunities paying into their old age support is a fair way to compensate them and us.

Who has access to this information.
The guest worker smart card will link to a database where complete records are kept. If the guest worker qualifies for a drivers license (common or commercial) the smart card will serve as the only required ID. Employers will use the card to access the data base and get employment, training, education and housing experience, as well as validating the right to remain in the country. Employers can use common computer finger print devices to compare individuals for absolute identifications to prevent fraud. Medical records will be available to authorized medical personnel. Income, credit and housing history will be available to any landlord. And of course all DNA, Print, Iris scans, Identifying photos will be available to law enforcement,

If we are going to talk about immigration reform, lets start here. Recognized that there is a difference between someone who wants to come here and earn a good living, and someone that wants to adopt the USA as their country forever. It simplifies the discussion.

      Well, What is it?
      No better place to explain then right here!
      Lets start a discussion. What is different from this, above, and what do you think needs expanding or changing. This is a summary from a much longer old post with lots of “whys and hows” and a conversation that addressed a lot of concerns. I would like to see you ideas and compare.

        The short version of the differences is that in my plan, the smart card would also be a bank/atm card; businesses wouldn’t pay their workers directly, it would go through the federal government which would take a flat 20 percent in taxes; there wouldn’t be a need for workers to tell the government that they’re working because the gov’t would already know via the pay to the worker; workers that aren’t working would be given (say) 3 weeks to find another job or leave the country (they would have to stay out of the country for an equal amount of time that they spent not working), if they don’t leave in time they can be immediately deported and the amount of time before they can re-enter increases substantially.

        The program would also keep track of how much each worker has worked in the United States, which would allow for certain types of benefits (e.g. getting a drivers license) to become available once they reached certain levels. Courts would be able to penalize them by taking away some or all of this time, or adding time that needs to be spent outside the country, or even permanent banning, for those that are convicted of a crime, depending on the level of crime.

          The data base contains all information about the user. From blood type and finger prints, photos, identifying marks, DNA samples, to licenses certifications and history. Where they lived, where they worked, what the earned. And through the 90 certifying process we get details on all expenditures for housing. Plus maintaining a record drug testing and communicable disease testing. And this information is available to anyone with a need. And that would be a low threshold, for example, a school, local police, even neighborhood watch could have access. In fact, anyone could have access to some information about anyone carrying this card. It might only be access to the “active/legal” or “inactive/detain” category but all the information about everything this person would be accessible via the card through the database. Or via government and business access.

          You misunderstood the reason for the 90 re-certification requirement. The government already knows who is working by employment tax submissions now. The purpose of the 90 re-certification requirement is to catch employers who are not paying the taxes. It also it to catch people who are using drugs or contract communicable diseases. There is no cost to the government, the process is paid for by the guest. If they can’t pay for it, then they are not gainfully employed and must leave. By making re-certification the guest workers responsibility you can make failing to do that a crime and

          Keep in mind we didn’t talk about what the penalties would be for staying in the country illegally. Since anyone gainfully employed can remain as long as they re-certify regularly anyone who fails to stay would be subject to harsh penalties.

          A first offense would mean 6 months in jail and two years ban on returning to the country At the time of the original post (2004 maybe) a second offense would be two years in prison, but not here. I had the idea that we should use commercial prisons in Iraq. Pay to ship them there and pay the Iraq corporations that run the prisons to house them. Once they get out (and the corporate prisons have no incentive to let them out early) they would either have to pay their way back from Iraq to their home country or petition their government for help. Since they are not American citizens this would become their governments problem.
          But I didn’t want to get into that specifically.
